MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

APRIL 1, 2004

Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.

Unless otherwise noted, all actions were taken unanimously.

Motion by Lehman, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Harney, second by Stutsman, to approve the minutes of the formal meeting of March 25, 2004. Roll call: aye: Harney, Stutsman, Neuzil, Lehman; abstain: Thompson.

Motion by Thompson, second by Harney, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Motion by Thompson, second by Stutsman, to accept the Recorder’s Report of Fees Collected for the month of February, 2004, in the amount of $120,506.52, as submitted by County Recorder Kim Painter.

RESOLUTION 04-01-04-B1

NAMING DEPOSITORIES

Whereas, the Johnson County Board of Supervisors in Johnson County, Iowa approves the list of financial institutions to be depositories of Johnson County funds and specifies the maximum amount which may be kept on deposit in each depository, in conformance with Code of Iowa, section 12C.2, Deposit of Public Funds, Approval-requirements; and

Whereas, this resolution amends Resolution 09-18-03-B1;

Therefore be it resolved that the following depositories and maximum deposit balances be approved:

Motion by Stutsman, second by Thompson, to approve and authorize the Chairperson to sign right-of-way contracts with the following for acquisition for a shoulder widening and pavement rehabilitation project on Wapsi Avenue, Johnson County Project STP-S-C052(54)--5E-52: MAR-GIL Farm Corporation for $4,832.50; Lowell L. Baker and Helen A. Baker for $8,700.00; Arden Kasper and Alice Kasper Trust, Arden Kasper Trustee and Donald K. Werbach-CP, Nancy J. Werbach-CP and Charles R. Werbach-CP for $2,800.00; Kathryn M. Motion by Thompson, second by Harney, to approve and authorize the Chairperson to sign right-of-way contracts with the following for acquisition for a grading and paving project on Sand Road, Johnson County Project STP-S-C052(67)--5E-52: Phyllis W. Kelso for $6,072.00; and with Russell L. Winborn a/k/a Russell Winborn for $15,100.00.

Motion by Stutsman, second by Thompson, to set April 27, 2004 at 10:00 a.m. as the bid letting date and authorize the Auditor’s office to publish a notice to bidders for a bridge replacement project on Sand Road, Johnson County Project LFM-S-2-2--7X-52.

Motion by Harney, second by Stutsman, to approve and authorize the Chairperson to sign a contract with New Horizon FS, Inc. for seed and fertilizer to be used in calendar year 2004 in the amount of $18,274.90.

Motion by Lehman, second by Stutsman, to rescind the Johnson County Board of Health regulation Governing Daycare Centers as approved by the Johnson County Board of Health after holding a public hearing on March 10, 2004.

PROCLAMATION 04-01-04-01

NATIONAL PUBLIC HEALTH WEEK ON THE EFFECTS OF OVERWEIGHT AND OBESITY

Whereas, over the past 50 years, the United States has achieved significant increases in life expectancy and reductions in the incidence of injury, disability, and disease; and

Whereas, of the 30 additional years of life expectancy we have gained since the turn of the century, the public health approach is credited with the majority - approximately 25 years - of improvements in our health status and expanded life expectancy; and

Whereas, public health succeeds by identifying and addressing patterns of disease, illness and injury in populations; and

Whereas, the use of population-based strategies for disease and injury prevention, public health has contributed to the decline in illness and injury, including heart disease and stroke, tobacco related diseases, infectious diseases and motor vehicle and workplace injuries; and

Whereas, National Public Health Week provides the focused opportunity for the public and public health professionals to learn about public health concerns and success stories which are vital to healthy communities, such as immunizing against infectious disease, maintaining good nutritional standards and providing good prenatal care; and

Whereas, the National Public Health Week theme for 2004-Eliminating Health Disparities: Communities Moving from Statistics to Solutions-seeks to educate Americans about disparities in health and highlight community programs that have been successful at eliminating and reducing health disparities; and

Now, therefore I, Terrence Neuzil, proclaim April 5-11, 2004, as National Public Health Week for Johnson County Iowa, and commend this observance to all our citizens.

Motion by Thompson, second by Lehman, to approve Proclamation 04-01-04-01.

PROCLAMATION 04-01-04-02

IOWA NATIONAL GUARD 109TH MEDICAL BATTALION AND COMPANY A DAY

Whereas, the Army and Air National Guard contribute significant numbers of soldiers and airmen to America’s defense capability and, as such, are vitally important to our national security; and

Whereas, our Iowa National Guardsmen accept their role as defenders of our people’s freedoms and rights, and meet and exceed the readiness standards; and

Whereas, our Iowa National Guardsmen have been called to every major war and conflict our country has been involved in since Iowa became a state in 1846; and

Whereas, Iowa’s citizen-soldiers are continually on the vigil and ready to respond when called for a war or national emergency, or to protect the citizens of Iowa when disasters and emergencies occur within our state’s borders; and

Whereas, it has become nearly commonplace for our Guardsmen to support efforts such as the war in Iraq and the war on terrorism world-wide, and respond to floods, storms and calamities here at home; and

Whereas, the soldiers with the 109th Medical Battalion and the battalion’s Company A were called to duty to serve in the Iraq conflict; and

Whereas, the 150 soldiers with the 109th Medical Battalion and the approximately 60 members of the battalion’s Company A have returned from their tour of duty;

Now, therefore be it resolved, that the Johnson County Board of Supervisors do hereby proclaim April 1, 2004 as Iowa National Guard 109th Medical Battalion and Company A Day in Johnson County, Iowa and urge that the citizens of Johnson County, Iowa give full support of their efforts to keep our great state and nation a safer place to live.

Motion by Stutsman, second by Harney, to approve Proclamation 04-01-04-02.
