MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

FEBRUARY 8, 2007

Chairperson Harney called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

Unless otherwise noted, all actions were taken unanimously.

Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Sullivan, second by Stutsman, to approve the minutes of the formal meeting of February 1, 2007.

Motion by Neuzil, second by Sullivan, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Motion by Stutsman, second by Neuzil, to accept the Recorder’s Report of Fees Collected for the month of December, 2006, in the amount of $161,973.65, as submitted by County Recorder Kim Painter.

Convened Public Hearing on Platting applications at 5:33 p.m.

Subdivision Application #14662 of Darrell L. Marak, signed by Glen Meisner of MMS Consultants, requesting preliminary and final plat approval of Marak Commercial Subdivision Part Two, a subdivision described as being located in the SE 1/4 of the NE 1/4 and the NE 1/4 of the SE 1/4 of Section 8, Township 81 North, Range 7 West, of the 5th P.M. in Johnson County, Iowa (This is a 1-Lot, 11.55-acre, Commercial Subdivision, located on the west side of Highway 965 NW, approximately 1/2 mile south of its intersection with 120th Street NW in Jefferson Twp.).

Glen Meisner of MMS Consultants spoke in favor of the application.

Public Hearing closed at 5:40 p.m.

RESOLUTION 02-08-07-Z1

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF MARAK COMMERCIAL SUBDIVISION PART TWO, JOHNSON COUNTY, IOWA.

Whereas, the owner has filed application 14662 for approval of a preliminary and final plat of Marak Commercial Subdivision Part Two, and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:

1.  That said plat be approved.

2.  That the Chairperson be directed to sign said plat and Subdivider's Agreement.

3.  This Resolution requires the recording of the following documents:

A. Resolution & Documents: Approval from the City of Swisher; Certificate of the Owners; Title Opinion; Certificate of County Auditor; Certificate of Treasurer; Subdivider Agreement; Declaration of Fencing Responsibility; Agreement Concerning Roadway Right-of-Way; B. Subdivision Plat: Plats 5

Motion by Stutsman, second by Neuzil, to approve Resolution 02-08-07-Z1.

RESOLUTION 02-08-07-01

RESOLUTION OF SUPPORT INDICATING THAT THE IOWA CIVIL RIGHTS CODE BE AMENDED TO INCLUDE PROTECTIONS BASED ON SEXUAL ORIENTATION AND GENDER IDENTITY

Whereas, all Iowans deserve workplaces and communities that are free from discrimination and harassment, and;

Whereas, nineteen states and countless cities and local governments have already passed civil rights protections for their gay and lesbian citizens, and;

Whereas, in Iowa, eight cities, one county, the majority of colleges and universities, and several major employers including Pioneer Hi-Bred, Principal Financial, Wells Fargo, and Rockwell Collins protect gay and lesbian citizens and employees from discrimination, and;

Whereas, the majority of the United States population favors prohibiting discrimination based on sexual orientation and;

Whereas, the Johnson County Board of Supervisors supports civil rights policies that protect all people from discrimination in the work place, and recognize that all Iowans should be able to live and work without fear based on their race, gender, religion, ability, and sexual orientation

Now, Therefore Be It Resolved that the Johnson County Board of Supervisors hereby adopts this resolution in support of the Iowa Civil Rights Code being amended to include protections on “sexual orientation” and “gender identity.”

Motion by Stutsman, second by Meyers, to approve Resolution 02-08-07-01.

Motion by Sullivan, second by Stutsman, to approve the request for tax suspension at 2312 Nevada Avenue, Iowa City, Iowa for Dai To.

Recessed to Informal meeting at 5:44 p.m.; reconvened at 5:48 p.m.

Motion by Stutsman, second by Sullivan, to approve the grant application to Heritage to support an application to fund the Aging Specialist for a Livable Community initiative.

Motion by Sullivan, second by Stutsman, to approve and authorize the Chairperson to sign the contract with the State Department of Human Services Decat for funding to provide mental health and substance abuse evaluations and in-home substance abuse treatment to parents/caregivers whose children are placed in foster care.
