MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
JANUARY 20, 2004
Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 8:45 a.m. Members present were: Pat Harney, Terrence Neuzil, and Carol Thompson; absent: Mike Lehman and Sally Stutsman.
Unless otherwise noted, all actions were taken by the following roll call: aye: Harney, Neuzil, Thompson; absent: Stutsman, Lehman.
RESOLUTION 01-20-04-01
TO SET A DATE FOR A PUBLIC HEARING FOR A PROPOSED GRADE, DRAIN AND PAVE PROJECT ON SAND ROAD (W66) IN SECTION 2, T78N, R6W, AND SECTIONS 22, 26, 27, 34 AND 35, T79N, R6W PROJECT NUMBER STP-S-C052(67)--5E-52
Whereas, Johnson County, State of Iowa, proposes to acquire property under the power of Eminent Domain for a public improvement project, pursuant to the provisions of Section 6B.2A of the Code of Iowa, for the purpose of a Grade, Drain and Pave Project on Sand Road (W66) in Section 2, T78N, R6W, and Sections 22,26,27,34 and 35, T79N, R6W, Project Number STP-S-C052(67)--5E-52, and it is necessary to set a date of meeting of the Johnson County Board of Supervisors, at which it is proposed to consider taking action on the proposed public improvement project and to give notice thereof as required by such law;
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, as follows:
Section 1. This Board of Supervisors shall meet on the 29th day of January, 2004, at the Johnson County Administration Building, located at 913 South Dubuque Street, Iowa City, Iowa at 9:00 a.m., at which time and place a hearing will be held and proceedings will be instituted to consider funding the site-specific design for public improvement, final selection of the route or site location for the public improvement, and to authorize acquisition of private property needed for the project by condemnation proceedings if necessary.
Section 2. The County Engineer is hereby directed to give notice of the proposed public hearing to consider funding the site-specific design for public improvement, final selection of the route or site location for the public improvement, and to authorize acquisition of private property needed for the project by condemnation proceedings if necessary. The Auditor is hereby directed to provide notice by publication not less than 4 nor more than 20 days before the meeting in a legal newspaper, which has a general circulation in Johnson County.
Motion by Thompson, second by Harney, to approve Resolution 01-20-04-01.
