MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
MARCH 4, 2004
Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:02 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.
Unless otherwise noted, all actions were taken unanimously.
Motion by Lehman, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Thompson, to approve the minutes of the formal meeting of February 26, 2004.
Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
RESOLUTION 03-04-04-01
TO FIX A DATE FOR A PUBLIC HEARING ON A LOAN AGREEMENT
Whereas, Johnson County (the "County"), proposes to enter into a loan agreement (the "Loan Agreement") in the principal amount of $3,965,000 pursuant to the provisions of Section 331.402 of the Code of Iowa for the purpose of paying the cost, to that extent, of funding county health, property and casualty insurance programs; and
Whereas, it is necessary to fix a date of meeting of this Board at which it is proposed to take action to enter into the Loan Agreement and to give notice thereof as required by such law;
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, as follows:
Section 1. This Board shall meet on the 16th day of March, 2004, at the Johnson County Administration Building Boardroom, Iowa City, Iowa, at 9 o’clock a.m., at which time and place a hearing will be held and proceedings will be instituted and action taken to enter into the Loan Agreement.
Section 2. The County Auditor is hereby directed to give notice of the proposed action on the Loan Agreement setting forth the amount and purpose thereof, the time when and place where the said meeting will be held by publication at least once and not less than four nor more than twenty days before the meeting, in a legal newspaper of general circulation in the County.
The notice shall be in substantially the following form:
NOTICE OF PROPOSED ACTION TO INSTITUTE PROCEEDINGS TO ENTER INTO A LOAN AGREEMENT AND BORROW MONEY IN THE PRINCIPAL AMOUNT OF $3,965,000
The Board of Supervisors of Johnson County, Iowa, will meet on the 16th day of March, 2004, at the Johnson County Administration Building Boardroom, Iowa City, Iowa, at 9 o’clock a.m., for the purpose of instituting proceedings and taking action to enter into a loan agreement (the "Loan Agreement") and borrow money in the principal amount of $3,965,000 for the purpose of paying the cost, to that extent, of funding county health, property and casualty insurance programs.
The Loan Agreement is proposed to be entered into pursuant to authority contained in Section 331.402 of the Code of Iowa. The Loan Agreement will constitute a general obligation of the County.
At the aforementioned time and place, oral or written objections may be filed or made to the proposal to enter into the Loan Agreement. After receiving objections, the County may determine to enter into the Loan Agreement, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter.

Section 3. All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict.
Motion by Stutsman, second by Lehman, to approve Resolution 03-04-04-01.
Motion by Stutsman, second by Thompson, to approve and authorize the Chairperson to sign a contract for Youth Development State and Local Collaboration Demonstration project between the Iowa Department of Human Rights – Division of Criminal and Juvenile Justice Planning and Johnson County in the amount of $50,000.
Motion by Harney, second by Thompson, to approve and authorize the Chairperson to sign sub-contracts with United Action for Youth and the Iowa City Community School District for Youth Development for services rendered in State and Local Collaboration Demonstration project.
Motion by Stutsman, second by Lehman, setting March 30, 2004 at 10:00 a.m. as the bid letting date and authorizing the Auditor’s Office to publish a notice to bidders for the National Guard Sanitary Sewer project.
Motion by Harney, second by Stutsman, to approve and authorize the Chairperson to sign an Application For Fireworks Permit for Gene Zdrazil, 6090 River Junction Road SE, Lone Tree, on March 20, 2004.
