MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

SEPTEMBER 18, 2008

 

      Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Stutsman, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Neuzil, second by Meyers, to approve the minutes of the formal meeting of September 11, 2008.

 

      Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Harney, second by Neuzil, to accept the correspondence from Public Professional and Maintenance Employees (PPME) International Union of Painters and Allied Trades (IUPAT) Local 2003 regarding collective bargaining proposals for 2009-2010 with Johnson County for Secondary Roads Unit and Sheriff’s Office Unit.

 

      Motion by Stutsman, second by Neuzil, to approve and authorize the Chairperson to sign a contract with L.L. Pelling in the amount of $479,065.52 for Secondary Roads project (Project # L-CBR Rd—73-52).

 

      Motion by Stutsman, second by Harney, to approve and authorize the Chairperson to sign an Agreement between Johnson County, Iowa and Vietnam Vets Motorcycle Club, Chapter D Iowa, to accept the donation of Johnson County Vietnam Veterans Memorial.

 

      Motion by Neuzil, second by Stutsman, to approve the Military Exemptions and Homestead Tax Credit applications filed between July 1, 2007 and June 30, 2008, for Iowa City as recommended by City Assessor Dennis Baldridge.

 

RESOLUTION 09-18-08-01

RESOLUTION SETTING FORTH PROPOSAL TO DISPOSE OF A LEASEHOLD INTEREST IN AND EASEMENT TO REAL PROPERTY LOCATED SOUTH OF CHATHAM OAKS FACILITY AND ON THE JOHNSON COUNTY POOR FARM, WEST OF HIGHWAY 218 AND SOUTH OF MELROSE AVENUE WEST, IOWA CITY, IOWA

 

      Whereas, Johnson County is the owner of real property located west of Highway 218 and South of Melrose Avenue West, in Iowa City, Iowa; and

 

      Whereas, the real property is located adjacent to and directly South of Chatham Oaks and is part of what historically has been known as the Johnson County Poor Farm; and

 

      Whereas, pursuant to Section 331.361 of the 2007 Code of Iowa, prior to disposing of an interest in real property owned by Johnson County, the Johnson County Board of Supervisors must set forth in a resolution its proposal for disposing of the real property and publish notice of the time and place of a public hearing on the same; and

 

      Whereas, the Johnson County Board of Supervisors’ proposal to dispose of the real property referenced above is the following:

 

      Proposed Plan to Dispose of a Leasehold Interest in and an Easement to Real Property Located Adjacent to and Directly South of Chatham Oaks and on the Johnson County Poor Farm, West of Highway 218 and South of Melrose Avenue West, Iowa City, Iowa

 

      Johnson County is the owner of real property located adjacent to and south of Chatham Oaks on what has historically been known as the Johnson County Poor Farm site.  The property is west of Highway 218 and south Melrose Avenue West, in Iowa City, Iowa.  The Johnson County Board of Supervisors is considering disposing of a leasehold interest in and an easement to the property.  The plan for disposal of an interest in the real property is to enter into a Lease Agreement with the Joint Emergency Communications Services Association of Johnson County (hereinafter “JECSA”), along with a shared access easement to the site along an existing driveway.

 

      The legal description of the proposed leased premises is as follows:

 

      A PORTION OF THE NORTHEAST ONE-QUARTER OF THE NORTHEAST ONE-QUARTER OF SECTION 13, TOWNSHIP 79 NORTH, RANGE 7 WEST OF THE 5TH PRINCIPAL MERIDIAN, CITY OF IOWA CITY, JOHNSON COUNTY, IOWA, MORE PARTICULARLY DESCRIBED AS FOLLOWS:

      JECSA is a governmental entity created by an agreement between Johnson County, Iowa; Iowa City, Iowa; Coralville, Iowa; North Liberty, Iowa; and the Johnson County Emergency Management Commission.   The Lease Agreement would allow JECSA to lease the real property for the purpose of building and operating thereon a Joint Emergency Communications Center.  Access to the site will be through a shared access easement granted at the same time as the lease and following an existing driveway.  The yearly rent for the property would be $1.00.  The term of the lease would be approximately 50 years.  At the conclusion of the lease term, ownership of the building and improvements would revert to Johnson County.  JECSA will be responsible for all utilities and maintenance of the leased premises.  Otherwise, the specific language of the Lease Agreement will be as approved by the Johnson County Attorneys Office.

      Therefore, be it resolved by the Johnson County Board of Supervisors that it hereby sets forth its proposal for disposing of a leasehold interest in the real property located adjacent to and directly south of Chatham Oaks and on the Johnson County Poor Farm, west of Highway 218 and South of Melrose Avenue West in Iowa City, Iowa.

 

      Motion by Harney, second by Meyers, to approve Resolution 09-18-08-01.

 

RESOLUTION 09-18-08-02

RESOLUTION SETTING PUBLIC HEARING ON PROPOSAL TO DISPOSE OF A LEASEHOLD INTEREST IN AND AN EASEMENT TO REAL PROPERTY LOCATED SOUTH OF CHATHAM OAKS FACILITY AND ON THE JOHNSON COUNTY POOR FARM, WEST OF HIGHWAY 218 AND SOUTH OF MELROSE AVENUE WEST, IOWA CITY, IOWA

 

      Whereas, Johnson County is the owner of real property located west of Highway 218 and South of Melrose Avenue West, in Iowa City, Iowa; and

 

      Whereas, the real property is located adjacent to and directly South of Chatham Oaks and is part of what historically has been known as the Johnson County Poor Farm; and

 

      Whereas, the Johnson County Board of Supervisors is considering whether to dispose of a leasehold interest in and an easement to this property; and

 

      Whereas, the proposed plan for disposal of a leasehold interest in the real property is to enter into a Lease Agreement with the Joint Emergency Communications Services Association of Johnson County (hereinafter “JECSA”), along with a shared access easement to the property.  JECSA is a governmental entity created by an agreement between Johnson County, Iowa; Iowa City, Iowa; Coralville, Iowa; North Liberty, Iowa; and the Johnson County Emergency Management Commission.   The Lease Agreement would allow JECSA to lease the real property for the purpose of building and operating thereon a Joint Emergency Communications Center.

 

      Whereas, entering into the Lease Agreement will be the best method to dispose of the subject property.

 

      Therefore, be it resolved that the Board of Supervisors proposes to dispose of an interest in the real property by entering into a Lease Agreement with JECSA to lease the real property for the purpose of building and operating thereon a Joint Emergency Communications Center and by granting JECSA an access easement to the property; and

 

      Be it further resolved that the proposal is set out in the Proposed Plan to Dispose of a Leasehold Interest in and an Easement to Real Property located South of Chatham Oaks Facility and on the Johnson County Poor Farm, West of Highway 218 and South of Melrose Avenue, Iowa City, Iowa, and the Proposed Plan is available for review at the Johnson County Auditor’s Office at 913 S. Dubuque Street; and

 

      Be it further resolved that in accordance with Section 331.361(2) of the 2007 Code of Iowa, a public hearing on said proposed plan to dispose of the property is set for September 25, 2008, at 9:00 A.M., in the Boardroom of the Johnson County Board of Supervisors, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa.  The Johnson County Auditor is directed to publish notice of the hearing no less than four (4) and no more than twenty (20) days prior to the same.

 

      Motion by Stutsman, second by Meyers, to approve Resolution 09-18-08-02.
