MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
JULY 10, 2008
Subject to approval by the Board of Supervisors at a subsequent meeting.
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Pat Harney, Larry Meyers, Sally Stutsman, and Rod Sullivan; absent: Terrence Neuzil.
Unless otherwise noted, all actions were taken by the following vote: Roll call: aye: Harney, Stutsman, Sullivan, Meyers; absent: Neuzil.
Motion by Meyers, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Meyers, to approve the minutes of the formal meeting of July 3, 2008.
Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Harney, second by Stutsman, to place on file the Clerk’s Report of Fees Collected for the month of June, 2008, in the amount of $16,289.78, as submitted by Clerk of District Court Lodema Berkley.
Convened Public Hearing on the proposal to dispose of county-owned real property consisting of the Secondary Roads maintenance shed in Tiffin, Iowa at 5:35 p.m.
Assistant County Attorney Andy Chappell presented the proposal to dispose of county-owned real property consisting of the Secondary Roads maintenance shed in Tiffin, Iowa. No members of the public made any remarks.

RESOLUTION 07-10-08-01
RESOLUTION ADOPTING PROPOSED PLAN TO DISPOSE OF COUNTY-OWNED REAL PROPERTY CONSISTING OF THE SECONDARY ROADS MAINTENANCE SHED IN TIFFIN, IOWA
Whereas, Johnson County is the owner of real property located generally South of Railroad Street, North of the Iowa Interstate Railroad, West of the southerly extension of the centerline of Grant Street, and East of the southerly extension of the centerline of College Street, in the City of Tiffin, Johnson County, Iowa; and
Whereas, this property is the current site of a Johnson County Secondary Roads Maintenance Shed and contains approximately 32,104 square feet; and
Whereas, in accordance with Section 331.361(2) of the 2007 Code of Iowa, a public hearing on a proposed plan to dispose of the county’s interest in this real property was held on this the 10th day of July, 2008, at 5:30 P.M., in the Boardroom of the Johnson County Board of Supervisors, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa; and
Whereas, after said hearing, the Johnson County Board of Supervisors made its final determination on the proposed plan to dispose of county-owned real property consisting of the Johnson County Secondary Roads Maintenance Shed located in Tiffin, Iowa, and decided to sell Johnson County’s fee interest in the 32,104 square foot tract to the City of Tiffin for $160,000.00, the amount of the offer previously made to Johnson County by the City of Tiffin for the tract; and
Whereas, this conveyance, as described above and in the proposal set forth, is necessary and will be the best method to dispose of the subject property.
Therefore, be it resolved by the Johnson County Board of Supervisors that disposing of county-owned real property consisting of Secondary Roads Maintenance Shed located in Tiffin, Iowa, is deemed necessary; and
Be it further resolved that the plan to dispose of the above-described county-owned real property as specifically described in the proposal and available at the Johnson County Auditor’s Office at 913 S. Dubuque Street, is hereby adopted; and
Be it further resolved the Johnson County Board of Supervisors shall dispose of Johnson County’s fee interest in the 32,104 square foot tract described in the Proposed Plan by conveying it to the City of Tiffin in exchange for $160,000.00; and
Be it further resolved that the Board of Supervisors hereby authorizes the Chairperson to sign on its behalf any documents of conveyance necessary to fulfill the above-referenced Proposed Plan, including but not limited to a deed, and to take any other such actions to convey the interests in real property described above.
Motion by Stutsman, second by Meyers, to approve Resolution 07-10-08-01.
Convened Public Hearing on the revised draft of the Services Management Plan for Johnson County MH/DS (formerly known as MH/DD) at 5:38 p.m.
Mental Health/Disabilities Services Planning Council Chair Gillian Fox, MH/DS Director Kris Artley, Assistant MH/DS Director Jan Shaw, and Contract Analyst Suzanne Kirschner presented the proposed plan.
Nancy Williams, University of Iowa psychiatrist, asked if the Impact in-home visit program was included in the plan. Artley said the program had been taken off the plan but the current contract is valid until June 30, 2010, and the one current Impact participant had been grandfathered in. Stutsman noted that Williams and Artley have scheduled a meeting on the issue for next week.
Peggy Loveless of the National Alliance for the Mentally Ill (NAMI) said family education should be included in the plan. Artley said the program would honor prescription changes. Shaw said public education was included as an optional service.
Community Mental Health Center Director Stephen Trefz noted the importance of Impact and the conflict between the plan and the contract. He noted that prescription assistance programs (PAPs) were at the grace of the pharmaceutical companies and could disappear without notice, and there were hidden administrative costs to PAPs. He said the plan overall was a good working document.
Williams said the effectiveness of generic medications versus brand name medications was not completely determined and varied between patients.
Edward Allgood said the right medication is the one that works.

Convened Public Hearing on Zoning Ordinance Amendments at 6:31 p.m.
An Ordinance Amending the Johnson County Unified Development Ordinance By Amending the Road Performance Standards Related to Gravel and Oiled Chip Seal Roads.
Planning and Zoning Administrator Rick Dvorak and Assistant Planning and Zoning Administrator R.J. Moore presented the proposed ordinance. Dvorak noted that Ed Sayre had written in opposition. Chris Huberty spoke in opposition. George Crosheck spoke in support. Phyllis Ruppert asked about the traffic count on Stewart Road. Dvorak said it was 1,180 in 2006.

Huberty said chip seal roads could be improved without additional right-of-way. Stutsman asked why that was not done in Johnson County. County Engineer Greg Parker said Iowa state design standards meet or exceed national standards, and as an engineer he has to base decisions strictly on safety. R. Sullivan said the Board should consider street standards versus rural road standards. Meyers said there had not been formal speed limits posted on some of these roads.

Chappell noted that a 2-2 vote would end consideration of the proposed ordinance.
Motion by Harney, second by Stutsman, to approve the Ordinance Amending the Johnson County Unified Development Ordinance by amending the Road Performance Standards related to gravel and oiled chip seal roads on first consideration. Roll call: aye: Harney, Stutsman, Sullivan; nay: Meyers; absent: Neuzil.
RESOLUTION 07-10-08-Z1
Whereas, the 1998 Johnson County Land Use Plan as amended and updated calls for the preparation and adoption of development plans and agreements between the County and the City regarding municipality and its environs: and
Whereas, the Board of Supervisors finds that such policies are necessary to more effectively and economically provide services for future growth and development and to protect and preserve the fringe areas natural resources and its environmentally sensitive features, and
Whereas, the Board of Supervisors finds that it is in the public interest to adopt said Johnson County/Swisher Fringe Area Agreement.
Now, therefore be it resolved by the Johnson County Board of Supervisors, that the following Johnson County/Swisher Fringe Area Agreement, copies of which can be obtained at the Johnson County Planning and Zoning Office, Johnson County Auditor’s Office or at www.johnson-county.com, is hereby adopted.
Be it further resolved that this Johnson County/Swisher Fringe Area Agreement shall become effective upon adoption of this Resolution.
Motion by Stutsman, second by Meyers, to approve Resolution 07-10-08-Z1.
Motion by Stutsman, second by Harney, to approve opening a charitable giving account and an endowment account with the Community Foundation of Johnson County for the purpose of sustaining the Livable Community for Successful Aging Initiative.
Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign an Interim Assistance Reimbursement Agreement with the Iowa State Department of Human Services for the purpose of administering an Interim Assistance Program through General Assistance as indicated in Resolution 05-03-07-02.
Motion by Stutsman, second by Meyers, to approve the FY09 Mental Health/Developmental Disabilities Services Provider Agency Rate for ARC of Southeast Iowa.
Motion by Stutsman, second by Meyers, to approve the revised Targeted Case Management Policies and Procedure Manual.
