MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

MARCH 20, 2008

 

      Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Meyers, second by Stutsman, to approve the minutes of the formal meeting of March 11, 2008. 

 

      Motion by Harney, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Stutsman, second by Meyers, to place on file the Clerk’s Report of Fees Collected for the month of February, 2008, in the amount of $12,832.25, as submitted by Clerk of District Court Lodema Berkley.

 

      Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the affiliation agreement between Johnson County Mental Health/Developmental Disabilities Director and the Community Mental Health Center.

 

ORDINANCE 03-20-08-Z1

Zoning Application 15126

AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM MH-HEAVY INDUSTRIAL  TO C-COMMERCIAL

 

      SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described in Section II hereof from MH-Heavy Industrial  to C-Commercial

 

      SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Jefferson Township and comprised of approximately 0.21 acres to wit:

 

      Beginning at the Southeast Corner of Lot 2, Kiracofe's Subdivision, to Johnson County, Iowa, in accordance with the plat thereof recorded in Book 27, at Page 51, of the records of the Johnson County Recorder's Office; Thence S90°00'00"W, along the South Line of said Lot 2, a distance of 204.52 feet; Thence N02°04'18"W, 45.50 feet; Thence N89°59'58"E, 206.05 feet, to a point on the East Line of said Lot 2; Thence S00°09'00"E, along said East Line, 45.47 feet, to the said Point of Beginning. Said tract of land contains 0.21 acre, and is subject to easements and restrictions of record.

 

      is hereby changed from MH-Heavy Industrial to C-Commercial.

 

      SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.I of the Johnson County Unified Development Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

 

      SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

      SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

 

      SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

 

      On March 11, 2008, motion by Stutsman, second by Meyers, to waive the requirement of three considerations before amending an ordinance and to approve Application 15126 on first and second consideration.  Roll call: aye: Sullivan, Stutsman, Harney, Neuzil, Meyers.

 

      Motion by Neuzil, second by Meyers, to approve Application 15126 on final consideration and to approve Ordinance 03-20-08-Z1.  Roll call: aye: Sullivan, Stutsman, Harney, Neuzil, Meyers.

Zoning Application 15127

AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM A-AGRICULTURAL TO ML-LIGHT INDUSTRIAL

 

      SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described in Section II hereof from A-Agricultural to ML-Light Industrial

 

      SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Washington Township and comprised of approximately 18.19 acres to wit:

 

      A part of the Northeast One-Quarter of the Southeast One-Quarter of Section 24, Township 78 North, Range 8 West, of the Fifth Principal Meridian, Johnson County, Iowa, more particularly described as follows:  Beginning at the Southwest corner of the Northeast One-Quarter of the Southeast One-Quarter of Section 24, Township 78 North, Range 8 West, of the Fifth Principal Meridian, Johnson County, Iowa; Thence N01°02'40"E, along the West line of said Northeast One-Quarter of the Southeast One-Quarter, 1321.80 feet, to the Northwest corner of said Northeast One-Quarter of the Southeast One-Quarter; Thence S88°33'19"E, along the North line of said Northeast One-Quarter of the Southeast One-Quarter, 600.01 feet; Thence S01°02'40"W, 1319.99 feet, to a point on the South line of said Northeast One-Quarter of the Southeast One-Quarter; Thence N88°43'41"W, along said South line, 600.00 feet, to said POINT OF BEGINNING, containing 18.19 acres, and subject to easements and restrictions of record.

RESOLUTION 03-20-08-01

RESOLUTION OF NOTIFICATION OF INTENT TO APPLY FOR FUNDING FROM THE WASHINGTON COUNTY RIVERBOAT FOUNDATION FOR THE CONNECTING COMMUNITIES BY BIKE: THE CYCLIST’S ROAD-ROUTE MAP OF TOURISM FROM JOHNSON COUNTY TO NEIGHBORING COUNTIES

 

      Whereas, the Washington County Riverboat Foundation will be accepting grant applications to assist in funding projects that are of special interest in the area of economic development; and

 

      Whereas, Johnson County will be submitting an application requesting $15,500 for the Connecting Communities by Bike: The Cyclist’s Road-Route Map of Tourism from Johnson County to Neighboring Counties; and

 

      Whereas, Johnson County will provide a match in the amount of $2,000; and

 

      Whereas, Johnson County will conduct research to create and distribute a map of bicycle routes connecting Johnson County with surrounding counties calling attention to unique natural, historic, and commercial features along each route, such as Washington County’s Lake Darling State Park, Kalona Historical Village, and the Riverside Casino & Golf Resort; and

 

      Whereas, this resolution provides that the Chairperson of the Johnson County Board of Supervisors have the authority to sign the grant application before it is submitted for consideration,

 

      Now, Therefore Be It Resolved, by the Johnson County Board of Supervisors, that a grant application will be completed, signed, and submitted to the Washington County Riverboat Foundation for their consideration to fund the project Connecting Communities by Bike: The Cyclist’s Road-Route Map of Tourism from Johnson County to Neighboring Counties in the amount of $15,500.

 

      Motion by Stutsman, second by Meyers, to approve Resolution 03-20-08-01.
