MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
JANUARY 10, 2008
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Meyers, second by Stutsman, to approve the minutes of the formal meeting of January 3, 2008.
Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Convened Public Hearing on Platting Applications at 5:31 p.m.
Subdivision Application 14964 of Jeffrey Banas requesting preliminary and final plat approval of Morning Glory Subdivision, a subdivision described as being located in the SE 1/4 of the SW 1/4 and the SW 1/4 of the SE 1/4 of Section 1 Township 81 North, Range 7 of the 5th P.M. in Johnson County, Iowa (This is a 1 lot, 4.7 acre, Farmstead Split located on the north side of 120th ST NE approximately 1/4 mile east of Hickory Hollow Road NE in Jefferson Twp).
Glenn Meisner of MMS Consultants was present to answer questions.
RESOLUTION 01-10-08-Z1
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF MORNING GLORY SUBDIVISION, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application 14964 for approval of a preliminary and final plat of Morning Glory Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Motion by Neuzil, second by Harney, to approve Resolution 01-10-08-Z1.
Subdivision Application 15010 of Chris Mottinger, signed by Anna M. Mottinger, requesting preliminary and final plat approval of Mottingers First Subdivision, a subdivision described as being located in the NW 1/4 of the SW 1/4 of Section 6, Township 80 North, Range 5 West of the 5th P.M. in Johnson County, Iowa (This is a 2 lot farmstead split with 1 buildable lot and 1 outlot containing 20.56 acres, located at 2332 Highway 1 NE. It is located in the southeast corner of the intersection of Dillions Furrow Road NE and Highway 1 NE in Graham Twp).

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF MOTTINGERS FIRST SUBDIVISION, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application 15010 for approval of a preliminary and final plat of Mottingers First Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.

Magruder, requesting preliminary and final plat approval of Magruder Farms Second Subdivision, a subdivision described as being located in the SW 1/4 of the SW 1/4 of Section 31, Township 78 North, Range 5 West of the 5th P.M. in Johnson County, Iowa (This is a 1 lot, 1.86 acre, Farmstead Split located on the east side of Sioux Avenue SE approximately 500 feet north of its intersection with 580th Street SE in Lincoln Twp).
Scott Ritter from Hart-Frederick Consultants was present to answer questions.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF MAGRUDER FARMS SECOND SUBDIVISION, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application 15083 for approval of a preliminary and final plat of Magruder Farms Second Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Motion by Stutsman, second by Meyers, to approve Resolution 01-10-08-Z3.
Subdivision Application 15085 of John and Holly Wellendorf, signed by Holly Wellendorf, requesting preliminary and final plat approval of Digby Grove Second Subdivision, a subdivision described as being located in the SE 1/4 of the NE 1/4 of Section 5, Township 79 North, Range 5 West of the 5th P.M. in Johnson County, Iowa (This is a 1 lot, 2.18 acre, Farmstead Split located on the west side of Utah Avenue NE approximately 1200 feet north of its intersection with Fairview Cemetery Road NE in Scott Twp).
Glenn Meisner of MMS Consultants was present to answer questions. Harney asked if the 237 acres was all one parcel. Assistant Planner Josh Busard said it was one farmstead split for the 237 acres.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF DIGBY GROVE SECOND SUBDIVISION, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application 15085 for approval of a preliminary and final plat of Digby Grove Second Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Owners Statement; Title Opinion; Certificate of County Auditor; Certificate of County Treasurer; Covenant to Erect and Maintain Fence; Exhibit “A” Legal Description; Resolution Affirming the Stability of the Road System; Subdivider’s Agreement; Exhibit “A” (Parent Farm Description); B. Motion by Neuzil, second by Stutsman, to approve Resolution 01-10-08-Z4.
Subdivision Application 15086 of John Oaks Estate, signed by Mark Danielson, attorney for estate, requesting final plat approval of Lyn-den Heights Part III Phase I, a subdivision described as being located in the NE 1/4 of the NE 1/4 of Section 36 and in the N 1/2 of the NW 1/4 of Section 31, Township 80 North, Range 6 West of the 5th P.M. in Johnson County, Iowa (This is a 2 lot, 1 buildable lot and one outlot for future development, 38.67 acre Residential Subdivision located on the north side of Rapid Creek Road NE approximately 800 feet east of its intersection with Highway 1 NE in Graham and Newport Twp).
Sullivan asked about the right-of-way. Assistant Planning and Zoning Administrator R.J. Moore said the County is asking for only 60 feet of right-of-way as far as the new road, and 100 feet beyond that. Mark Danielson, representing the applicant, concurred on the deferral. Glen Meisner of MMS Consultants said the 100 foot right-of-way had been dedicated because at some point in the future a bridge will need to be replaced.
Motion by Neuzil, second by Stutsman, to continue public hearing and defer Application 15086 until January 17, 2008 at 9:00 a.m.
Motion by Neuzil, second by Meyers, to rescind the motion of January 2, 2008 and to authorize the designation of the Iowa City Press-Citizen, Lone Tree Reporter, Solon Economist, and North Liberty Leader as the official newspapers of Johnson County.
