MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
SEPTEMBER 25, 2008
Supervisor Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:04 a.m. Members present were: Pat Harney, Larry Meyers, and Sally Stutsman; absent: Terrence Neuzil and Rod Sullivan.
Unless otherwise noted, all actions were taken by the following vote: Roll call: aye: Harney, Stutsman, Sullivan, Meyers; absent: Neuzil.
Motion by Meyers, second by Harney, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors. Roll call: aye: Harney, Stutsman, Meyers; absent: Sullivan, Neuzil.
Motion by Meyers, second by Harney, to approve the minutes of the formal meetings of September 12 and 18, 2008. Roll call: aye: Harney, Stutsman, Meyers; absent: Sullivan, Neuzil.
Motion by Harney, second by Meyers, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors. Roll call: aye: Harney, Stutsman, Meyers; absent: Sullivan, Neuzil.
Sullivan arrived at 9:08 a.m.
Motion by Meyers, second by Harney, to direct the Auditor to publish notice of changes in the County precinct boundaries approved by the State Commissioner of Elections as required by Code of Iowa section 49.11. Roll call: aye: Harney, Stutsman, Meyers; absent: Neuzil; abstain: Sullivan.
Motion by Harney, second by Meyers, to approve and authorize the Chairperson to sign a Renewal Application for a Class C Liquor License, Application for Outdoor Service Area, and Application for Sunday Sales Privilege for Club 76 American Legion, North Liberty, as submitted by Tracy Folkmann.
Convened Public Hearing on the proposal to dispose of leasehold interest in and an easement to real property located on the Johnson County Poor Farm adjacent to and immediately south of the Chatham Oaks Facility, west of Highway 218 and south of Melrose Avenue West in Iowa City, Iowa, for the purpose of building and operating a Joint Emergency Communications Center at 9:10 a.m.
No one from the public was present to speak on the proposal.

RESOLUTION 09-25-08-01
RESOLUTION ADOPTING PROPOSAL TO DISPOSE OF A LEASEHOLD INTEREST IN AND AN EASEMENT TO REAL PROPERTY LOCATED SOUTH OF CHATHAM OAKS FACILITY AND ON THE JOHNSON COUNTY POOR FARM, WEST OF HIGHWAY 218 AND SOUTH OF MELROSE AVENUE WEST, IOWA CITY, IOWA
Whereas, Johnson County is the owner of real property located west of Highway 218 and South of Melrose Avenue West, in Iowa City, Iowa; and
Whereas, the real property is located adjacent to and directly South of Chatham Oaks and is part of what historically has been known as the Johnson County Poor Farm; and
Whereas, the Johnson County Board of Supervisors is considering whether to dispose of a leasehold interest in and an easement to this property; and
Whereas, in accordance with Section 331.361 of the 2007 Code of Iowa, a public hearing on a proposed plan to dispose of an interest in the real property by entering into a Lease Agreement with Joint Emergency Communications Services Association of Johnson County and by also granting an access easement to the property was held on this the 25th day of September, 2008, at 9:00 A.M., in the Boardroom of the Johnson County Board of Supervisors, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa; and
Whereas, after said hearing, the Johnson County Board of Supervisors made its final determination on the proposed plan to dispose of a leasehold interest in and an easement to the real property and has decided to dispose of said interest by entering into a Lease Agreement with the Joint Emergency Communications Services Association of Johnson County and by also granting an access easement to the property; and
Whereas, the Johnson County Board of Supervisors has determined that disposing of a leasehold interest in and an easement to the real property in this manner will be the best method to dispose of it.
Therefore, be it resolved by the Johnson County Board of Supervisors after public hearing that disposing of a leasehold interest in and an easement to the real property located adjacent to and directly south of Chatham Oaks and on the Johnson County Poor Farm, west of Highway 218 and South of Melrose Avenue West in Iowa City, Iowa, by entering into a Lease Agreement and granting an Easement is deemed necessary; and
Be it further resolved that the plans for disposing of a leasehold interest in and an easement to the real property set out in the Proposed Plan to Dispose of a Leasehold Interest in and Easement to Real Property located South of Chatham Oaks Facility and on the Johnson County Poor Farm, West of Highway 218 and South of Melrose Avenue, Iowa City, Iowa, and available at the Johnson County Auditor’s Office at 913 S. Dubuque Street are hereby adopted; and
Be it further resolved that the Board of Supervisors hereby authorizes the Chairperson to sign on its behalf a Lease Agreement and Easement with the Joint Emergency Communications Services Association of Johnson County in such form as is approved by the Johnson County Attorney’s Office and any other documents necessary to effectuate the Plan herein adopted.
Motion by Harney, second by Meyers, to approve Resolution 09-25-08-01.
Motion by Stutsman, second by Meyers, to name American Administrators as the new Flexible Spending Plan Administrators for Johnson County effective January 1, 2009.
Motion by Stutsman, second by Harney, to approve and authorize the Chairperson to sign a letter regarding discontinuance of Flexible Spending Plan services with Wellmark.
Motion by Stutsman, second by Meyers, to approve recommendations from the Juvenile Justice Youth Development Policy Board for FY09 agency funding (October 1st through June 30th).
Motion by Harney, second by Stutsman, to approve recommendations from the Juvenile Justice Youth Development Policy Board on the FY10-12 allocation process.
Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the renewal of Community Partnership to Protect Children Contract from the Iowa Department of Human Services in the amount of $20,000.00.
RESOLUTION 09-25-08-02
JOHNSON COUNTY BOARD OF SUPERVISORS RESOLUTION APPROVING AN APPLICATION TO THE IOWA DEPARTMENT OF TRANSPORTATION FOR GRANT FUNDING VIA THE FEDERAL RECREATIONAL TRAILS PROGRAM.
Whereas, the Johnson County Trails Advisory Committee has recommended that the County make application to the Iowa Department of Transportation for grant funding via the Federal Recreational Trails Program (the “Program”) to fund an approximate 2.9 mile trail section from West Overlook Road northerly along Dubuque Street to the North Liberty city limits (the “Project”); and
Whereas, the total project estimate is $700,000.00; and
Whereas, the County is applying for funding from the Program in the amount of $516,000.00 to construct the project; and
Whereas, the county, if awarded the grant, must provide an additional $284,000.00 to construct the project; and
Whereas, it is now necessary for the County Board of Supervisors to approve said application.
Now, therefore, be it resolved, by the Board of Supervisors of Johnson County, Iowa that the aforementioned application is hereby be and the same is hereby accepted and approved.
Be it further resolved, that Johnson County will be responsible for the maintenance and operation of the Project, and that the County will adequately maintain the Project for a term of not less than 20 years from the date of acceptance of the Project.
Be it further resolved, that the Chair is hereby directed to execute said application on behalf of the County.
