MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
NOVEMBER 18, 2008
Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Terrence Neuzil, Sally Stutsman, and Rod Sullivan; absent: Larry Meyers.
Unless otherwise noted, all actions were taken by the following vote: Roll call: aye: Harney, Stutsman, Sullivan, Neuzil; absent: Meyers.
Motion by Stutsman, second by Neuzil, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Stutsman, to approve the minutes of the formal meeting of November 13, 2008.
Motion by Harney, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Stutsman, to approve and authorize the Chairperson to sign an Application for Fireworks Permit for Andrea Farrier, 2395 560th SW, Kalona on November 28, 2008, with a rain date of November 29, 2008.
Reconvened Public Hearing of November 13, 2008 on Subdivision Application 15468 at 9:02 a.m.
Subdivision Application 15468 of Harold A. Ambrose requesting final plat approval of Longview Estates, a subdivision described as being located in the SW 1/4 of the SE 1/4 of Section 22 and the W 1/2 of the NE 1/4 of Section 27 all located in Township 81 North, Range 7 West of the 5th P.M. in Johnson County, Iowa (This is a 44 lot, 5 outlot, 51.25 acre residential subdivision located on the west side of Curtis Bridge Road NE approximately 1500 feet north of its intersection with Highway 965 in Jefferson Township).

RESOLUTION APPROVING THE FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF LONGVIEW ESTATES JOHNSON COUNTY, IOWA
Whereas, the owner has filed application 15468 for approval of a final plat of Longview Estates, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Owner Certificate; Title Opinion; Certificate of County Auditor; Certificate of County Treasurer; Subdivider’s Agreement; Consent of Mortgagee; Soil Erosion Control Plan; Easement for Public Highway; Underground Utility Easement; Well House Water Well Sanitary Sewer; Open Space Management Plan; Protective Covenants and Restrictions; Developer Agreement; Resolution Affirming the Stability of the Current Road System; B. Subdivision Plat (5).

Zoning Application 15466 of Ken McKenna requesting rezoning of 2.01 acres from C-Commercial to R-Residential of certain property described as Lot 1 in Lager Land Subdivision, being in the SW 1/4 of the SW 1/4 of Section 12, Township 79 North, Range 8 West of the 5th P.M. in Johnson County, Iowa (This property is located on the east side of Cosgrove RD SW, approximately 1200 feet north of its intersection with IWV Road SW in Hardin Township).

Zoning Application 15466
AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM C TO R
SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described in Section II hereof from C to R
SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Hardin Township and comprised of approximately 2.01 acres to wit:
Lot 1 of Lager Land Subdivision as recorded in Plat Book 18 Page 1 of the records of the Johnson County Recorders Office.
is hereby changed from C to R.
SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.I of the Johnson County Unified Development Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.
SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.
SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.
On November 13, 2008, motion by Stutsman, second by Neuzil, to waive the requirement of three considerations before amending an ordinance and to approve Application 15466 on first and second consideration. Roll call: aye: Harney, Stutsman, Sullivan, Neuzil, Meyers.
Motion by Harney, second by Neuzil, to approve Application 15466 on final consideration and to approve Ordinance 11-18-08-Z1. Roll call: aye: Harney, Stutsman, Sullivan, Neuzil; absent: Meyers.
Public Hearing closed at 9:05 a.m.
Motion by Neuzil, second by Stutsman, to approve the draft Request for Proposals developed by a subcommittee of the Juvenile Justice Youth Development Policy Board to announce a competitive process to award up to $200,000 for the prevention of juvenile delinquency.
Motion by Neuzil, second by Stutsman, to reappoint Thomas Hoff to the Johnson County Conservation Board for a term ending December 31, 2013.
Motion by Stutsman, second by Harney, to order the recount of all ballots for Public Measure D, the Conservation Bond Issue. Roll call: aye: Harney, Stutsman, Sullivan, Neuzil; absent: Meyers.
