MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
AUGUST 14, 2008
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:33 p.m. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Meyers, second by Stutsman, to approve the minutes of the formal meeting of August 7, 2008.
Motion by Harney, second by Meyers, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Harney, to approve and authorize the Chairperson to sign: a New Application for Class B Beer Permit, Application For Outdoor Service Area, and Application For Sunday Sales Privilege for St. Peter Church, Cosgrove, as submitted by John Ruth .
Motion by Stutsman, second by Meyers, to place on file the Clerk’s Report of Fees Collected for the month of July, 2008, in the amount of $16,685.28, as submitted by Clerk of District Court Lodema Berkley.
Convened Public Hearing on Platting Applications at 5:36 p.m.
Subdivision Application 15130 of Michael Plotz requesting preliminary plat approval of Willow Lake, a Resubdivision of Horseshoe Acres, a subdivision described as being located in the SW 1/4 of the SW 1/4 of Section 16 and SE 1/4 of the SE 1/4 of Section 17, Township 81 North, Range 7 West of the 5th P.M. in Johnson County, Iowa (This is a 10 lot residential subdivision with 8 buildable lots and 2 outlots containing 23.85 acres, located on the west side of Highway 965 approximately 700 feet north of its intersection with Royal Oaks Drive NW in Madison Twp).
Mark Stein of MMS Consultants was present to answer questions.
RESOLUTION 08-14-08-Z1
RESOLUTION APPROVING THE PRELIMINARY PLAT OF WILLOW LAKE, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application 15011 for approval of a preliminary plat of Willow Lake, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
Motion by Neuzil, second by Meyers, to approve Resolution 08-14-08-Z1.
Subdivision Application 15148 of Twin County Dairy, Inc., signed by Glen Meisner of MMS Consultants, Inc., requesting preliminary and final plat approval of Twin County Dairy Lagoon Site No. 4, a subdivision described as being located in the East 1/2 of the SE 1/4 of Section 24, Township 78 North, Range 8 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 30.34 acre, industrial subdivision located on the north side of 540th SW approximately 700 feet west of its intersection with Iowa Highway 1 in Washington Twp).

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF TWIN COUNTY DAIRY LAGOON SITE NO. 4, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application15148 for approval of a preliminary and final plat of Twin County Dairy Lagoon Site NO. 4, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Subdivision Application 15220 of Kevin Stahle requesting preliminary and final plat approval of Pheasant Ridge Subdivision, a subdivision described as being located in the NE 1/4 of the NE 1/4 of Section 12, Township 81 North, Range 6 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 1.87 acre, farmstead split located on the south side of 120th Street NE approximately 4000 feet east of its intersection with Iowa Highway #1 in Big Grove Twp).

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF PHEASANT RIDGE, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application 15220 for approval of a preliminary and final plat of Pheasant Ridge, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Subdivision Application 15226 of Willie Olin, Jr. signed by Glen Meisner MMS requesting preliminary and final plat approval of Locust Ridge Estates Second Subdivision, a Resubdivision of Lot 2 of Locust Ridge Estates, a subdivision described as being located in S 1/2 of the SW 1/4 Section 16, Township 80 North, Range 6 West of the 5th P.M. in Johnson County, Iowa (This is a 2 lot, 7.23 acre, residential subdivision located on the south side of Locust Ridge Court NE approximately 600 feet east of its intersection with 275th Street NE in Penn Twp).

Whereas, the owner has filed application 15226 for approval of a preliminary and final plat of Locust Ridge Estates Second Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:

Subdivision Application 15274 of Edwin and Charles Klouda requesting preliminary and final plat approval of Klouda Subdivision, a subdivision described as being located in the SW 1/4 of the NW 1/4 of Section 16, Township 81 North, Range 7 West of the 5th P.M. in Johnson County, Iowa (This is a 21.24 acre residential subdivision, lot 1 is 6.50 acres and outlot A is 14.74 acres, located on the east side of Highway 965 approximately 1500 feet south of its intersection with Marak Road NW in Jefferson Twp).

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF KLOUDA SUBDIVISION, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application 15274 for approval of a preliminary and final plat of Klouda Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Consent to Plat; Title Opinion; Certificate of Johnson County Auditor; Treasurer’s Certificate; Subdivider's Agreement; Exhibit A; Resolution Affirming the Stability of the Current Road System; Conservation Easement Agreement; B. Motion by Meyers, second by Stutsman, to approve Resolution 08-14-08-Z5.
Subdivision Application 15275 of Rob Kochan requesting preliminary and final plat approval of Kochan Corner, a subdivision described as being located in the SE 1/4 of the SE 1/4 of Section 23, Township 81 North, Range 8 West of the 5th P.M. in Johnson County, Iowa (This is a 4.75 acre farmstead split located at the northeast corner of the intersection of Dupont Lane NW and Amana Road NW (F20) in Monroe Twp).
Meyers asked if the house across the street was on Dupont. Mark Stein of MMS Consultants said additional right-of-way had been requested on Amana.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF KOCHAN CORNER, JOHNSON COUNTY, IOWA.
Whereas, the owner has filed application 15275 for approval of a preliminary and final plat of Kochan Corner and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Owners’ Certificate; Certificate of Treasurer; Certificate of County Auditor; Opinion of Attorney; Subdivider's Agreement; Exhibit A: Fence Agreement; Consent of Mortgagee; Grant of Easement for Public Highway; Resolution Affirming the Stability of the Current Road System; B. RESOLUTION 08-14-08-Z7
Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on August 11, 2008, filed its report and recommendations for certain actions;
Now, therefore, be it resolved as follows:
1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 11th day of September, 2008 at 5:30 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following: 15150 (Hotz), 15222 (Coan), 15223(Serovy), 15311 (Stiffler), and the 2008 Johnson County/Solon Fringe Area Agreement.
2. That the Johnson County Auditor be authorized to publish the official notice of above public hearing.
Motion by Stutsman, second by Neuzil, to approve Resolution 08-14-08-Z7.
Motion by Stutsman, second by Meyers, to approve and authorize the Auditor to publish a Notice to Bidders setting a bid letting date of September 8, 2008 at 10:00 a.m. for a Pavement Rehabilitation Project on Curtis Bridge Road south of the Iowa River, Johnson County Project L-CBr-Rd--73-52.
Motion by Neuzil, second by Harney, to approve and authorize the Auditor to publish a Notice to Bidders setting a bid letting date of September 8, 2008 at 10:00 a.m. for Grading, Bank Stabilization and Guardrail Replacement on Lake MacBride Shoreline along Cottage Reserve Road, Johnson County Project L-Cottage--73-52.
Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to send James Martin a letter of appreciation and certificate for serving on the Johnson County Integrated Roadside Vegetation Management Committee.
