MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
MAY 15, 2008
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Meyers, to approve the minutes of the formal meeting of May 8, 2008.
Motion by Harney, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Harney, to place on file the Clerk’s Report of Fees Collected for the month of April, 2008, in the amount of $16,457.72, as submitted by Clerk of District Court Lodema Berkley.
Motion by Stutsman, second by Meyers, to accept the Recorder’s Report of Fees Collected for the month of April, 2008, in the amount of $158,842.32, as submitted by County Recorder Kim Painter.
RESOLUTION 05-15-08-Z1
Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on May 12, 2008, filed its report and recommendations for certain actions;
Now, therefore, be it resolved as follows:
1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 12th day of June, 2008 at 5:30 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following: 15147 (Syngenta Seeds), 15221 (Kelsi Fobian), 15224 (Allan Serovy), 15225 (Julie Monson), 15228 (David Hein), 15230 (Mike Marak), and the proposed amendments to the 2008 Swisher/Johnson County Fringe Area Agreement.
2. That the Johnson County Auditor be authorized to publish the official notice of above public hearing.
Motion by Stutsman, second by Neuzil, to approve Resolution 05-15-08-Z1.
RESOLUTION 05-15-08-Z2
RESOLUTION APPROVING THE SITE PLAN BUD MILLER LOT 2 OF BUDS SECOND SUBDIVISION
Whereas, the owner has filed application 15232 for approval of a Site Plan lot 2 of Buds Second Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends approval.
Now, therefore be it resolved by the Johnson County Board of Supervisors:
1. That said site plan be approved
Motion by Harney, second by Stutsman, to approve Resolution 05-15-08-Z2.
RESOLUTION 05-15-08-Z3
Whereas, pursuant to Iowa Code Section 335.5 (2007), county zoning regulations must be made in accordance with a comprehensive plan; and
Whereas, the Board of Supervisors adopted the current Land Use Plan on December 31, 1998; and
Whereas, the Board of Supervisors finds that it is in the public interest to amend said Land Use Plan.
Now, therefore be it resolved by the Johnson County Board of Supervisors, that the amended Land Use Plan, copies of which can be obtained at the Johnson County Planning and Zoning Office, the Johnson County Auditor’s Office, or at www.johnson-county.com, is hereby adopted.
Be it further resolved that this amended Land Use Plan shall replace any previously adopted Land Use Plan, including but not limited to the 1998 Land Use Plan adopted by the Board of Supervisors on December 31, 1998; and
Be it further resolved that this amended Land Use Plan shall become effective upon adoption of this Resolution.
Motion by Stutsman, second by Harney, to approve Resolution 05-15-08-Z3.
RESOLUTION 05-15-08-Z4
Whereas, the Board of Supervisors finds that the Frytown Village Plan is intended to supplement the Johnson County Land Use Plan specifically regarding future growth in Frytown and the surrounding area; and
Whereas, the Board of Supervisors finds that it is in the public interest to adopt said Frytown Village Plan as an appendix to the Johnson County Land Use Plan.
Now, therefore be it resolved by the Johnson County Board of Supervisors, that the following Frytown Village Plan, copies of which can be obtained at the Johnson County Planning and Zoning Office, Johnson County Auditor’s Office or at www.johnson-county.com, is hereby adopted as an appendix to the Johnson County Land Use Plan.
Be it further resolved that this Frytown Village Plan shall become effective as an Appendix to the Land Use Plan upon adoption of this Resolution.

RESOLUTION 05-15-08-01
RESOLUTION AWARDING AND AUTHORIZING EXECUTION
OF CONTRACT FOR CONSTRUCTION OF HEALTH AND HUMAN SERVICES BUILDING – PHASE II, FINISH GRADING, PARKING LOT PAVEMENT, SIDEWALKS, PARKING RAMP STRUCTURE AND LANDSCAPING
Whereas, on the 17th day of April, 2008, after notice as required by law, a public hearing was conducted concerning the proposed plans, specifications and form of contract for, and the estimated cost of, construction of Health and Human Services Building – Phase II, including finish grading parking lot pavement, sidewalks, parking ramp structure and landscaping; and
Whereas, after said public hearing and hearing all the evidence presented, and on that date the Johnson County Board of Supervisors gave due consideration to and adopted a resolution approving said proposed plans, specifications, form of contract for, and the estimated cost of, said construction, and providing that sealed bids for the construction of said project be solicited for receipt by the Johnson County Auditor no later than 9:00 A.M. Central Time, May 13, 2008, Notice to bidders being published pursuant to the Iowa Code; and
Whereas, at said time and place the bids were opened and the amounts of all bids announced and it was determined that the lowest responsive, responsible bidder, determined pursuant to Iowa Code §§ 26.9-.10, was Tricon General Construction of Dubuque, Iowa, and said bid was for $3,556,000.00.
Now, therefore be it resolved that Tricon General Construction of Dubuque, Iowa, was the lowest responsive, responsible bidder for the proposed project, and that the bid amount is $3,556,000.00, for construction of Health and Human Services Building – Phase II, including finish grading parking lot pavement, sidewalks, parking ramp structure and landscaping, as shown in the plans previously adopted by the Board;
Be it further resolved that the Board hereby awards the contract for construction of Health and Human Services Building – Phase II, including finish grading parking lot pavement, sidewalks, parking ramp structure and landscaping, as shown in the plans previously adopted by the Board to Tricon General Construction of Dubuque, Iowa, and authorizes the Chairperson to sign any documents, including the previously approved form of contract, necessary to effectuate said award of contract in such manner as is consistent with Iowa law.
Motion by Neuzil, second by Sullivan, to approve Resolution 05-15-08-01.
Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign a letter of appreciation to Dean Dykstra for serving on the Johnson County Zoning Board of Adjustment.
