MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
JULY 24, 2008
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Meyers, second by Stutsman, to approve the minutes of the formal meeting of July 17, 2008.
Motion by Harney, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
ORDINANCE 07-24-08-Z1
AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY AMENDING THE ROAD PERFORMANCE STANDARDS RELATED TO GRAVEL AND OILED CHIP SEAL ROADS
Section I. Purpose. The purpose of this ordinance is to further the stated purpose of the County Unified Development Ordinance by amending the Road Performance Standards related to Gravel and Oiled Chip Seal Roads.
Section II. Amendments.
A. Article 8:1.21(V)(12)(b) is hereby amended by deleting it in its entirety, including each of its subparts, and replacing it with the following:
b. Gravel Roads.
1. Subdivisions shall not be approved on gravel roads with a projected traffic volume greater than three hundred (300) vehicles per day, unless improvement of said road is scheduled within the next two years of the adopted Johnson County five year road improvement plan.
The preceding vehicle volume threshold shall be reduced by fifty percent (50%) if (a) the measured 85th percentile speed on the road exceeds the posted speed limit by fifteen (15) miles per hour or more, or (b) horizontal or vertical geometry of said road is judged by the County Engineer to have significant sight distance constraints.
B. Article 8:1.21(V)(12)(c) is hereby amended by deleting it in its entirety, including each of its subparts, and replacing it with the following:
c. Oiled Chip Seal Roads.
1. Subdivisions shall not be approved on oiled chip seal roads with a projected traffic volume greater than two thousand (2,000) vehicles per day, unless improvement of said road is scheduled within the next two years of the adopted Johnson County five year road improvement plan.
2. The preceding vehicle volume threshold shall be reduced by fifty percent (50%) if (a) the measured 85th percentile speed on the road exceeds the posted speed limit by fifteen (15) miles per hour or more, or (b) horizontal or vertical geometry of said road is judged by the County Engineer to have significant sight distance constraints.
Section III. Repealer. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Section IV. Savings Clause. If any section, provision, or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.
Section V. Effective Date. This ordinance shall be in effect after its final passage and publication as part of the proceedings of the Board of Supervisors.
On July 10, 2008, motion by Harney, second by Stutsman, to approve the Ordinance Amending the Johnson County Unified Development Ordinance by amending the Road Performance Standards related to gravel and oiled chip seal roads on first consideration. On July 17, 2008, motion by Stutsman, second by Neuzil, to approve the Ordinance Amending the Johnson County Unified Development Ordinance by amending the Road Performance Standards related to gravel and oiled chip seal roads on second consideration. Roll call: aye: Harney, Stutsman, Sullivan, Neuzil; nay: Meyers.
Motion by Harney, second by Stutsman, to approve Ordinance 07-24-08-Z1, an ordinance Amending the Johnson County Unified Development Ordinance by amending the Road Performance Standards related to gravel and oiled chip seal roads on final consideration. Roll call: aye: Harney, Stutsman, Sullivan, Neuzil; nay: Meyers.
Motion by Stutsman, second by Harney, to approve and authorize the Chairperson to sign the Empowerment Contract for Continue Care and School-Ready Scholarships.
Motion by Neuzil, second by Meyers, to approve and authorize the Chairperson to sign the Empowerment Contract for Johnson County Social Services to be employer of record for Early Childhood Specialist and Empowerment Administrative Assistant.
Motion by Harney, second by Stutsman, to approve the new position in Social Services of Community Projects Specialist.
Motion by Neuzil, second by Meyers, to approve the FY09 rates for Chatham Oaks.
Motion by Stutsman, second by Meyers, to approve the University of Iowa Hospitals and Clinics and Carver College of Medicine University of Iowa Physicians proposed rates for FY09.
