MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

FEBRUARY 26, 2009

 

      Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Stutsman, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Stutsman, second by Meyers, to approve the minutes of the formal meeting of February 19, 2009. 

 

      Motion by Harney, second by Sullivan, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Meyers, to accept the Recorder’s Report of Fees Collected for the month of January, 2009, in the amount of $125,834.84 as submitted by County Recorder Kim Painter.

 

RESOLUTION 02-26-09-01

A RESOLUTION AFFECTING ALL JURISDICTIONS IN JOHNSON COUNTY, IOWA, DESIGNATING THE DATE AT WHICH A LOCAL SALES AND SERVICES TAX WILL BE REPEALED, IN THE EVENT SUCH TAX IS IMPOSED, FOR EACH JOHNSON COUNTY JURISDICTION VOTING ON THE ISSUE AT THE MAY 5, 2009, LOCAL OPTION SALES AND SERVICES TAX ELECTION

 

      Whereas, pursuant to Code of Iowa Section 423B.1, as amended by Senate File 44, and a resolution of the Council of the City of Iowa City, Iowa, an election date of May 5, 2009 has been established for the question of the imposition of a local sales and services tax in the incorporated and unincorporated areas of Johnson County, Iowa. 

 

      Whereas, Code of Iowa Section 423B.1, as amended by Senate File 44, dictates that the imposition date for a local option sales and services tax approved at an election held on May 5, 2009, shall be July 1, 2009; and

 

      Whereas, pursuant to Code of Iowa 423B.1, the Board of Supervisors may specify a date upon which the local option sales and services tax will be automatically repealed.

 

      Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, that:

 

      If a local sales and services tax is imposed as a result of the May 5, 2009 election, said local sales and services tax will be automatically repealed on June 30, 2013 in the following jurisdictions in Johnson County, Iowa:

 

      Coralville, Hills, Iowa City, Lone Tree, North Liberty, Oxford, Shueyville, Solon, Swisher, Tiffin, University Heights, West Branch, and the unincorporated area of Johnson County.

 

      Motion by Stutsman, second by Meyers, to approve Resolution 02-26-09-01.  Roll call: Aye: Harney, Stutsman, Meyers: nay: Neuzil, Sullivan. 

 

RESOLUTION 02-26-09-02

A RESOLUTION AFFECTING THE UNINCORPORATED AREA OF JOHNSON COUNTY, IOWA, DESIGNATING THE DATE AT WHICH A LOCAL SALES AND SERVICES TAX WILL TAKE EFFECT, IN THE EVENT SUCH TAX IS IMPOSED, IN THE UNINCORPORATED AREA OF JOHNSON COUNTY, IOWA, THE RATE OF SUCH TAX, AND DESIGNATING THE PERCENTAGE OF SUCH TAX REVENUES TO BE DEVOTED TO PROPERTY TAX RELIEF AND THE PROPOSED USE OF THE REMAINDER OF SUCH REVENUES

 

      Whereas, pursuant to Code of Iowa Section 423B.1, as amended by Senate File 44, and a resolution of the Council of the City of Iowa City, Iowa, an election date of May 5, 2009 has been established for the question of the imposition of a local sales and services tax in the incorporated and unincorporated areas of Johnson County, Iowa; and 

 

      Whereas, Iowa law authorizing imposition of the tax allows each jurisdiction wherein the tax would be imposed to individually designate the rate, up to one percent, of the tax to be imposed, and the percentage or amount of local option tax revenues each will devote to property tax relief and the specific purposes other than property tax relief for which revenues will be expended in the jurisdiction. 

 

      Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, that, if imposed as a result of the May 5, 2009 election, a local sales and services tax will be set in the unincorporated areas of Johnson County at the rate of one percent (1%), and will take effect on July 1, 2009. 

 

      Be It Further Resolved, that revenues from a local sales and services tax, if imposed in the unincorporated areas of Johnson County, Iowa, will be allocated as follows:

 

      1.  Fifty percent (50%) for property tax relief in the unincorporated areas of Johnson County.

 

      2.  The specific purpose for which the revenues will otherwise be expended is: Fifty percent (50%) for improvement and/or maintenance of Johnson County secondary roads and bridges.

 

      Motion by Stutsman, second by Meyers, to approve Resolution 02-26-09-02.  Roll call: Aye: Harney, Stutsman, Meyers: nay: Neuzil, Sullivan. 

 

      Motion by Sullivan, second by Stutsman, to approve and authorize the Chairperson to sign the right-of-way agreement for the bridge replacement project on Black Diamond Road (F52) over Old Man’s Creek, Section 31, T79N, R8W, Hardin Township, for $1,080.00 with Marie Catherine Crow, Ada M. Crow, Lyle Crow, Leanne Schwarting, Joan Brogaard, Harold Dean Crow, Helen Crow Day, Kathryn Crow Yoder, and Edward Alan Kasper.

 

      Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the right-of-way agreement for the bridge replacement project on Black Diamond Road (F52) over Old Man’s Creek, Section 31, T79N, R8W, Hardin Township, for $200.00 with Norma F. Schrock.

 

      Motion by Harney, second by Sullivan, to approve the Request for the WIC/MCH Data Program Specialist position as a result of the reorganization of the WIC/MCH Division within the Health Department. 

 

      Motion by Stutsman, second by Sullivan, to appoint Johnson County Social Services Coordinator Amy Correia as Johnson County’s official representative to the HACAP Board of Directors effective March 1, 2009.

 

      Motion by Meyers, second by Stutsman, to approve and authorize the Board of Supervisors to sign a letter responding to the new State rules regarding the hours of operation for the Veteran Affairs Office and discussion of options for responding to the change.

 

      Motion by Stutsman, second by Meyers, to set a public hearing for the Mental Health/Disability Services (MH/DS) FY10-12 Strategic Plan for Thursday, March 19, 2009, at the Administration Building, 913 S. Dubuque Street, at 9:00 a.m., and authorize the Auditor’s Office to publish notice.

 

      Motion by Meyers, second by Sullivan, to set a public hearing amending language for the Johnson County Services Management Plan for Thursday, March 19, 2009, at the Administration Building, 913 S. Dubuque Street, at 9:00 a.m., and authorize the Auditor's Office to publish notice.
