MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
MARCH 10, 2005
Vice-Chairperson Lehman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, and Rod Sullivan; absent: Sally Stutsman.
Unless otherwise noted, all actions were taken by the following vote: Roll call: aye: Harney, Sullivan, Lehman, Neuzil; absent: Stutsman.
Motion by Neuzil, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Sullivan, second by Harney, to approve the minutes of the formal meeting of March 3, 2005.
Motion by Harney, second by Sullivan, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Sullivan, to accept the Recorder’s Report of Fees Collected for the month of January, 2005, in the amount of $170,007.92, as submitted by County Recorder Kim Painter.
Convened Public Hearing on Platting Applications at 5:32 p.m.
Application S04048 of Richard J. Schwab requesting preliminary and final plat approval of Schwab’s Barn, a subdivision described as being located in the NE 1/4 of the SW 1/4 of Section 10, Township 80 North, Range 6 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 6.81 acres, Farmstead Split, located on the south side of Scott Lane NE [a private road] accessed via Sugar Bottom Road NE, approximately 500’ north of its intersection with Anchorage Road NE in Newport Twp.).
Glen Meisner of MMS Consultants spoke in favor of the application.
RESOLUTION 03-10-05-Z1
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF SCHWAB’S BARN, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application S04048 for approval of a preliminary and final plat of Schwab’s Barn, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents:

Application S04059 of David G. Hahn requesting preliminary and final plat approval of Allegheny Heights, a subdivision described as being located in the SE 1/4 of the SE 1/4 of Section 29, Township 80 North, Range 5 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 11.88 acres, Farmstead Split, located at the end of Utah Avenue NE, approximately one mile north of its intersection with 340th Street NE in Graham Twp.).
Harney asked if the permanent right-of-way easement is dedicated to the County or if it remains property of the landowner. Tom Anthony of Landmark Surveying and Engineering said that the road, which is no longer maintained, is used by local farmers and has a gate to prevent the public from accessing it. Anthony explained that the landowners would like to have the road regraveled. In exchange for the maintenance, the landowners are giving the necessary right-of-way and providing a turnaround. Assistant County Attorney Andy Chappell said that the easement for the turnaround will be dedicated to the County, but the underlying ground will remain in ownership of the property owner.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF ALLEGHENY HEIGHTS, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application S04059 for approval of a preliminary and final plat of Allegheny Heights, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents:

Application S05001 of Craig Stark, signed by Scott Ritter of Hart-Frederick Consultants, requesting preliminary and final plat approval of Starks Acres, a subdivision described as being located in the NE 1/4 of the SE 1/4 of Section 16 and a part of the NW 1/4 of the SW 1/4 of Section 15, all in Township 81 North, Range 6 West, of the 5th P.M., in Johnson County, Iowa (This is a 3-Lot, 25.34 acre, Commercial/Residential Subdivision located in the northwest corner of the intersection of Ely Road NE and Highway 382 NE in Big Grove Twp.).

Application S05003 of Earl Hull, requesting preliminary and final plat approval of Hull’s Country Estates, a subdivision described as being located in the NE 1/4 of the SE 1/4 of Section 27 and the NW 1/4 of the SW 1/4 of Section 26, Township 79 North, Range 6 West, of the 5th P.M., in Johnson County, Iowa (This is a 2-Lot, 34.41 acre, Residential Subdivision located in the southeast corner of Sycamore Street SE and Sand Road SE in East Lucas Twp.).
Ralph Neuzil spoke in favor of the application.

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:

Motion by Neuzil, second by Sullivan, to re-set the public hearing for the FY 2006 budget on March 28, 2005 at 5:30 p.m. and authorize the Budget Coordinator to publish notice.
Motion by Harney, second by Sullivan, to appoint the following as Reserve Deputy Sheriff as recommended by County Sheriff Lonny Pulkrabek: Michael O’Brien, Sara Van Eck, Bret Duda, Jim Malmberg, Alan Reinier, Joshua Gersten, Howard Lewis, Kacie Waters, Rick Henley, and Chad Fiderlein.
Motion by Sullivan, second by Neuzil, to approve and authorize the Chairperson to sign an Application For Fireworks Permit for Thomas A. Dewey, 5054 Rapid Creek Road NE, Iowa City, on July 4, 2005 with a rain date of July 9, 2005.
Motion by Harney, second by Sullivan, to reappoint Michael Bowers and Tammy Rowe to the Targeted Case Management Advisory Board for a term ending April 1, 2006.
