MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 11, 2007

Chairperson Harney called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

Unless otherwise noted, all actions were taken unanimously.

Motion by Sullivan, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Sullivan, second by Neuzil, to approve the minutes of the formal meeting of January 4, 2007.

Motion by Stutsman, second by Meyers, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Motion by Neuzil, second by Stutsman, to accept the Sheriff’s second quarterly report for FY 2007 as submitted by County Sheriff Lonnie Pulkrabek.

Convened Public Hearing on Platting applications and Zoning Ordinance Amendments at 5:33 p.m.

Subdivision Application #14530 of James and Hope Frantz requesting preliminary and final plat approval of Frantz Homestead, a subdivision described as being located in the SW 1/4 of Section 17, Township 78 North, Range 6 West, of the 5th P.M. in Johnson County, Iowa (This is a 2-lot, consisting of one farmstead split lot and one outlot totaling 1.77 acres, Farmstead Split Subdivision, located on the south side of 500th Street SW, approximately 1/4 mile east of its intersection with Naples Avenue SW in Liberty Twp.).

RESOLUTION 01-11-07-Z9

Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on January 8, 2007, filed its report and recommendations for certain actions;

Now, Therefore, Be It Resolved as follows:

1.  A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 8th day of February, 2007 at 5:30 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following subdivision application: 14662 (Marak).

2.  That the Johnson County Auditor be authorized to publish the official notice of above public hearing.

RESOLUTION 01-11-07-01

AMENDED RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND CERTAIN LEGAL DOCUMENTS OF TIMBERLAND ESTATES PART TWO, JOHNSON COUNTY, IOWA

Whereas, the owner of Timberland Estates Subdivision filed Johnson County subdivision application S04038 for approval of a preliminary and final plat of Timberland Estates Part Two; and

Whereas, the Johnson County Board of Supervisors, through Resolution No. 10-14-04-Z10, approved said plat which was subsequently recorded December 28, 2004 in Book 48 at Page 233 of the Records of Johnson County Recorder with the remaining subdivision documents being recorded December 28, 2004 in Book 3829 at Page 722 of the Records of the Johnson County Recorder; and

Whereas, while the Plat as approved and recorded was accurate, a scrivener’s error has been detected in the legal description utilized in many of the subdivision documents as approved and recorded; and

Whereas, the owner’s counsel has recorded an affidavit to clarify and correct the scrivener’s error in the legal description of the following previously submitted and approved subdivision documents:

Owners Certificate, Treasurer Certificate, Subdivider’s Agreement, four Fence Agreements, and Consent of Mortgagee, Hills Bank and Trust Company.

Said affidavit is recorded in Book 4119 at Page 308 of the Records of the Johnson County Recorder; and

Whereas, the owner seeks an amended resolution ratifying and confirming the previously recorded final plat and approving the subdivision documents with the correction to the scrivener’s error in the legal description.

Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:

1.   That the plat of Timberland Estates Part Two, Johnson County, Iowa as previously recorded is ratified and confirmed.

2.   That the Subdivider’s Agreement is hereby ratified and confirmed and the Owner’s Certificate, Treasurer’s Certificate, four Fence Agreements, and Consent of Mortgagee, Hills Bank and Trust Company, are hereby approved as previously recorded, with the understanding that all such documents have a scrivener’s error in the legal description for the area previously platted as Timberland Estates to Johnson County, Iowa, in that the phrase “Lots 1, 2, 3, 4, 5, and Outlot A of Timberland Estates to Johnson County, Iowa” should be “the North one-half of the Southeast Quarter of the Southwest Quarter of Section 7, Township 80 North, Range 5 West of the 5th P.M., Johnson County, Iowa, containing 20.13 acres”.

3.   This resolution is adopted after the recording of an affidavit from the owner’s counsel clarifying and correcting the scrivener’s error in the previously recorded subdivision documents.

4.   That the Chairperson is authorized and directed to sign this Amended Resolution Approving the Preliminary and Final Plat and Certain Legal Documents of Timberland Estates Part Two, Johnson County, Iowa.

PROCLAMATION 01-11-07-01

DEDICATION OF SYSTEMS UNLIMITED SERVICE CENTER

JANUARY 13, 2007

Whereas, Systems Unlimited, Inc. has been delivering quality services to individuals with developmental disabilities and children and families who are a part of the child welfare systems since 1971; and

Whereas, Systems Unlimited, Inc. has been preventing the institutionalization and assisting with the deinstitutionalization of people with disabilities thus saving county tax dollars; and

Whereas, Systems Unlimited, Inc. has been preventing the abuse and neglect of children through its child welfare services; and

Whereas, Systems Unlimited, Inc. has been assisting adults with developmental disabilities to be gainfully employed in the community; and

Whereas, Systems Unlimited, Inc. has completed the construction of its new agency Service Center which supports the operations of the entire agency;

Now, Therefore, I, Pat Harney, Chairperson of the Johnson County Board of Supervisors, do hereby express our congratulations and best wishes to Systems Unlimited, Inc. with its Dedication and Open House for its Service Center on January 13, 2007.

Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign the collective bargaining tentative agreement with the Public Professional and Maintenance Employees (PPME) unit of the Secondary Roads Department.

Motion by Sullivan, second by Stutsman, to approve and authorize the Chairperson to sign the collective bargaining tentative agreement with the Public Professional and Maintenance Employees (PPME) unit of the Administrative Unit.
