MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

MARCH 29, 2007

Chairperson Harney called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

Unless otherwise noted, all actions were taken unanimously.

Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Sullivan, second by Neuzil, to approve the minutes of the formal meeting of March 22, 2007.

Motion by Meyers, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

On March 22, 2007, motion by Neuzil, second by Meyers, to approve an ordinance establishing a School Infra-Structure Local Option Sales and Services Tax applicable to transactions within Johnson County on first consideration.  Roll call: aye: Sullivan, Stutsman, Harney, Neuzil, Meyers.

Motion by Sullivan, second by Stutsman, to approve an ordinance establishing a School Infra-Structure Local Option Sales and Services tax applicable to transactions within Johnson County on second consideration.  Roll call: aye: Sullivan, Stutsman, Harney, Neuzil, Meyers.

Motion by Neuzil, second by Sullivan, to approve and authorize the Chairperson to sign the negotiated purchase agreement to purchase land located at the southwest corner of Highway 6 and Lower Old Highway 6 from the sellers; James Kennedy and Mary Knowling for a purchase price of $108,000.00.  The said property contains 11.07 acres of which includes 3.28 acres of existing road easement.

Motion by Meyers, second by Sullivan, to approve and authorize the Chairperson to sign the Sheriff’s town contract for the provision of law enforcement services for the City of Solon. 

RESOLUTION 03-29-07-01

RESOLUTION STATING THE JOHNSON COUNTY BOARD OF SUPERVISORS RECOMMENDATION REGARDING RECENT ANNEXATION REQUEST BY THE CITY OF NORTH LIBERTY

Whereas, the Johnson County Board of Supervisors has held a consultation meeting with the City of North Liberty, and

Whereas, the Johnson County Planning Department has reviewed the request for the Board, and

Whereas, the Johnson County Board of Supervisors has reviewed the recent annexation request of the Alois Alberhasky property from the City of North Liberty.  The notice from North Liberty was received on February 27, 2007, and

Whereas, the North Liberty annexation request is in compliance with the Johnson County Fringe Area Agreement with North Liberty, and 

Whereas, the North Liberty annexation is eliminating a possible island situation, and

Whereas, the Johnson County Board of Supervisors encourage the City of North Liberty to complete the annexation in this area by annexing that portion of the CRANDIC railroad right-of-way from the NW corner of the Alberhasky property down to Forevergreen Road, and also take the land that is owned by Francis Xavier Lenane, and is described as the south 50 feet of the south 10 acres of the SE 1/4 of the SE 1/4 of Section 13 Township 80N, Range 7W which is Penn Township;

Now, Therefore, Be It Resolved By The Board Of Supervisors Of Johnson County, Iowa: that the Board of Supervisors recommends this North Liberty annexation request be approved by the City Development Board.

Motion by Stutsman, second by Meyers, to approve Resolution 03-29-07-01.

Motion by Neuzil, second by Stutsman, to appointment Reserve Deputy Sheriff Troy Lusk as recommended by County Sheriff Lonny Pulkrabek.
