MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
JUNE 5, 2008
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:01 a.m. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Meyers, second by Stutsman, to approve the minutes of the formal meeting of May 29, 2008.
Motion by Harney, second by Meyers, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Stutsman, to approve and authorize the Chairperson to sign an Application for five day Class B Beer Permit, and Application for Outdoor Service for the Dawg House, Oxford, as submitted by Deborah Ranshaw.
Motion by Neuzil, second by Meyers, to approve a Retail Cigarette Permit for Club 76, North Liberty, as submitted by Tracy Folkmann.
Motion by Stutsman, second by Neuzil, to approve a Retail Cigarette Permit for Baxa’s Sutliff Store and Tavern, Lisbon, as submitted by Randy Howell.
Motion by Neuzil, second by Meyers, to approve and authorize the Chairperson to sign the FY09 Mental Health/Developmental Disabilities Services Provider Agency Rates for Reach for Your Potential.
Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the FY09 Mental Health/Developmental Disabilities Services Provider Agency Rates for Successful Living.
Motion by Harney, second by Stutsman, to approve and authorize the Chairperson to sign the FY09 Mental Health/Developmental Disabilities Services Provider Agency Rates for Goodwill Industries of the Heartland.
Motion by Meyers, second by Neuzil, to approve and authorize the Chairperson to sign the FY09 Mental Health/Developmental Disabilities Services Provider Agency Rates for Systems Unlimited.
RESOLUTION 06-05-08-B1
FY08 APPROPRIATION CHANGES TO GENERAL BASIC BLOCK GRANTS (DEPT. 20), AND PLANNING & ZONING (DEPT. 19)
Whereas, the appropriations for General Basic Block Grant’s County Environment and Education Service Area, are not sufficient to meet payments for Johnson County Ag Extension, and
Whereas, due to an unforeseen increase in North Liberty Pool Block Grant payments, the County Environment & Education Service Area for the General Basic Block Grants will deplete its funds; and
Whereas, the Planning & Zoning Department has available funds in their budgets; and
Whereas, pursuant to section 331.434(6) of the Code of Iowa, a department appropriation may be decreased without a public hearing if the decrease is not more than the greater of $5,000 or ten percent of the department’s total budget; and
Therefore, be it resolved that General Basic Block Grants (Dept. 20), County Environment & Education Service Area, is herewith appropriated an additional $3,000 and a total appropriation of $223,065 for fiscal year 2007-2008. The appropriation for Planning & Zoning (Dept. 19) is correspondingly decreased by $3,000 for a total of $721,083 for fiscal year 2007-2008. The relevant county service area is County Environment & Education, which remains unchanged.
Motion by Stutsman, second by Harney, to approve Resolution 06-05-08-B1.
Motion by Neuzil, second by Harney, to approve and authorize the Chairperson to sign the Construction Contract for IDOT Project # FM-CO52(79)—55-52, HMA – full depth reclamation for Route F62 (500th Street SW) from the Johnson-Iowa Road easterly to the Angle Road SW in Section 7-11 and 14-18, Township 78N, Range 8W.
Motion by Stutsman, second by Neuzil, to commit $2,000 of Johnson County’s funding as a member of the Public Leadership Group to participate in “A Study of Attitudes and Opinions of Local Leaders and the General Population Regarding Issues of Local Importance.”
Motion by Neuzil, second by Meyers, to appoint Sally Stutsman and Rick Dvorak to the Iowa Valley RC&D Local Food Group.
Motion by Harney, second by Neuzil, to approve and authorize the Chairperson to sign a letter of support to the Department of Transportation for improvements to Highway 1 between Iowa City and Kalona.

Motion by Harney, second by Stutsman, to approve County financial support in the amount of $20,000 for the Coralville Center for the Performing Arts Vision Iowa Grant proposal.
RESOLUTION 06-05-08-01
RESOLUTION SETTING FORTH PROPOSED PLAN TO DISPOSE OF COUNTY-OWNED REAL PROPERTY CONSISTING OF SECONDARY ROADS MAINTENANCE SHED IN TIFFIN, IOWA
Whereas, Johnson County is the owner of real property located generally South of Railroad Street, North of the Iowa Interstate Railroad, West of the southerly extension of the centerline of Grant Street, and East of the southerly extension of the centerline of College Street, in the City of Tiffin, Johnson County, Iowa; and
Whereas, this property is the current site of a Johnson County Secondary Roads Maintenance Shed and contains approximately 32,104 square feet; and
Whereas, Section 331.361(2) of the 2007 Code of Iowa requires the County, in disposing of an interest in real property, to set forth its proposal in a resolution, to publish notice of the time and place of a public hearing on the proposal and, after the public hearing, to make a final determination on the proposal; and
Whereas, the Johnson County Board of Supervisors’ proposal to dispose of the County’s interest in the real property referenced is as follows:
Proposed Plan to Dispose of County-Owned Real Property Consisting of the Secondary Roads Maintenance Shed in Tiffin, Iowa
Johnson County is the owner of real property located generally South of Railroad Street, North of the Iowa Interstate Railroad, West of the southerly extension of the centerline of Grant Street, and East of the southerly extension of the centerline of College Street, in the City of Tiffin, Johnson County, Iowa. This property is the current site of a Johnson County Secondary Roads Maintenance Shed and consists of approximately 32,104 square feet.
Johnson County has received an offer to purchase its fee interest in this tract for $160,000.00 from the City of Tiffin, Iowa. The fair market value of this tract, as determined by an independent appraiser, is $160,000.00. The City of Tiffin currently owns the adjacent property immediately east of this property. The Secondary Roads Department no longer has need for this site because it has relocated its operations and equipment in this area to a new maintenance shed located near Oxford, Iowa.
Accordingly, the Johnson County Board of Supervisors has determined to dispose of the property. The plan is to sell Johnson County’s fee interest in the 32,104 square foot tract to the City of Tiffin for $160,000.00, the amount of the offer made by the City of Tiffin.
The legal description of the tract the County plans to dispose of is as follows:
Commencing at a concrete nail found at the South Quarter corner of Section 28, Township 80 North, Range 7 West of the 5th P.M., thence N 00°00’00” E (an assumed bearing), along the west line of the Southeast Quarter of said Section 28, 630.45 feet; thence N 87°40’24” E, 594.56 feet, to a point which is 50.00 feet normally distant Northwesterly of the centerline of the Main trackage of the Chicago, Rock Island, and Pacific Railroad Company, and which point is the point of beginning, thence N 2°19’36” W, 100.00 feet, to a point on the Southeasterly line of Railroad Street, thence S 87°40’24”W, 321.25 feet, along said Southeasterly line, thence S 2°19’36” E, to a point which is 50.00 feet normally distant Northwesterly of said Railroad Centerline, thence N 87°40’24” E, 321.25 feet to the point of beginning.
Including all right and interest to an Easement Agreement recorded in Book 1049, Page 520 of the records of Johnson County. The property is subject to an easement for access, as set forth in the Easement Agreement recorded in Book 1049, Page 520 of the records of Johnson County.
All as described in a certain warranty deed recorded in Book 1070, Page 316 of the records of Johnson County.

Therefore, Be It Resolved by the Johnson County Board of Supervisors that it hereby sets forth its proposal to dispose of county-owned real property consisting of Johnson County Secondary Roads Maintenance Shed located in Tiffin, Iowa, and as specifically described in the proposal.

RESOLUTION SETTING PUBLIC HEARING ON PROPOSED PLAN TO DISPOSE OF COUNTY-OWNED REAL PROPERTY CONSISTING OF THE SECONDARY ROADS MAINTENANCE SHED IN TIFFIN, IOWA
Whereas, Johnson County is the owner of real property located generally South of Railroad Street, North of the Iowa Interstate Railroad, West of the southerly extension of the centerline of Grant Street, and East of the southerly extension of the centerline of College Street, in the City of Tiffin, Johnson County, Iowa; and
Whereas, this property is the current site of a Johnson County Secondary Roads Maintenance Shed and contains approximately 32,104 square feet; and
Whereas, Section 331.361(2) of the 2007 Code of Iowa requires the County, in disposing of an interest in real property, to set forth its proposal in a resolution, to publish notice of the time and place of a public hearing on the proposal and, after the public hearing, to make a final determination on the proposal; and
Whereas, the Johnson County Board of Supervisors has set forth by resolution a proposal to dispose of the above described Secondary Roads Maintenance Shed in Tiffin; and
Whereas, conveying this property, as set forth above and in the proposal set forth, will be the best method to dispose of the same and is in the best interests of Johnson County, Iowa.
Therefore, Be It Resolved by the Johnson County Board of Supervisors that the plans for disposing of this interest in real property are set out in the Proposed Plan to Dispose of County-Owned Real Property Consisting of the Secondary Roads Maintenance Shed in Tiffin, Iowa, and are available at the Johnson County Auditor’s Office at 913 S. Dubuque Street; and
Be It Further Resolved that the Board of Supervisors proposes to dispose of the property by selling Johnson County’s fee interest in the 32,104 square foot tract to the City of Tiffin for $160,000.00; and
Be It Further Resolved that conveying this property, as set forth above and in the proposal, will be the best method to dispose of the same and is in the best interests of Johnson County, Iowa; and
Be It Further Resolved that in accordance with Section 331.361(2) of the 2007 Code of Iowa, a public hearing on said proposed plan to dispose of the interest in property is set for June 18, 2008, at 9:00 A.M., in the Boardroom of the Johnson County Board of Supervisors, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa. The Johnson County Auditor is hereby directed to publish notice of the hearing no less than four (4) and no more than twenty (20) days prior to the same.
Motion by Stutsman, second by Meyers, to approve Resolution 06-05-08-02.
Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the following Applications for Fireworks Permits: Joe Rasmussen, for display at 4098 180th St. NE, Solon, on July 5, 2008; Christopher Handley, for display at 5404 180th St. NE, Solon, on July 3 or 4, 2008; and Cottage Reserve Corp., for display at Main Boat Ramp, Mac Bride State Park, on July 4, 2008.
