MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JUNE 12, 2008

 

      Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m.  Members present were: Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan; absent was Pat Harney.

 

      Unless otherwise noted, all actions were taken with the following roll call: aye: Stutsman, Sullivan, Neuzil, Meyers; absent: Harney.

 

PROCLAMATION 06-12-08-01

JOHN WATSON, PRESIDENT OF GOODWILL INDUSTRIES

JUNE 12, 2008

 

      Whereas, John Watson is retiring after 29 years as the CEO of Goodwill of the Heartland; and

 

      Whereas, Goodwill is now much bigger and much better because of his leadership and vision - Goodwill now serves veterans, homeless individuals, people with a brain injury, and people who live in public housing - in addition to people with mental and physical disabilities.  In 1978, Goodwill developed 30 jobs for people; last year 561.  Its supported employment program is Iowa’s largest; and

 

      Whereas, Goodwill’s retail program has grown dramatically.  John inherited two retail stores in 1979.  Today Goodwill operates the Retail Support Center in southeast Iowa and 12 modern retail outlets that contribute more than $500,000 per year to its services and provide employment and training for more than 250 clients; and

 

      Whereas, John has been an active participant in the Johnson County community.   He has served on the Iowa City Human Rights Commission, the Parks and Recreation Commission, Zoning Commission and the Police Review Board.  He is active in the Johnson County United Way and serves on the boards of the Iowa Donor Network, Old Brick and Habitat for Humanity; and

 

      Whereas, John brought a sense of quiet competence and the tools to run a not-for-profit organization in an ethical, business-like manner.  His insistence that Goodwill fulfill its mission was infectious; and

 

      Whereas, over the years John has facilitated the move toward independence for more than 10,000 people; and

 

      Now, Therefore, be it resolved that we, the Johnson County Board of Supervisors declares the week of June 15, 2008 to be:

 

JOHN WATSON WEEK

 

in Johnson County, and urges all residents of Johnson County to congratulate this

humble gentleman on his remarkable accomplishments.

 

      Motion by Stutsman, second by Meyers, to approve Proclamation 06-12-08-01.

      Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Neuzil, second by Stutsman, to approve the minutes of the formal meeting of June 4, 2008 and the minutes of the canvass of June 10, 2008.

 

      Motion by Meyers, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Stutsman, second by Neuzil, to approve a Retail Cigarette Permit for Funcrest Bait and Tackle, Iowa City, as submitted by William Kallaus.

 

      Convened Public Hearing on Platting Applications at 7:50 p.m.

 

      Subdivision Application 15147 of Syngenta Seeds, c/o of Eric Snoke, signed by Glen Meisner of MMS Consultants, Inc., requesting preliminary and final plat approval of Prairie Valley Subdivision Part Three, a subdivision described as being located in the NW 1/4 of the NE 1/4 of Section 11, Township 77 North, Range 5 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 29.69 acre, commercial subdivision is located on the south side of Highway 22 SE, approximately 1 1/2 miles east of the intersection of Highway 22 and Wapsie Avenue SE in Fremont Twp.).

      Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

 

      Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa:

      Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

      Motion by Neuzil, second by Meyers, to defer action and continue the public hearing on the proposed Swisher/Johnson County Fringe Area Agreement until July 10, 2008 at 5:30 p.m.

 

RESOLUTION 06-12-08-Z7

 

      Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on June 9,2008, filed its report and recommendations for certain actions;

 

      Now, Therefore, Be It Resolved as follows:

 

1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 10th day of July, 2008 at 5:30 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following: An Ordinance Amending The Johnson County Unified Development Ordinance By Amending The Road Performance Standards Related To Gravel And Oiled Chip Seal Roads.

 

2. That the Johnson County Auditor be authorized to publish the official notice of above public hearing.

 

      Motion by Stutsman, second by Meyers, to approve Resolution 06-12-08-Z7.

 

      Motion by Stutsman, second by Meyers, to accept the low bid of $64,800 from Vogel Traffic Services for Secondary Roads Paving Markings and authorize the Chairperson to sign a contract.

 

      Motion by Neuzil, second by Stutsman, to approve and authorize the Chairperson to sign a 28E Project Agreement with the City of Coralville for Engineering Design and Construction Management for improvements on Oakdale Boulevard extension from its eastern terminus in Coralville to Dubuque Street and intersection improvements to Oakdale Boulevard and Dubuque Street.

 

      Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign a contract for Johnson County Board of Supervisors to continue to be the Fiscal Agent for Johnson County Empowerment for the period July 1, 2008 through June 30, 2009.

 

      Motion by Neuzil, second by Meyers, to approve and authorize the Chairperson to sign Compliance Assurances for the Iowa Empowerment Board.

 

      Motion by Meyers, second by Neuzil, to approve and authorize the Chairperson to sign the Mental Health/Developmental Disabilities Services Provider Contracts for Hy-Vee Pharmacy

 

      Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the Mental Health/Developmental Disabilities Services Provider Contracts for Liberty Pharmacy

 

      Motion by Neuzil, second by Meyers, to approve and authorize the Chairperson to sign the Mental Health/Developmental Disabilities Services Provider Contracts for Mercy Medical Plaza Pharmacy

 

      Motion by, Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the Mental Health/Developmental Disabilities Services Provider Contracts for NuCara Pharmacy

 

      Motion by Meyers, second by Stutsman, to approve and authorize the Chairperson to sign the Mental Health/Developmental Disabilities Services Provider Contracts for Towncrest Pharmacy

 

      Motion by Stutsman, second by Meyers, to set a public hearing for the Johnson County Mental Health/Disability Services Management Plan, for July 10, 2008 at the Johnson County Administration Building at 5:30 p.m. and authorize the Auditor’s Office to publish.

 

      Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the FY08-09 Johnson County Sheriff's Office collective bargaining agreement with Public Professional and Maintenance Employees (PPME) IUPAT Local 2003.

 

      Motion by Neuzil, second by Meyers, to approve increasing employee mileage reimbursement rate to 44 1/2 cents per mile, effective July 1, 2008, with indexing.

 

      Motion Stutsman, second by Meyers, to approve combining the existing part-time benefit eligible status Oral Health Coordinator (30 hours) and temporary Oral Health Coordinator (10 hours) in to a regular full-time (40 hours) position.  

 

      Motion by Meyers, second by Stutsman, to approve and authorize the Chairperson to sign the Memorandum of Understanding, MOU-2009-CO52, between the Iowa Department of Public Health and the Johnson County Board of Supervisors to provide substance abuse prevention and related services to include only education, prevention, referral, or post-treatment services.

 

RESOLUTION 06-12-08-B1

FY08 APPROPRIATION CHANGES TO ATTORNEY (DEPT.02), AND AMBULANCE (DEPT. 01)

 

      Whereas, the appropriations for Attorney’s Public Safety & Legal Services Service Area, are not sufficient to meet payments for payroll, and

 

      Whereas, due to an unforeseen  increase in Attorney operating expenses, the Public Safety & Legal Services Service Area for the Attorney department’s payroll will deplete its funds; and

 

      Whereas, the Ambulance department has available funds in their budgets; and

 

      Whereas, pursuant to section 331.434(6) of the Code of Iowa, a department appropriation may be decreased without a public hearing if the decrease is not more than the greater of $5,000 or ten percent of the department’s total budget; and

 

      Therefore, be it resolved that Attorney department (Dept. 02), Public Safety & Legal Services Service Area, is herewith appropriated an additional $20,000 and a total appropriation of $1,662,445 for fiscal year 2007-2008. The appropriation for Ambulance dept. (Dept. 01) is correspondingly decreased by $20,000 for a total of $2,464,985 for fiscal year 2007-2008.  The relevant county service area is Public Safety & Legal Services, which remains unchanged.

 

      Motion by Stutsman, second by Meyers, to approve Resolution 06-12-08-B1.

 

      Motion by Neuzil, second by Meyers, to appoint Douglas Vance to the Johnson County Civil Service Commission for a term ending October 15, 2009. 

 

      Motion by Stutsman, second by Neuzil, to appoint the following people to the Johnson County Rural Advisory Committee for terms ending June 30, 2010: Dennis Byrnes, Robert Conrad, Rick Dvorak, Russell Bailey, Ron Mavrais, Donald Saxton, Linda Severson, Gary Bilyeu, Tom Salm, and Roger Goedken.

 

      Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to send Joseph Fowler a letter of appreciation and certificate for serving on the Johnson County Civil Service Commission.

 

      Motion by Meyers, second by Stutsman, to approve and authorize the Chairperson to send Tom Palmer and Christopher Rossi letters of appreciation and certificates for serving on the Johnson County Rural Advisory Committee.
