MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

AUGUST 3, 2006

Chairperson Lehman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, and Rod Sullivan; absent: Sally Stutsman.

Unless otherwise noted, all actions were taken by the following vote: Roll call: aye: Harney, Lehman, Neuzil, Sullivan; absent: Stutsman.

Motion by Neuzil, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Sullivan, second by Harney, to approve the minutes of the formal meeting of July 25, 2006, and the July 25, 2006 canvass of votes for the Lone Tree Special Election.

Motion by Harney, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

RESOLUTION 08-03-06-01

RESOLUTION AWARDING AND AUTHORIZING EXECUTION OF CONTRACT FOR IMPROVEMENTS TO COUNTY PROPERTY AT 417 SOUTH CLINTON STREET, IOWA CITY, IOWA, TO RE-ROOF ALL OR PART OF THE JOHNSON COUNTY COURTHOUSE

Whereas, on the 29th day of June, 2006, after notice as required by law, a public hearing was conducted concerning the proposed plans, specifications and form of contract for, and the estimated cost of, improvement to county property at the Johnson County Courthouse, 417 South Clinton Street, Iowa City, specifically re-roofing all of the Johnson County Courthouse or, as Alternate 1, re-roofing only part of the Johnson County Courthouse as shown in the plans; and

Whereas, after said public hearing and hearing all the evidence presented, and on that date the Johnson County Board of Supervisors gave due consideration to and adopted a resolution approving said proposed plans, specifications, form of contract for, and the estimated cost of, said improvements, and providing that sealed bids for the construction of said improvements be solicited for receipt by the Johnson County Auditor no later than 2:00 P.M. Central Time, August 1, 2006, Notice to bidders being published pursuant to the Iowa Code; and

Whereas, at said time and place the bids were opened and the amounts of all bids announced and it was determined that the lowest responsive responsible bidder, determined pursuant to Iowa Code §§ 384.99-.100, was Advanced Builders Corporation of Cedar Rapids, Iowa, and said bid was for $382,000.000.

Now, Therefore, Be It Resolved that Advanced Builders Corporation of Cedar Rapids, Iowa, was the lowest responsive responsible bidder for the proposed public improvement, and that the bid amount is $382,000.00, for re-roofing all of the Johnson County Courthouse as shown in the plans previously adopted by the Board;

Be It Further Resolved that the Board hereby awards the contract for re-roofing all of the Johnson County Courthouse as shown in the plans previously adopted by the Board to Advanced Builders Corporation of Cedar Rapids, Iowa, and authorizes the Chairperson to sign any documents, including the previously approved form of contract, necessary to effectuate said award of contract in such manner as is consistent with Iowa law.

Motion by Neuzil, second by Harney, to approve Resolution 08-03-06-01.

Convened Public Hearing on FY 07 budget amendments at 9:10 a.m.

Executive Assistant Mike Sullivan and Budget Coordinator Rich Claiborne presented the proposed FY 07 budget amendments.  No one from the public was present to speak.

RESOLUTION 08-03-06-B1

AMENDING THE FISCAL YEAR 2007 JOHNSON COUNTY BUDGET

Whereas, the Board of Supervisors has held a public hearing pursuant to Chapter 331, Code of Iowa, to amend the fiscal year 2006-2007 County Budget; and

Whereas, the explanation of changes is as follows:

Expenditures increased for:

·        Physical Health and Social Services service area for Central Services Systems Unlimited Block Grants ($438,823)

·        County Environment and Education service area for Rural Basic Block Grants for Iowa City Library Block Grant ($9,625)

·        Non-Program & Other Financing Uses/Capital Projects service area  for Capital Expenditures for Planning & Zoning vehicle purchase ($35,000)

·        Non-Program & Other Financing Uses/Capital Projects service area for Elections department for a projector ($3,500)

·        Non-Program & Other Financing Uses/Capital Projects service area for Information Services department for vehicle purchase ($3,000)

·        Non-Program & Other Financing Uses/Capital Projects service area for Information Services department for office furniture ($24,000)

·        Government Services to Residents service area for Recorder’s Electronic Transaction account closing ($2)

Whereas, after consideration of all comments at said hearing the Board of Supervisors has determined that it will be necessary to amend the 2006-2007 budget; and

Whereas, the amendment does not increase taxes to be collected in the fiscal year ending June 30, 2007.

Therefore be it resolved that the following expenditures of the fiscal year 2006-2007 county budget be amended:

EXPENDITURE INCREASES (by Service Area):

Physical Health and Social Services by $438,823 to $7,544,924

County Environment and Education by $9,625 to $2,769,790

Government Services to Residents by $2 to $2,038,304

Motion by Sullivan, second by Neuzil, to approve Resolution 08-03-06-B1.

RESOLUTION 08-03-06-B2

CHANGING DEPARTMENTAL APPROPRIATIONS

Whereas, the Board of Supervisors has held a public hearing pursuant to section 331.434(3), Code of Iowa, to amend the fiscal year 2006-2007 County Budget; and

Whereas, the explanation of changes is contained in Resolution 08-03-06-B1; and

Whereas, the amendment does not increase the taxes to be collected in the fiscal year ending June 30, 2007; and

Whereas, all comments from the public have been heard.

Therefore be it resolved that the following department appropriations be changed as follows:

DEPARTMENT EXPENDITURES (Service Area):

Dept 18- Central Services (Physical Health and Social Services service area) increases $438,823 for YTD appropriation $1,106,793

Dept 23- Rural Basic Block Grants (County Environment and Education service area) increases $9,625 for YTD appropriation $568,908

Dept. 44- Capital Expenditures (Non-program and Other Finance Use/Capital Projects service area) increases $65,500 for YTD appropriation $322,670

Dept 90- Recorder’s Electronic Transaction (Government Services to Residents service area) increases $2.10 for YTD appropriation $2.10

Motion by Sullivan, second by Harney, to approve Resolution 08-03-06-B2.

RESOLUTION 08-03-06-T1

TRANSFERRING FROM THE GENERAL BASIC FUND TO THE CONSERVATION TRUST FUND

Whereas, the Board of Supervisors may periodically credit monies to the Conservation Trust Fund pursuant to section 350.6, Code of Iowa; and

Whereas, $64,495.97 is the amount of Conservation Department revenue collected within the General Basic Fund during the 2005-2006 fiscal year; and

Whereas, sufficient funds are available in the General Basic Fund.

Therefore be it resolved that the Auditor is authorized to transfer $64,495.97 from the General Basic Fund to the Conservation Trust Fund.

Motion by Harney, second by Sullivan, to approve Resolution 08-03-06-T1.

ORDINANCE 08-03-06-Z1

AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE TO PROVIDE THAT THE DISTRICT ZONING MAPS WILL BE MAINTAINED IN DIGITAL FORMAT.

Section I.  Purpose. The purpose of this ordinance is to further the stated purpose of the Johnson County Unified Development Ordinance for the unincorporated area of Johnson County by amending Chapter 8:1.5 Districts and Boundaries Thereof to require that the official zoning maps referred to as “District Maps,” will be maintained in a digital format.

Section II.  Amendments.  Chapter 8:1.5 is hereby amended by deleting Section 8:1.5(I) in its entirety and replacing with the following:

I. The Boundaries of the districts are shown upon maps which are made a part of this chapter and which maps are designated as the “District Maps.”  The District maps, and all the information shown thereon, are a part of this chapter and have the same force and effect as if the District Maps and all the information shown thereon were all set forth or described herein.  The originals of these maps are in digital format and are on file with the Auditor of Johnson County, Iowa.

Section III.  Repealer.  All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section IV.  Savings Clause.  If any section, provision, or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

Section V.  Effective Date.  This ordinance shall be in effect after its final passage and publication as part of the proceedings of the Board of Supervisors.

On July 13, 2006, motion by Sullivan, second by Stutsman, to approve on first consideration the Ordinance amending the Johnson County Unified Development Ordinance to provide that the district zoning maps will be maintained in digital format.  Roll call: aye: Harney, Stutsman, Lehman, Neuzil, Sullivan.

On July 20, 2006, motion by Sullivan, second by Stutsman, to approve on second consideration the Ordinance amending the Johnson County Unified Development Ordinance to provide that the district zoning maps will be maintained in digital format.  Roll call: aye: Harney, Stutsman, Lehman, Neuzil, Sullivan.

Motion by Sullivan, second by Harney, to approve on final consideration Ordinance 08-03-06-Z1, an Ordinance amending the Johnson County Unified Development Ordinance to provide that the district zoning maps will be maintained in digital format.  Roll call: aye: Harney, Lehman, Neuzil, Sullivan; absent: Stutsman.

Motion by Neuzil, second by Harney, to approve the approvals and denials of Homestead and Military credit applications for 2006 as recommended by County Assessor Bill Greazel.
