MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

APRIL 22, 2004

Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:02 a.m.  Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, and Carol Thompson; absent: Sally Stutsman.

Unless otherwise noted, all actions were taken by the following vote: Roll call: aye: Harney, Neuzil, Lehman, Thompson; absent: Stutsman.

Motion by Lehman, second by Harney, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors. 

Motion by Lehman, second by Thompson, to approve the minutes of the formal meeting of April 15, 2004.

Motion by Lehman, second by Thompson, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Motion by Thompson, second by Harney, to place on file the Sheriff’s Reports to the Board of Supervisors for the 1st and 2nd Quarters of Fiscal Year 2004 as submitted by County Sheriff Bob Carpenter.

Application Z04003 of Twin County Dairy, Inc., c/o and signed by John Roetlin, Kalona, Iowa, requesting rezoning of 0.64 acres from C2-Commercial District to M1-Light Industrial District of certain property described as being in the SW 1/4 of Section 19, Township 78 North, Range 7 West of the 5th P.M., in Johnson County, Iowa  (This property is located on the north side of 540th Street SW, approximately 250’ east of its intersection with Iowa Highway #1 SW in Sharon Twp.).

AN ORDINANCE AMENDING THE JOHNSON COUNTY ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM C2-COMMERCIAL DISTRICT TO M1-LIGHT INDUSTRIAL DISTRICT

SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Zoning Ordinance by changing the classification of the real estate described in Section II hereof from C2-Commercial District to M1-Light Industrial District.

SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Sharon Township and comprised of approximately 0.64-acres to wit:

COMMENCING AT THE SOUTHWEST CORNER OF SECTION 19, TOWNSHIP 78 NORTH, RANGE 7 WEST OF THE 5TH P.M., JOHNSON COUNTY, IOWA; THENCE N89º29'16"E, ALONG THE SOUTH LINE OF THE SOUTHWEST ONE-QUARTER OF SAID SECTION 19, A DISTANCE OF 247.50 FEET; THENCE N00º15'21"E, 33.00 FEET TO A POINT ON THE NORTHERLY RIGHT-OF-WAY LINE OF 540TH STREET SW AND THE POINT OF BEGINNING; THENCE CONTINUING N00º15'21"E, 231.00 FEET; THENCE N89º29'16"E, 87.00 FEET; THENCE S00º15'21"W, 231.00 FEET TO A POINT ON SAID NORTHERLY RIGHT-OF-WAY LINE; THENCE S89º29'16"W, ALONG SAID NORTHERLY RIGHT- OF-WAY LINE, 87.00 FEET TO THE POINT OF BEGINNING, CONTAINING 0.64 ACRE AND IS SUBJECT TO EASEMENTS AND RESTRICTIONS OF RECORD.

is hereby changed from C2 to M1.

SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.2 of the Johnson County Zoning Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

On April 15, 2004, motion by Stutsman, second by Neuzil, to waive the requirement of three considerations before amending an ordinance and to approve Application Z04003 on first and second consideration.  Roll call: aye: Harney, Stutsman, Neuzil, Lehman, Thompson.

Motion by Thompson, second by Lehman, to approve Application Z04003 on final consideration and to approve Ordinance 04-22-04-Z1.  Roll call: aye: Harney, Neuzil, Lehman, Thompson; absent: Stutsman.

PROCLAMATION 04-22-04-01

CRIME VICTIMS’ RIGHTS WEEK

Whereas, crime and the threat of violence have profound and devastating effects on individuals, families and communities in America; and

Whereas, over 24 million people in the United States are touched by crime each year; and

Whereas, crime in America results in significant physical, psychological, financial and spiritual effects on countless innocent victims; and

Whereas, crime victims in every state, U.S. territories and Federal jurisdictions have statutory rights to be kept informed of and involved in criminal and juvenile justice processes, and to be afforded protection, restitution and accountability from their offenders; and

Whereas, there are over 10,000 community- and system-based victim service programs across our nation that provide a wide range of services and support to victims of crime; and

Whereas, since 1983 the Office for Victims of Crime within the U.S.  Department of Justice has provided leadership to ensure that crime victims are treated with dignity and compassion; and

Whereas, America as a nation continues to face threats to our personal and public safety, and continues to commit its collective energies to help our fellow citizens who are hurt by crime;

Now, Therefore, Be It Resolved, that Johnson County proclaims the week of April 18 – 24, 2004 to be

Crime Victims' Week

and honors crime victims and those who serve them during this week and throughout the year;

And Be It Further Resolved, that we continue to fulfill the promise of justice and compassion for crime victims as individuals, as communities, and as a nation dedicated to justice for all.

Motion by Thompson, second by Harney, to approve Proclamation 04-22-04-01.

Motion by Harney, second by Thompson, to approve and authorize the Chairperson to sign a 28E Agreement with Coralville and North Liberty for design consulting fees for 12th Avenue Extension construction project.

Motion by Thompson, second by Harney, to appoint Terrence Neuzil as an ex-officio member of Johnson County Board of Supervisors for the Johnson County Task Force on Aging.

Motion by Thompson, second by Harney, to appoint Michael Stalkfleet to the Johnson County Commission of Veteran Affairs for a term ending May 31, 2007.

Motion by Lehman, second by Thompson, to approve and authorize the Chairperson to sign an Application For Fireworks Permit for Larry Bartlett, 2688 Hidden Valley Trail, for display at Hidden Acres Development, Solon, on July 3, 2004 with a rain date of July 5, 2004.
