MINUTES OF THE CANVASS OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
NOVEMBER 12, 2008
Chairperson Sullivan called to order the Johnson County Board of Supervisors at 2:00 p.m. to act as a canvass board to certify the results of the General Election of November 4, 2008. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
ABSTRACT OF VOTES
For the Office of United States President and Vice President (One to be elected) there were seventy-two thousand nine hundred eighty-nine (72,989) votes cast as follows: Barack Obama/Joe Biden received fifty-one thousand twenty-seven (51,027) votes; John McCain/Sarah Palin received twenty thousand seven hundred thirty-two (20,732) votes; Chuck Baldwin/Darrell L. Castle received one hundred twenty-eight (128) votes; Cynthia McKinney/Rosa Clemente received one hundred twenty (120) votes; Bob Barr/Wayne A. Root received two hundred eighty-seven (287) votes; Gloria La Riva/Robert Moses received four (4) votes; Ralph Nader/Matt Gonzalez received three hundred twenty-six (326) votes; Brian Moore/Stewart A. Alexander received ten (10) votes; James Harris/Alyson Kennedy received nine (9) votes; and three hundred forty-six (346) scattered write-in votes were cast.
For the Office of United States Representative District 2 (One to be elected) there were sixty-nine thousand five hundred eighty-six (69,586) votes cast as follows: Dave Loebsack received forty-five thousand two hundred forty-seven (45,247) votes; Mariannette Miller-Meeks received twenty thousand six hundred eighty (20,680) votes; Wendy Barth received two thousand one hundred nine (2,109) votes; Brian White received one thousand four hundred seventy-six (1,476) votes; and seventy-four scattered write-in (74) votes were cast.
For the Office of United States Senator (One to be elected) there were seventy thousand four hundred thirteen (70,413) votes cast as follows: Tom Harkin received fifty-two thousand seven hundred forty-one (52,741) votes; Christopher Reed received seventeen thousand five hundred thirty-seven (17,537) votes; and one hundred thirty-five (135) scattered write-in votes were cast.
For the Office of State Representative District 29 (One to be elected) there were eight thousand three hundred ten (8,310) votes cast as follows: Nate Willems received four thousand seven hundred seventy-seven (4,777) votes; Emma Nemecek received three thousand five hundred sixteen (3516) votes; and seventeen (17) write-in votes were cast.
For the Office of State Representative District 30 (One to be elected) there were sixteen thousand one hundred thirty (16,130) votes cast as follows: Dave Jacoby received fifteen thousand eight hundred fifty-one (15,851) votes; and two hundred seventy-nine (279) scattered write-in votes were cast.
For the Office of State Representative District 77 (One to be elected) there were thirteen thousand seven hundred ninety-four (13,794) votes cast as follows: Mary Mascher received eleven thousand two hundred eighty-four (11,284) votes; Chris L Brewer received two thousand four hundred twenty-one (2,421) votes; and eighty-nine (89) scattered write-in votes were cast.
For the Office of State Representative District 78 (One to be elected) there were fifteen thousand nine hundred forty-six (15,946) votes cast as follows: Vicki Lensing received fifteen thousand seven hundred two (15,702) votes; and two hundred forty-four (244) scattered write-in votes were cast.
For the Office of State Representative District 79 (One to be elected) there were one thousand two hundred forty-five (1,245) votes cast as follows: Rebecca Spears received six hundred eighty-seven (687) votes; Jeff Kaufmann received five hundred fifty-seven (557) votes; and one (1) scattered write-in vote was cast.
For the Office of State Representative District 89 (One to be elected) there were three thousand three hundred ninety-three (3,393) votes cast as follows: Larry K Marek received one thousand nine hundred eighty-nine (1,989) votes; Jarad Klein received one thousand four hundred one (1,401) votes; and three (3) scattered write-in votes were cast.
For the Office of State Senator District 40 (One to be elected) there were one thousand two hundred sixty-one (1,261) votes cast as follows: Sharon Savage received seven hundred forty-seven (747) votes; James F. Hahn received five hundred thirteen (513) votes; and one (1) scattered write-in vote was cast.
For the Office of County Auditor (One to be elected) there were fifty-nine thousand six hundred thirty-eight (59,638) votes cast as follows: Tom Slockett received thirty-eight thousand six hundred ninety-seven (38,697) votes; Hanna Gugliuzza received twenty thousand seven hundred twenty-five (20,725) votes; and two hundred sixteen (216) scattered write-in votes were cast. We therefore declare Tom Slockett duly elected to the office of County Auditor for the term of 4 years.
For the Office of County Sheriff (One to be elected) there were fifty-one thousand nine hundred sixty-six (51,966) votes cast as follows: Lonny L. Pulkrabek received fifty thousand nine hundred twenty-two (50,922) votes; and one thousand forty-four (1,044) scattered write-in votes were cast. We therefore declare Lonny L. Pulkrabek duly elected to the office of County Sheriff for the term of 4 years.
For the Office of County Supervisor (Three to be elected) there were one hundred thirty-two thousand two hundred thirty-four (132,234) votes cast as follows: Pat Harney received forty-five thousand four hundred twenty-five (45,425) votes; Terrence Neuzil received forty-four thousand two hundred fifty-two (44,252) votes; Rod Sullivan received forty-one thousand one hundred fifty-two (41,152) votes; and one thousand four hundred five (1,405) scattered write-in votes were cast. We therefore declare Pat Harney, Terrence Neuzil, and Rod Sullivan duly elected to the office of County Supervisor for the term of 4 years.
For the Office of County Agricultural Extension Council (Four to be elected) there were one hundred twenty-three thousand eight hundred thirty-two (123,832) votes cast as follows: Larry Culver received thirty-three thousand one hundred seventy-five (33,175); Maynard Hebl received twenty-nine thousand six hundred two (29,602) votes; Donna Ruth received thirty thousand four hundred ninety-five (30,495) votes; John Schneider received twenty-nine thousand eight hundred thirty-five (29,835); and seven hundred twenty-five (725) scattered write-in votes were cast. We therefore declare Larry Culver, Maynard Hebl, Donna Ruth, and John Schneider duly elected to the office of County Agricultural Extension Council for the term of 4 years.
For the Office of Soil and Water Commissioner (Three to be elected) there were ninety-eight thousand nine hundred thirty-nine (98,939) votes cast as follows: Nathan M. Moore received thirty-three thousand twenty-eight (33,028) votes; Kelley Putman received thirty-four thousand thirty-nine (34,039) votes; Alex Schmidt received thirty-one thousand fifty-three (31,053) votes; and eight hundred nineteen (819) scattered write-in votes were cast. We therefore declare Nathan M. Moore, Kelley Putman, and Alex Schmidt duly elected to the office of Soil and Water Commissioner for the term of 4 years.
For the Office of Big Grove Township Trustee (Two to be elected) there were six hundred thirty-three (633) votes cast as follows: Roy Smyth received six hundred ten (610) votes; Steven Schaefer received three (3) votes; and twenty (20) scattered write-in votes were cast. We therefore declare Steven Schaefer and Roy Smyth duly elected to the office of Big Grove Township Trustee for the term of 4 years.
For the Office of Cedar Township Trustee (Two to be elected) there were two hundred fifty-four (254) votes cast as follows: Ronald J O'Neil received two hundred thirty-one (231) votes; Scott Devalk received seven (7) write-in votes; and sixteen (16) scattered write-in votes were cast. We therefore declare Scott Devalk and Ronald J O'Neil duly elected to the office of Cedar Township Trustee for the term of 4 years.
For the Office of Clear Creek Township Trustee (Two to be elected) there were ten (10) write-in votes cast as follows: Marjorie Stanton received two (2) votes; Don Pirkl received one (1) vote; Doug Campbell received four (4) votes; David Campbell received one (1) vote; Steven Branin received one (1) vote; and Blank received one (1) vote. We therefore declare Doug Campbell and Marjorie Stanton duly elected to the office of Clear Creek Township Trustee for the term of 4 years.
For the Office of East Lucas Township Trustee (Two to be elected) there were one hundred ninety-six (196) votes cast as follows: Pamela Terrill received one hundred eighty-eight (188) votes; Alicia Lepic received one (1) write-in vote; Andrew Daumeller received one (1) write-in vote; Eldon Snyder received one (1) write in vote; Jaro Lepic received one (1) write-in vote; Jay Christensen-Szalanski received one (1) write-in vote; Jeremy Faden received one (1) write-in vote; and Josef Pohl received one (1) write-in vote. We therefore declare Pamela Terrill duly elected to the office of East Lucas Township Trustee for the term of 4 years. We therefore declare Eldon Snyder duly elected to the office of East Lucas Township Trustee for the term of 4 years, as determined by lot according to Chapter 50.44 of the Code of Iowa, as amended.
For the Office of Fremont Township Trustee (Two to be elected) there were three hundred five (305) votes cast as follows: Gerald Morgan received two hundred eighty-three (283) votes; Gene Zdrazil received six (6) write-in votes; and sixteen (16) scattered write-in votes were cast. We therefore declare Gerald Morgan and Gene Zdrazil duly elected to the office of Fremont Township Trustee for the term of 4 years.
For the Office of Graham Township Trustee to fill vacancy (One to be elected) there were one hundred eighty-two (182) votes cast as follows: Kyle D. Schuchmann received one hundred eighty (180) votes; and two (2) scattered write-in votes were cast. We therefore declare Kyle D. Schuchmann duly elected to the office of Graham Township Trustee to fill vacancy for the term of 2 years.
For the Office of Graham Township Trustee (Two to be elected) there were three hundred sixty (360) votes cast as follows: Donald W. Bulechek received one hundred eighty-four (184) votes; Dwight R Gardner received one hundred sixty-eight (168) votes; and eight (8) scattered write-in votes were cast. We therefore declare Donald W. Bulechek and Dwight R. Gardner duly elected to the office of Graham Township Trustee for the term of 4 years.
For the Office of Hardin Township Trustee (Two to be elected) there were three hundred seventy (370) votes cast as follows: David Campbell received one hundred eighty-seven (187) votes; and Larry J Skripsky received one hundred eighty-three (183) votes. We therefore declare David Campbell and Larry J Skripsky duly elected to the office of Hardin Township Trustee for the term of 4 years.
For the Office of Jefferson Township Trustee (Two to be elected) there were one thousand seven hundred sixteen (1,716) votes cast as follows: James W Bys received nine hundred five (905) votes; Winthrop Gregor received eight hundred (800) votes; and eleven (11) scattered write-in votes were cast. We therefore declare James W Bys and Winthrop Gregor duly elected to the office of Jefferson Township Trustee for the term of 4 years.
For the Office of Liberty Township Trustee (Two to be elected) there were two hundred ninety (290) votes cast as follows: Richard Cole received one hundred thirty-six (136) votes; Randy Lackender received one hundred fifty-two (152) votes; and two (2) scattered write-in votes were cast. We therefore declare Richard Cole and Randy Lackender duly elected to the office of Liberty Township Trustee for the term of 4 years.
For the Office of Lincoln Township Clerk to fill vacancy (One to be elected) there were ninety-one (91) votes cast as follows: Marvin Hotz received ninety-one (91) votes. We therefore declare Marvin Hotz duly elected to the office of Lincoln Township Clerk to fill vacancy for the term of 2 years.
For the Office of Lincoln Township Trustee (Two to be elected) there were eight (8) scattered write-in votes cast as follows: Amie Rockafellow received two (2) votes; Jeremy Hotz received two (2) votes; Gary Smothers received one (1) vote; Kevin Forbes received one (1) vote; Linda Minor received one (1) vote; and John Schneider received one (1) vote. We therefore declare Jeremy Hotz and Amie Rockafellow duly elected to the office of Lincoln Township Trustee for the term of 4 years.
For the Office of Madison Township Trustee (Two to be elected) there were three hundred eighty-four (384) votes cast as follows: Daryl Neitderhisar received one hundred eighty-five (185) votes; and George V. Swenka received one hundred ninety-nine (199) votes. We therefore declare Daryl Neitderhisar and George V. Swenka duly elected to the office of Madison Township Trustee for the term of 4 years.
For the Office of Monroe Township Trustee (Two to be elected) there were three hundred ninety-three (393) votes cast as follows: Roland J. Achey received one hundred sixty-seven (167) votes; and Gary Kloubec received two hundred twenty-six (226) votes. We therefore declare Roland J. Achey and Gary Kloubec duly elected to the office of Monroe Township Trustee for the term of 4 years.
For the Office of Newport Township Trustee (Two to be elected) there were one thousand eight hundred twenty-five (1,825) votes cast as follows: Jim Sedlacek received one thousand seventeen (1,017) votes; Susan Haman Uthoff received seven hundred ninety-four (794) votes; and fourteen (14) scattered write-in votes were cast. We therefore declare Jim Sedlacek and Susan Haman Uthoff duly elected to the office of Newport Township Trustee for the term of 4 years.
For the Office of Oxford Township Trustee (Two to be elected) there were two hundred seventy-seven (277) votes cast as follows: Patrick Hughes received two hundred sixty-three (263) votes; and William Cummins received one (1) vote; and thirteen (13) scattered write-in votes were cast. We therefore declare Patrick Hughes duly elected to the office of Oxford Township Trustee for the term of 4 years. We therefore declare William Cummins elected to the office of Oxford Township Trustee for the term of 4 years as determined by lot according to Chapter 50.44 of the Code of Iowa, as amended.
For the Office of Oxford Township Trustee to fill vacancy (One to be elected) there were two hundred ninety-nine (299) votes cast as follows: James Tandy received two hundred ninety-four (294) votes; and five (5) scattered write-in votes were cast. We therefore declare James Tandy duly elected to the office of Oxford Township Trustee to fill vacancy for the term of 2 years.
For the Office of Penn Township Trustee (Two to be elected) there were one thousand five (1,005) votes cast as follows: James Tallman received nine hundred forty-eight (948) votes; and Ken Leo received twenty-two (22) write in votes. We therefore declare Ken Leo and James Tallman duly elected to the office of Penn Township Trustee for the term of 4 years.
For the Office of Pleasant Valley Township Trustee (Two to be elected) there were one hundred ten (110) votes cast as follows: Ronald Waldschmidt received one hundred seven (107) votes; John Parizek received two (2) write-in votes; and Jeremy Loveks received one (1) write-in vote. We therefore declare John Parizek and Ronald Waldschmidt duly elected to the office of Pleasant Valley Township Trustee for the term of 4 years.
For the Office of Scott Township Trustee (Two to be elected) there were One thousand twenty-nine (1,029) votes cast as follows: Al Lacina received five hundred seventy-six (576) votes; Keith W. Schultes received four hundred forty-seven (447) votes; and six (6) scattered write-in votes were cast. We therefore declare Al Lacina and Keith W. Schultes duly elected to the office of Scott Township Trustee for the term of 4 years.
For the Office of Sharon Township Trustee (Two to be elected) there were four hundred thirteen (413) votes cast as follows: Dale J. Rhodes received two hundred thirteen (213) votes; Cathie Stutsman received one hundred ninety-seven (197) votes; and three (3) scattered write-in votes were cast. We therefore declare Dale J. Rhodes and Cathie Stutsman duly elected to the office of Sharon Township Trustee for the term of 4 years.
For the Office of Union Township Trustee to fill vacancy (One to be elected) there were two hundred seventy-eight (278) votes cast as follows: Vernon J Brogla received two hundred seventy-seven (277) votes; and one (1) scattered write-in vote was cast. We therefore declare Vernon J Brogla duly elected to the office of Union Township Trustee to fill vacancy for the term of 4 years.
For the Office of Union Township Trustee (Two to be elected) there were five hundred forty-two (542) votes cast as follows: Maynard Hebl received two hundred eighty-six (286) votes; Donald K. Johnson received two hundred fifty-two (252) votes; and four (4) scattered write-in votes were cast. We therefore declare Maynard Hebl and Donald K. Johnson duly elected to the office of Union Township Trustee for the term of 4 years.
For the Office of Washington Township Trustee to fill vacancy (One to be elected) there were thirteen (13) write-in votes cast as follows: Anthony Yoder received one (1) vote; Arlee Yoder received one (1) vote; David Telliho received two (2) votes; Gary Hochstedler received three (3) votes; Marvin Eimen received two (2) votes; Robert Connelly received one (1) votes; Troy Roth received two (2) votes; and scattering received one (1) vote. We therefore declare Gary Hochstedler duly elected to the office of Washington Township Trustee to fill vacancy for the term of 2 years.

For the Office of West Lucas Township Trustee (Two to be elected) seven hundred thirty-eight (738) votes were cast as follows: Howard Pewitt received three hundred sixty-eight (368) votes; Tom H Williams received three hundred sixty-three (363) votes; and seven (7) scattered write-in votes were cast. We therefore declare Howard Pewitt and Tom H Williams duly elected to the office of West Lucas Township Trustee for the term of 4 years.
On the question “Shall the following judges of the Supreme Court be retained in office?” Brent Appell received thirty-two thousand three hundred eight (32,308) votes in favor of retention, and nine thousand one hundred fifty-four (9,154) votes opposed. Mark S. Cady received thirty-three thousand one hundred (33,100) votes in favor of retention, and eight thousand eight hundred twenty-nine (8,829) votes opposed. Daryl L. Hecht received thirty-one thousand nine hundred fifty-six (31,956) votes in favor of retention, and nine thousand five hundred fifty-four (9554) votes opposed.
On the question “Shall the following judges of the Court of Appeals be retained in office?” Larry J. Eisenhauer received thirty-one thousand five hundred thirty (31,530) votes in favor of retention, and eight thousand three hundred fifteen (8,315) votes opposed. Terry L. Huitink received thirty-one thousand nine hundred sixty-nine (31,969) votes in favor of retention, and eight thousand nine hundred thirty-seven (8,937) votes opposed. Rosemary Shaw Sackett received thirty-two thousand four hundred fourteen (32,414) votes in favor of retention, and eight thousand nine hundred seventy-one (8,971) votes opposed.
On the question “Shall the following judges of the 6 District be retained in office?” Nancy A. Baumgartner received thirty-two thousand forty-four (32,044) votes in favor of retention, and eight thousand three hundred thirty-eight (8,338) votes opposed. Marsha A. Bergan received thirty-one thousand nine hundred sixty-five (31,965) votes in favor of retention, and eight thousand three hundred twenty-two (8,322) votes opposed. Patrick R. Grady received thirty-two thousand nine hundred twenty-two (32,922) votes in favor of retention, and eight thousand two hundred seven (8,207) votes opposed. Fae Hoover-Grinde received thirty thousand five hundred sixty-four (30,564) votes in favor of retention, and nine thousand one hundred fifty-two (9152) votes opposed. Thomas Koehler received thirty thousand eight hundred fifty-six (30,856) votes in favor of retention, and eight thousand eight hundred nine (8,809) votes opposed.
On the questions “Shall the following associate judges of the 6 District be retained in office?” Casey D. Jones received thirty-one thousand one hundred (31,100) votes in favor of retention, and eight thousand one hundred fifteen (8,115) votes opposed. Russell Glen Keast received thirty thousand four hundred fifty-seven (30,457) votes in favor of retention, and eight thousand six hundred fifty-two (8,652) votes opposed. Barbara H. Liesveld received thirty-one thousand two hundred fourteen (31,214) votes in favor of retention, and eight thousand three hundred sixteen (8,316) votes opposed. Angeline M. Wilson received thirty-one thousand four hundred thirty (31,430) votes in favor of retention, and seven thousand nine hundred fifty (7,950) votes opposed.
Upon the public measure Constitutional Amendment - 1:
Shall the following amendment to the Constitution be adopted?
Summary: Changes the language that describes a person who cannot legally vote from “idiot or insane person” to “a person adjudged mentally incompetent to vote.”
Section 5 of Article II of the Constitution of the State of Iowa is repealed and the following adopted in lieu thereof:
DISQUALIFIED PERSONS. SEC 5. A person adjudged mentally incompetent to vote or a person convicted of any infamous crime shall not be entitled to the privilege of an elector.
There were sixty-four thousand twenty (64,020) votes cast as follows: for the question, there were fifty-three thousand one hundred forty-three (53,143) votes; and against the question, there were ten thousand eight hundred seventy-seven (10,877) votes.
Upon the public measure D:
Local Option Sales and Service Tax – Change of Use for City of West Branch
Shall the Following Public Measure Be Adopted?
To authorize a change in the use of the one percent (1%) local sales and services tax in the City of West Branch effective February 4, 2009.
PROPOSED USE OF THE TAX: If the change is approved, excess revenue from the sales and services tax shall be allocated as follows: 0% for property tax relief; 100% for the renovation and maintenance of the West Branch Town Hall building at 205 East Main Street, West Branch, Iowa.
CURRENT USE OF THE TAX: 0% for property tax relief; 100% of the revenue generated from the sales and services tax was allocated for the specific purpose of repayment for the County Law Enforcement Center Notes. On June 3, 2008 these payments were fulfilled. Therefore, the excess revenue was distributed to the cities.
There were fifty (50) votes cast as follows: for the question, there were thirty-nine (39) votes; and against the question, there were eleven (11) votes.
Upon the public measure E:
Shall the County of Johnson, State of Iowa, be authorized to acquire and develop lands with public access provided, to be managed by the Johnson County Conservation Board, in order to protect the water quality in rivers, lakes and streams; protect forests to improve air quality; protect natural areas and wildlife habitat from development, and provide for parks and trails, at a cost not exceeding $20,000,000 and issue its general obligation bonds in an amount not exceeding $20,000,000 for that purpose, to be repaid in not more than 20 years? All expenditures will be subject to an annual independent audit.
There were sixty-four thousand four hundred sixty-two (64,462) votes cast as follows: for the question, there were thirty-nine thousand one hundred eighty-six (39,186) votes cast; and against the question, there were twenty-five thousand two hundred seventy-six (25,276) votes cast.
