MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
MAY 14, 2009
Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Social Services Coordinator Amy Correia said the “You Earned It, Now Claim It!” Program would not exist without the strong support from the University of Iowa, the Tippie College of Business, Beta Alpha Psi, and student volunteers. The 2009 program received financial support from the University of Iowa Community Credit Union, Veridian Credit Union, United Way of Johnson County, and Iowans for Social and Economic Development Ventures (ISED).
Correia thanked the following planning committee members and the organizations they represent: Tippie College of Business Associate Professor Dr. Joyce Berg, Iowa City Community School District Representative Joan VandenBerg, Iowa City Housing Authority Representative Steve Rakis, Neighborhood Centers of Johnson County Program Director Susan Freeman, Iowa City Public Library Reference Librarian Coordinator Maeve Clarke, United Way of Johnson County Community Impact Director Patti Fields, Johnson County Council of Governments Human Services Coordinator Linda Severson, Sullivan, and herself. She also thanked Iowa City Document Services Representative Shannon McMahon, Internal Revenue Service Representative Elizabeth Skiba, ISED Ventures Representative Jay Kerrigan, and the Johnson County Social Services Department for administrative support and coordination.
Correia said there were 36 tax preparation clinics for a total of 126 scheduled hours. She said that in many cases, volunteers arrived early and stayed for hours after the scheduled closing time. She said 93 University of Iowa students volunteered over 1,800 hours. A total of 954 returns were filed which represents a 42% increase from last year. Total Federal refunds received by tax filers utilizing the program is in excess of $1.2 million, and $400,000 of those refund dollars were in Earned Income Credit refunds.
Correia said each volunteer will receive a certificate which reads: "The Johnson County Board of Supervisors presents this certificate of appreciation for their contribution to the You Earned It, Now Claim It campaign to support the financial security of workers earning less than $42,000 per year. This collaboration involving the Tippie College of Business, Beta Alpha Psi, Volunteer income tax assistance program assisted in the filing of over 900 tax returns. Your commitment to social and economic health of the people of Johnson County inspires many." Correia introduced program volunteers Evan Malcom, Nathan Stouder, and Dr. Joyce Berg. Motion by Stutsman, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Meyers, to approve the minutes of the formal meeting of May 7, 2009.
Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by , second by , to place on file the Clerk’s Report of Fees Collected for the month of April, 2008, in the amount of $13,857.51, as submitted by Clerk of District Court Lodema Berkley.
Convened Public Hearing on Platting Applications at 5:39 p.m.
Subdivision Application 15701 of David Hodge requesting preliminary and final plat approval of Black Diamond Gem, a subdivision described as being located in the NE 1/4 of the NE 1/4 of Section 32 and in the SE 1/4 of the SE 1/4 of Section 29 Township 79; Range 7 West, of the 5th P.M. in Johnson County, Iowa. This is a 1 lot 3.00 acre farmstead split located on the north side of Black Diamond Road SW approximately 1/4 mile east of its intersection with Half Moon Avenue SW in Union Township.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF BLACK DIAMOND GEM JOHNSON COUNTY, IOWA
Whereas, the owner has filed application 15701 for approval of a preliminary and final plat of Black Diamond Gem, and
Whereas, the County Zoning Commission, having studied said application recommends that the plat be approved.
Now, Therefore, be it Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. This is a 1 lot, 4.00 acre farmstead split located on the south side of 140th Street NE approximately 1/2 mile east of its intersection with Polk Avenue NE in Big Grove Township.

Now, Therefore, be it Resolved by the Board of Supervisors of Johnson County, Iowa:

Motion by Harney, second by Meyers, to approve Resolution 05-14-09-Z2.
Subdivision Application 15702 of Dellis Miller requesting preliminary and final plat approval of Miller Estates, a subdivision described as being located in the S 1/2 of Section 25 Township 81, Range 6 West of the 5th P.M. in Johnson County, Iowa. This is a 1 lot, 5.00 acre, farmstead split located on the west side of Highway 1 NE approximately 2500 feet north of the intersection of Highway 1 NE and 200th Street NE in Big Grove Township.
Neuzil said he was surprised that Solon did not want a little more input into this application because the property is fairly close to their city limits. He said traveling up Highway #1 on the left is the big white house and this subdivision would be behind there and it does leave some room. He asked if that is where they want to keep it commercial. Assistant Planner Josh Busard said the only thing Solon wanted was to keep this area as frontage for a commercial development. Sullivan said he called and spoke to the Solon City Manager about this because he feels like in 20 years a huge problem will surface but he is not on the Solon City Council and they can recommend it if they want. Meyers said he feels the same way and this seems kind of short sighted. Sullivan said a one acre parcel with a four acre outlot would have made a lot more sense.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF MILLER ESTATES JOHNSON COUNTY, IOWA
Whereas, the owner has filed application 15702 for approval of a preliminary and final plat of Miller Estates, and
Whereas, the County Zoning Commission, having studied said application recommends that the plat be approved.
Now, Therefore, be it Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Solon City Council Approval; Owners’ Certificate and Consent; Opinion of Attorney; Certificate of County Treasurer; Certificate of County Auditor; County-Subdivider Agreement Covenant Concerning Fences; Resolution Affirming the Stability of the Current Road System; B. RESOLUTION 05-14-09-Z4
APPROVING THE FRINGE AREA AGREEMENT BETWEEN JOHNSON COUNTY, IOWA AND THE CITY OF ELY, IOWA
Whereas, the 1998 Johnson County Land Use Plan as amended and updated calls for the preparation and adoption of development plans and agreements between the County and the City regarding municipality and its environs: and
Whereas, the Board of Supervisors finds that such policies are necessary to more effectively and economically provide services for future growth and development and to protect and preserve the fringe areas natural resources and its environmentally sensitive features, and
Whereas, the Board of Supervisors finds that it is in the public interest to adopt said Johnson County/Ely Fringe Area Agreement.
Now, Therefore, Be It Resolved by the Johnson County Board of Supervisors, that the following Johnson County/Ely Fringe Area Agreement, copies of which can be obtained at the Johnson County Planning and Zoning Office, Johnson County Auditor’s Office or at www.johnson-county.com, is hereby adopted.
Be It Further Resolved that this Johnson County/Ely Fringe Area Agreement shall become effective upon adoption of this Resolution.

RESOLUTION 05-14-09-Z5
Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on May 11, 2009, filed its report and recommendations for certain actions;
Now, therefore, be it resolved as follows:
1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 11th day of June, 2009 at 5:30 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following subdivision applications: Stark(15633), Hansen(15750), Phillips(15751), Crosheck(15752) and zoning application Wonick(15599).
2. That the Johnson County Auditor be authorized to publish the official notice of above public hearing.
Motion by Stutsman, second by Sullivan, to approve Resolution 05-14-09-Z5.
Motion by Stutsman, second by Meyers, to approve the Johnson County Board of Supervisor's intent to proceed with the contract under FEMA guidelines or by County guidelines or a combination of both to either repair or remove the Sutliff Bridge based on pending information from the engineering inspection report.
Motion by Sullivan, second by Meyers, to approve and authorize the Chairperson to sign the amendment to the contract with the Linn County Detention Center for FY10 to guarantee four beds.
Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign a letter to the Central Iowa Detention Center declining a contract for FY10.
Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign the contract renewal with the Department of Human Services for Decat Coordination Services.
Motion by Harney, second by Sullivan, to approve changing the budgeted Word Processor III vacancy to a Clerk I job classification and approve the new job description for Mental Health/Disability Services.
Motion by Meyers, second by Sullivan, to appoint Laura Hoover for a term ending December 31, 2009 and Jennifer Price for a term ending December 31, 2011 to the Johnson County Historic Preservation Commission. Roll call: aye: Meyers, Neuzil, Sullivan; nay: Harney and Stutsman.
Motion by Stutsman, second by Harney, to appoint R.J. Moore to the Johnson County Commission of Veteran Affairs for an unexpired term ending May 31, 2011.
