MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

FEBRUARY 21, 2008

 

      Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Neuzil, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Stutsman, second by Meyers, to approve the minutes of the formal meeting of February 14, 2008. 

 

      Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Stutsman, second by Neuzil, to approve and authorize the Chairperson to sign: a Renewal Application for Class B Beer Permit (BB) (Includes Wine Coolers), Application for Outdoor Service Area, and Application for Sunday Sales Privilege for Hi Point Golf Course, Iowa City, as submitted by Scott Wood; and a Renewal Application for Class C Liquor License (LC) (Commercial), Application for Outdoor Service Area, Application for Sunday Sales Privilege, and Application for Catering Privilege for Pleasant Valley Golf Course, Iowa City, as submitted by Tom Hein.

AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM R3 TO R

 

SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described in Section II hereof from R3 to R

 

SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Jefferson Township and comprised of approximately 9.01 acres to wit:

 

Beginning at the Northwest corner of Lot B of Timber Lake Second Addition to Johnson County, Iowa; Thence S89°23’10”E, along the north line of said Lot B, 990.40 feet to the Northeast corner of said Lot B and a point on the westerly right-of-way line of State Highway No.965; Thence S01°19’22”E, along said westerly right-of-way line, 130.28 feet; Thence S18°18’01”E, along said westerly right-of-way line, 312.29 feet to a point on the northerly right-of-way line of proposed Horseshoe Circle NW; Thence N78°31’34”W, along said northerly right-of-way line, 302.09 feet; Thence northwesterly, 91.78 feet along said northerly right-of-way line and an arc of a 530.00 foot radius curve, concave southwesterly, whose 91.66 foot chord bears N83°29’08”W; Thence N88°26’52”W, along said northerly right-of-way line, 75.75 feet; Thence northwesterly, 31.96 feet along said northerly right-of-way line and an arc of a 30.00 foot radius curve, concave northeasterly, whose 30.47 foot chord bears N57°55’55”W; Thence northwesterly, 51.25 feet along said northerly right-of-way line and an arc of a 100.00 foot radius curve, concave southwesterly, whose 50.69 foot chord bears N42°05’49”W; Thence northwesterly, 184.64 feet along said northerly right-of-way line and an arc of a 334.34 foot radius curve, concave southwesterly, whose 182.30 foot chord bears N72°35’55”W; Thence southwesterly, 73.21 feet along said northerly right-of-way line and an arc of a 75.00 foot radius curve, concave southeasterly, whose 70.34 foot chord bears S63°36”59”W; Thence S35°39’08”W, along the westerly right-of-way line of said Horseshoe Circle NW, 16.67 feet; Thence southwesterly, 136.66 feet along said westerly right-of-way line and an arc of a 158.19 foot radius curve, concave easterly, whose 132.45 foot chord bears S10°54’12”W; Thence S79°16’39”W, 353.41 feet to a point on the westerly line of said Lot B; Thence N05°46’10”E, along said westerly line, 499.65 feet to said Point of Beginning, containing 9.01 acres and subject to easements and restrictions of record.

 

is hereby changed from R3 to R.

 

SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.I of the Johnson County Unified Development Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

 

SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitu­tional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

 

SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

 

      On February 14, 2008, motion by Harney, second by Stutsman, to waive the requirement of three considerations before amending an ordinance and to approve Application 15114 on first and second consideration.  Roll call: aye: Harney, Stutsman, Sullivan, Neuzil, Meyers.

 

      Motion by Harney, second by Meyers, to approve Application 15114 on final consideration and to approve Ordinance 02-21-08-Z1.  Roll call: aye: Sullivan, Stutsman, Harney, Neuzil, Meyers.

 

      Motion by Stutsman, second by Neuzil, approving and authorizing the Chairperson to sign a letter of appreciation and certificate to Richard Holmes for serving on the Johnson County Integrated Roadside Vegetation Management Committee.
