MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
FEBRUARY 5, 2004
Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Lehman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Thompson, second by Stutsman, to approve the minutes of the formal meetings of January 29, 2004 and February 2, 2004.
Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to sign the Premises Update form for Baxa’s Sutliff Store and Tavern, Sutliff, as submitted by Randy Howell.
Motion by Harney, second by Thompson, to accept the Recorder’s Report of Fees Collected for the month of December, 2003, in the amount of $178,369.50, as submitted by County Recorder Kim Painter.
Convened Public Hearing on Fiscal Year 2004 Budget Amendments at 9:04 a.m.
Budget Coordinator Jeff Horne presented the Fiscal Year 2004 Budget Amendments. No one from the public was present to speak.

RESOLUTION 02-05-04-B1
AMENDING THE FISCAL YEAR 2004 JOHNSON COUNTY BUDGET
Whereas, the Board of Supervisors has held a public hearing pursuant to Chapter 331, Code of Iowa, to amend the fiscal year 2003-2004 County Budget; and
Whereas, the explanation of changes is as follows:

Whereas, after consideration of all comments at said hearing the Board of Supervisors has determined that it will be necessary to amend the 2003-2004 budget; and
Whereas, the amendment does not increase taxes to be collected in the fiscal year ending June 30, 2004.
Therefore be it resolved that the following expenditures of the fiscal year 2003-2004 county budget be amended:
EXPENDITURES (by Service Area):
Public Safety service area by $11,839 to $11,476,591
Health & Human Services service area by $8,021 to $6,326,074
Mental Health service area by $2,432 to $9,491,783
County Environment & Education service area by $4,229 to $2,274,580
Administration service area by $252,945 to $5,038,187
Capital Projects service area by $532,888 to $4,333,043
REVENUES (by type):
Intergovernmental revenues increase by $11,839 to $15,264,785
Miscellaneous revenues increase by $120,000 to $1,488,403
Use of Money & Property decrease by $175,000 to $480,401

RESOLUTION 02-05-04-B2
CHANGING DEPARTMENTAL APPROPRIATIONS
Whereas, the Board of Supervisors has held a public hearing pursuant to section 331.434(3), Code of Iowa, to amend the fiscal year 2003-2004 County Budget; and
Whereas, the explanation of changes is contained in Resolution 02-05-04-B1; and
Whereas, the amendment does not increase the taxes to be collected in the fiscal year ending June 30, 2004; and
Whereas, all comments from the public have been heard.
Therefore be it resolved that the following department appropriations be changed as follows:
DEPARTMENT EXPENDITURES (Service Area):
Dept. 03-Auditor (Administration) increases $22,945 for ytd appropriation $821,195;
Dept. 18-Central Services (Administration) increase $120,000 for ytd appropriation $416,962;
Dept. 22-Insurance (Administration) increases $110,000 for ytd appropriation $731,740;
Dept. 23-Rural Block Grants (County Environment & Education) increases $4,229 for ytd appropriation $520,876;
Dept. 31-EMS Grant (Public Safety) increases $11,839 for ytd appropriation $22,074;
Dept. 40-Technology (Capital Projects) increases $437,888 for ytd appropriation 1,815,304;
Dept. 41-Institutional Accounts (Health & Human Services) increases $8,000 for ytd appropriation $46,450;
Dept. 44-Capital Expenditures (Capital Projects) increases $95,000 for ytd appropriation $318,970;
Dept. 50-Veteran Affairs (Health & Human Services) increases $21 for ytd appropriation $65,571;
Dept. 84-Leinfelder Trust (Mental Health) increases $2,432 for ytd appropriation 12,432.

RESOLUTION 02-05-04-B3
INCREASING CREMATION CERTIFICATE FEES
Whereas, Iowa Code Section 331.805(3)(b) requires that a permit for cremation be obtained from the County Medical Examiner; and
Whereas, House File 2453 Seventy-Ninth General Assembly, effective July 1, 2002, authorized cremation permit fees to be increased from $35 to $75; and
Whereas, The Johnson County Board of Supervisors desires to increase the fee from the current $50 level passed in Resolution 08-01-02-C1 to $75 to help reduce the amount of property tax needed for operation of the Medical Examiner Program;
Therefore Be It Resolved that the fee for a cremation permit to be issued by the Johnson County Medical Examiner is revised to $75.

RESOLUTION 02-05-04-B4
TRANSFERRING FROM THE ROAD CONSTRUCTION ESCROW FUND TO THE SECONDARY ROADS FUND
Whereas, $40,000 is budgeted to be transferred from the Road Construction Escrow Fund to the Secondary Roads Fund during the 2003-2004 fiscal year; and
Whereas, sufficient funds are available in the Road Construction Escrow Fund.
Therefore be it resolved that the Auditor is authorized to transfer $40,000 from the Road Construction Escrow Fund to the Secondary Roads Fund.
Motion by Lehman, second by Thompson, to approve Resolution 02-05-04-B4.
RESOLUTION 02-05-04-B5
TRANSFERRING FROM THE RESERVOIR ROADS TRUST FUND TO THE SECONDARY ROADS FUND
Whereas, $100,000 is budgeted to be transferred from the Reservoir Roads Trust Fund to the Secondary Roads Fund during the 2003-2004 fiscal year; and
Whereas, sufficient funds are available in the Reservoir Roads Trust Fund.
Therefore be it resolved that the Auditor is authorized to transfer $100,000 from the Reservoir Roads Trust Fund to the Secondary Roads Fund.
Motion by Harney, second by Thompson, to approve Resolution 02-05-04-B5.
Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to sign the Licensing Agreement with Scott County for rights to use and modify the Polk/Johnson County Mental Health/Developmental Disabilities software.
Motion by Harney, second by Thompson, to approve and authorize the Chairperson to send a letter of support for Ireland Avenue Revitalized Iowa’s Sound Economy (RISE) Grant.
Motion by Stutsman, second by Thompson, to appoint Douglas Ruppert to the Civil Service Commission for a term ending October 15, 2005.
