MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 20, 2005

Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:01 a.m.  Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

Unless otherwise noted, all actions were taken unanimously.

Motion by Lehman, second by Harney, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Neuzil, second by Sullivan, to approve the minutes of the formal meeting of January 13, 2005.

Motion by Harney, second by Lehman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Application Z04017 of Craig D. Stark of Ely, Iowa, signed by Doug Frederick of Hart-Frederick Consultants, requesting rezoning of 7.15 acres from A2 Resort District to CP2 Planned Commercial District of certain property described as being in the NE 1/4 of the SE 1/4 of Section 16, Township 81 North and Range 6 West of the 5th P.M., in Johnson County, Iowa (This property is located in the NW corner of the Ely Road NE, and Highway 382 NE intersection in Big Grove Twp.).

Zoning Application Z04017

AN ORDINANCE AMENDING THE JOHNSON COUNTY ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM A2 RESORT DISTRICT TO CP2 PLANNED COMMERCIAL DISTRICT

SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Zoning Ordinance by changing the classification of the real estate described in Section II hereof from A2 Resort District to CP2 Planned Commercial District.

SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Big Grove Township and comprised of approximately 7.15  acres to wit:

Commencing at the East 1/4 corner of Section 16, Township 81 North, Range 6 West; thence N 89°54'42' W along the North line of the Southeast 1/4 of said Section 16, a distance of 1294.01 feet to the point of beginning of this description; thence S 49°32'37" E a distance of 1167.71 feet;  thence S 40°27'23" W a distance of 207.81 feet;  thence N 72°53'58" W a distance of 237.59 feet;  thence N 49°32'37" W a distance of 712.51 feet to a point on the West line of the East 1/2 of the Southeast 1/4 of Section 16, Township 81 North, Range 6 West; thence N 01°21'18' W along said West line, a distance of 383.77 feet to the Northwest corner of the Northeast 1/4 of the Southeast 1/4 of Section 16, Township 81 North, Range 6 West;  thence S89°54'42"E along the North line of the Southeast 1/4 a distance of 24.64 feet to the point of beginning containing 7.15 acres more or less and being subject to all easements and restrictions of record.

is hereby changed from A2 Resort District to CP2 Planned Commercial District.

SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.2 of the Johnson County Zoning Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

On January 13, 2005, motion by Lehman, second by Harney, to waive the requirement of three considerations before amending an ordinance and to approve Application Z04017 on first and second consideration.  Roll call: aye: Harney, Sullivan, Stutsman, Lehman, Neuzil.

Motion by Harney, second by Sullivan, to approve Application Z04017 on final consideration and to approve Ordinance 01-20-05-Z1.  Roll call: aye: Harney, Sullivan, Stutsman, Lehman, Neuzil.

Motion by Sullivan, second by Harney, to approve and authorize the Chairperson to sign the FY 06-07 collective bargaining agreements with Public Professional and Maintenance Employees Local 2003 for the Administrative Unit and Secondary Roads Department.
