MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
FEBRUARY 14, 2008
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Meyers, second by Stutsman, to approve the minutes of the formal meeting of February 7, 2008.
Motion by Harney, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Meyers, to place on file the Clerk’s Report of Fees Collected for the month of January, 2008, in the amount of $9,850.81, as submitted by Clerk of District Court Lodema Berkley.
Convened Public Hearing on Zoning and Platting Applications at 5:32 p.m.
Zoning Application 15114 of Michael Plotz requesting rezoning of 9.01 acres from R3-Residential to R-Residential of certain property described as being in the SW 1/4 of the SW 1/4 Section 16, and in the SE 1/4 of the SE 1/4 of Section 17, Township 81 North, Range 7 West, of the 5th P.M. in Johnson County, Iowa (This property is located on the west side of Highway 965 NW, approximately 2900 feet north of its intersection with Amana Road NW in Jefferson Twp).
Glen Meisner of MMS Consultants was present to answer questions. Neuzil said he was pleased that the applicant had worked with the County. Assistant Planning and Zoning Administrator R.J. Moore said the applicant would not move ahead with platting until spring.
Motion by Harney, second by Stutsman, to waive the requirement of three considerations before amending an ordinance and to approve Application 15114 on first and second consideration. Roll call: aye: Harney, Stutsman, Sullivan, Neuzil, Meyers.
Subdivision Application 15039 of Allan Meier requesting preliminary and final plat approval of Conklin Corner, a subdivision described as being located in the NE 1/4 of the SE 1/4 of Section 1, Township 81 North, Range 5 West of the 5th P.M. in Johnson County, Iowa (This is a 1 lot, 5.245 acre, Farmstead Split located on the east side of Yellow Pine Avenue NE approximately 1/2 mile south of its intersection with Clear Creek Road NE in Cedar Twp).

RESOLUTION 02-14-08-Z1
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF CONKLIN CORNER, JOHNSON COUNTY, IOWA
Whereas, the owner has filed application 15039 for approval of a preliminary and final plat of Conklin Corner, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be it Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Subdivision Application 15041 of Robert and Greg Miltner requesting preliminary and final plat approval of 2M Acres Subdivision, a subdivision described as being located in the SE 1/4 of the SW 1/4 of Section 5, Township 80 North, Range 5 West of the 5th P.M. in Johnson County, Iowa (This is a 1 lot, 2.535 acre, Farmstead Split located on the east side of Turner Avenue NE approximately 1 1/2 miles north of its intersection with Morse Road NE in Graham Twp).

Subdivision Application 15117 of Michael Bender requesting preliminary and final plat approval of Joshua First Subdivision, a subdivision described as being located in the NW 1/4 of Section 21, Township 81 North, Range 6 West, of the 5th P.M. in Johnson County, Iowa (This is a 2 Lot, 11.13 Acre, Residential Subdivision, located on the east side of Oak Avenue NE approximately 400 feet north of its intersection with Iowa Highway 382 NE in Big Grove Twp).

RESOLUTION 02-14-08-Z4
Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on February 11, 2008 files its report and recommendations for certain actions;
Now, therefore, be it resolved as follows:
1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 11th day of March, 2008 at 9:00 a.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following rezoning applications: 15126 (Kiracofe), 15127 (Twin County Dairy), and on the following subdivision applications:15007( Ruth Meyer Estate) 15040 (Stratton), 15084 (Prather), 15115 (Wonick), and 15129 (Ford).
2. That the Johnson County Auditor be authorized to publish the official notice of above public hearing.
Motion by Stutsman, second by Meyers, to approve Resolution 02-14-08-Z4.
Motion by Neuzil, second by Harney, to appoint Sally Stutsman to the Johnson County Council of Governments Transportation Committee.
Motion by Stutsman, second by Meyers, to appoint Amy Bouska to the County Trails Advisory Committee for a term ending December 31, 2009.
Motion by Neuzil, second by Meyers, to appoint Richard Tibbets to the Livable Community for Successful Aging Policy Board for a term ending June 30, 2008.
RESOLUTION 02-14-08-01
AUTHORIZING WEIGHT EMBARGOES ON SECONDARY ROADS
Whereas, the recent weather conditions have caused soft subgrade and surface conditions to develop on some Secondary Roads; and
Whereas, it is deemed to be in the best public interest and welfare to preserve the road system in the best possible condition; and
Whereas, Sections 321.471, 321.472, and 321.473 of the Code of Iowa provide local authorities the right to restrict the weight of vehicles;
Therefore, be it resolved that an embargo be authorized where necessary on the Secondary Roads System for Johnson County. The County Engineer is authorized beginning on February 14, 2008, to restrict gross loads on certain sections of the road system showing extreme distress at this time. He shall be authorized to restrict all traffic to an 8-ton gross load if necessary and to place temporary signs to comply with Section 321.472.
Motion by Stutsman, second by Harney, to approve Resolution 02-14-08-01.
Motion by Harney, second by Stutsman, to approve and authorize the Chairperson to sign a letter of support from the Board of Supervisors for the Lake MacBride/Cottage Reserve Road Embankment Stabilization Funding Application.
Motion by Stutsman, second by Meyers, to deny the City of Lone Tree request for use of STP funds available to the Johnson County Secondary Roads Department.

Motion by Harney, second by Stutsman, to authorize the location of the Joint Communications Center on County Farm property. Roll call: aye: Harney, Stutsman, Sullivan, Meyers; nay: Neuzil.
Motion by Stutsman, second by Neuzil, to appoint the following members to the Joint Communications Center Policy Board: Pat Harney, for a two year term, and Lonny Pulkrabek, for a one year term. Roll call: aye: Stutsman, Sullivan, Neuzil, Meyers; abstain: Harney.
Motion by Stutsman, second by Neuzil, to reduce the Compensation Board’s recommendation for Fiscal Year 2009 salary increases from 6% to 3.5% for all elected officials and their deputies.
Motion by Neuzil, second by Stutsman, to appoint the following persons as Reserve Deputy Sheriff, as recommended by County Sheriff Lonny Pulkrabek: Robert Armstrong, Michael Boley, Jerad Dieter, Brian Kahler, Joshua Kirchner, Jesse Lenz, Lucas Moses, Ryan Nidey, Gabriel Schaapveld, and Bradley Schramm.
Motion by Stutsman, second by Meyers, to set the public hearing on the Johnson County budget estimate for Fiscal Year 2009 on Thursday, March 6, 2008 at 5:30 p.m. and authorize the Auditor’s Office to publish budget hearing notice.
