MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
APRIL 17, 2008
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
PROCLAMATION 04-17-08-01
EARTH DAY
APRIL 22, 2008
Whereas, we are all children of the Earth, and human well-being is intricately woven within the complex web of life; and
Whereas, a healthy and diverse ecosystem is the keystone of a thriving community and vigorous local economy; and
Whereas, human activities are resulting in global and local environmental change to the detriment of human health and biological diversity; and
Whereas, we possess the potential to employ our abundant creativity and innovation, as well as education, to resolve this crisis of environmental degradation; and
Whereas, local communities can lead the way in taking such steps to protect and preserve our natural resources by encouraging sustainable energy and water consumption, land-use, transportation practices, and waste reduction; and
Whereas, there are compelling aesthetic, economic and social reasons for state and local governments to initiate and support sustainable community practices; and
Whereas, Earth Day offers citizens a unique opportunity to make a commitment to personal practices that will be vital in protecting the quality of human and other life for generations to come; and
Now, therefore, be it resolved that we, the Johnson County Board of Supervisors, do hereby proclaim April 22, 2008 to be:
Earth Day
in Johnson County, and urge all citizens to celebrate this special observance, and further, to reflect on ways that together that we can contribute to a healthy environment and make Johnson County an even greater place to live, work, and raise a family.
Motion by Stutsman, second by Harney, to approve Proclamation 04-17-08-01.
Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Meyers, to approve the minutes of the formal meeting of April 10, 2008.
Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Stutsman, to approve and authorize the Chairperson to sign: a Renewal Application for Class C Liquor License, Application for Outdoor Service Area, and Application for Sunday Sales Privilege for Black Diamond Road House, Oxford, as submitted by Gary Harding.
Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign: a Renewal Application for Class C Liquor License and Application for Sunday Sales Privilege for KC Building Association of Iowa City, Iowa City, as submitted by Randy Trca.
Motion by Harney, second by Meyers, to approve and authorize the Chairperson to sign: a Renewal Application for Class C Liquor License, Application for Outdoor Service Area, and Application for Sunday Sales Privilege for Saddleback Ridge Golf Course, Solon, as submitted by Ronald Rushek.
Convened Public Hearing on proposed plans, specifications, form of contract, and notice to bidders, for the Johnson County Health and Human Services Building Final Grading, Pavement and Parking Structure Project at 9:16 a.m.
Facilities Director David Kempf presented the proposed plans, specifications, form of contract, and notice to bidders, for the Johnson County Health and Human Services Building Final Grading, Pavement and Parking Structure Project. No one from the public was present to speak.
Public Hearing closed at 9:19 a.m.
RESOLUTION 04-17-08-01
RESOLUTION APPROVING PLANS AND SPECIFICATIONS, FORM OF CONTRACT, COST ESTIMATE AND REQUESTING BIDS FOR CONSTRUCTION OF JOHNSON COUNTY HEALTH AND HUMAN SERVICES BUILDING - PHASE II, FINISH GRADING, PARKING LOT PAVEMENT, SIDEWALKS, PARKING RAMP STRUCTURE AND LANDSCAPING
Whereas, a public hearing was conducted on the 17th day of April, 2008, concerning proposed plans, specifications and form of contract for, and the estimated cost of, construction of a Johnson County Health and Human Services Building Final Grading, pavement and Parking Structure Project; and
Whereas, the Johnson County Board of Supervisors has given due consideration to said proposed plans, specifications, form of contract for, and the estimated cost of, said construction and alternates along with objections and evidence for or against the same as reflected by the record of the public hearing.
Now, Therefore, Be It Resolved that the proposed Final Grading, Pavement and Parking Structure Project of a Johnson County Health and Human Services Building , is in the best interest of Johnson County; and
Be It Further Resolved that the estimated total cost of the Health and Human Services Building Final Grading, Pavement and Parking Structure Project is $ 3,500,000.00; and
Be It Further Resolved that the proposed plans, specifications and form of contract for, and the estimated total cost of said construction, are hereby approved as the plans, specifications and form of contract for, and estimated cost of said construction; and
Be It Further Resolved that sealed bids for the construction of said Health and Human Services Building Final grading, Pavement and Parking Structure, be solicited for receipt by the Johnson County Auditor, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, until 9:00 A.M. Central Time, May 13, 2008. Notice to bidders to be published pursuant to the Iowa Code; and
Be It Further Resolved that the bid security to accompany each bid for the construction of the project shall be in the amount of five percent (5%) of the amount of the bid; and
Be It Further Resolved that pursuant to Iowa Code Section 26.11, David Kempf, Johnson County Facilities Manager, is hereby delegated the duty of receiving and opening bids for this project, announcing the results, and reporting the results of the bidding with his recommendations to the Board of Supervisors at its next regular meeting or at a special meeting called for that purpose.

ORDINANCE 04-17-08-Z1
ZONING APPLICATION 15146
AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM A TO C-AG
SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described in Section II hereof from A to C-AG
SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Fremont Township and comprised of approximately 2.69 acres to wit:
A Portion Of The Northwest One-Quarter Of The Northeast One-Quarter Of Section 11, Township 77 North, Range 5 West Of The Fifth Principal Meridian, Johnson County, Iowa, More Particularly Described As Follows:
Beginning At The Northwest Corner Of Prairie Valley Subdivision, Part Two As Recorded In Book 52 At Page 19 In The Records Of The Johnson County Recorder, Johnson County, Iowa; Thence S00º42'58"W Along The West Line Of Said Subdivision, 836.69 Feet To The Southwest Corner Of Said Subdivision; Thence N70º39'06"W, 31.44 Feet; Thence N89º11'49"W, 112.80 Feet To The West Line Of The Northwest One-Quarter Of The Northeast One-Quarter Of Section 11, Township 77 North, Range 5 West Of The Fifth Principal Meridian, Johnson County, Iowa; Thence N00º48'11"E Along Said West Line, 824.72 Feet To The South Right-Of-Way Line Of Iowa Highway 22; Thence S89º59'44"E Along Said Right-Of-Way 141.36 Feet To The Point Of Beginning. is hereby changed from A to C-AG.
SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.I of the Johnson County Unified Development Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.
SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.
SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.
On April 10, 2008, motion by Stutsman, second by Harney, to waive the requirement of three considerations before amending an ordinance and to approve Application 15146 on first and second consideration. Roll call: aye: Harney, Stutsman, Sullivan, Neuzil, Meyers.

RESOLUTION 04-17-08-Z1
Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on April 14, 2008, filed its report and recommendations for certain actions;
Now, Therefore, Be It Resolved as follows:
1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 8th day of May, 2008 at 5:30 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following: 15159 (Lehman), proposed update of the 1998 Johnson County Land Use Plan, and the proposed Frytown Village Plan.
2. That the Johnson County Auditor be authorized to publish the official notice of above public hearing.
Motion by Neuzil, second by Meyers, to approve Resolution 04-17-08-Z1.
Motion by Neuzil, second by Stutsman, to approve the job reclassification of the full-time Clerk III to Clerk II in the Treasurer’s Office.
Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the contract and contractors bond with Binns and Stevens for the 2008 Johnson County Dust Control Safety Program in the amount of $217,801.00.
Motion by Harney, second by Stutsman, to approve and authorize the Chairperson to sign the contract and contractors bond with Big Country Seeds, Inc. for the 2008 Johnson County Seed and Fertilizer Program in the amount of $19,210.00.
Motion by Meyers, second by Neuzil, to approve and authorize the Chairperson to sign the contract and contractors bond with L.L. Pelling Company for the 2008 Bituminous Resurfacing Program (various locations) in the amount of $414,630.00 for Division 1 and $21,600.00 for Division 2 (Conservation Department) for a total of $436,230.00.

Motion by Stutsman, second by Harney, to approve and authorize the Chairperson to sign a letter of support for the City of Coralville for their Community Attraction and Tourism Application for the Coralville Center for the Performing Arts Project.
