MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JUNE 18, 2009

 

      Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

PROCLAMATION 06-18-09-01

IN RECOGNITION AND SUPPORT OF THE AMERICAN CANCER SOCIETY RELAY FOR LIFE

 

      Whereas, each year, the Johnson County community comes together to create a world with less cancer and more birthdays; and

 

      Whereas, during the 25th year of Relay For Life, the communities of Johnson County will celebrate the lives of those who have had cancer, remember those lost, and fight back against this disease; and

 

      Whereas, there are an estimated 11.1 million Americans with a history of cancer alive today; and

 

      Whereas, this year alone, more than 1.4 million new cases of cancer will be diagnosed in the United States; and more than 16,700 new cases of cancer will be diagnosed in Iowa; and

 

      Whereas, money raised during the American Cancer Society Relay For Life of Johnson County helps support research, education, advocacy and patient services; and

 

      Now, Therefore, be it resolved that we, the Johnson County Board of Supervisors do hereby proclaim June 19th and June 20th as “Relay For Life Days” in Johnson County and encourage citizens to participate in Relay For Life of Johnson County at the Clear Creek Amana High School on June 19-20, 2009.

 

      Motion by Stutsman, second by Sullivan, to approve Proclamation 06-18-09-01.

 

      Motion by Sullivan, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Meyers, second by Stutsman, to approve the minutes of the formal meeting of June 11, 2009. 

 

      Motion by Harney, second by Meyers, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Stutsman, to accept the Recorder’s Report of Fees Collected for the month of May, 2009 in the amount of $209,597.83, as submitted by County Recorder Kim Painter.

 

      Ordinance adopting by reference the 2008 National Electrical Code, including Annex H, and also adopting amendments to said standard code. 

 

      On June 11, 2009, motion by Sullivan, second by Stutsman, to approve the ordinance adopting by reference the 2008 National Electrical Code, including Annex H, and also adopting amendments to said standard code on first consideration.  Roll call: aye: Harney, Stutsman, Neuzil, Sullivan, Meyers. 

 

      Motion by Stutsman, second by Sullivan, to approve the ordinance adopting by reference the 2008 National Electrical Code, including Annex H, and also adopting amendments to said standard code on second consideration: Roll call: aye: Harney, Stutsman, Neuzil, Sullivan, Meyers. 

 

      Motion by Harney, second by Stutsman, to accept the Finance Committee recommendation to apply $2 million of the balance available in the Capital Projects Fund to pay down the bank loan for construction of the Health and Human Services Building.

 

      Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign the Tiffin town contract totaling approximately 24 hours per week at a rate of $31.00 per hour or a total of $38,610.00 per year.

 

RESOLUTION 06-18-09-01

 

RESOLUTION SETTING FORTH PROPOSED PLAN TO DISPOSE OF COUNTY-OWNED REAL PROPERTY CONSISTING OF A REMNANT PARCEL LOCATED AT THE INTERSECTION OF CAMP CARDINAL ROAD AND CAMP CARDINAL BOULEVARD IN IOWA CITY, IOWA

 

      Whereas, Johnson County is the owner of real property located immediately north and west of the intersection of Camp Cardinal Road and Camp Cardinal Boulevard in Iowa City, Iowa; and

 

      Whereas, this is generally a triangular tract consisting of approximately three acres of undeveloped property with approximately 680 feet of frontage along Camp Cardinal Boulevard and approximately 410 feet of frontage on Camp Cardinal Road; and

 

      Whereas, the parcel is a remnant of a larger tract that had been owned by Johnson County but was cut off with the improvement of Highway 218; and

 

      Whereas, Section 331.361(2) of the 2009 Code of Iowa requires the County, in disposing of an interest in real property, to set forth its proposal in a resolution, to publish notice of the time and place of a public hearing on the proposal and, after the public hearing, to make a final determination on the proposal; and

 

      Whereas, the Johnson County Board of Supervisors’ proposal to dispose of the County’s interest in the real property referenced is as follows:

 

Proposed Plan to Dispose of County-Owned Real Property Consisting of

a Remnant Parcel located at the Intersection of Camp Cardinal Road and Camp Cardinal Boulevard in Iowa City, Iowa

 

Johnson County is the owner of real property located immediately north and west of the intersection of Camp Cardinal Road and Camp Cardinal Boulevard in Iowa City, Iowa.  This is generally a triangular tract consisting of approximately three acres of undeveloped property with approximately 680 feet of frontage along Camp Cardinal Boulevard and approximately 410 feet of frontage on Camp Cardinal Road.  It is a remnant of a larger tract that had been owned by Johnson County but was cut off with the improvement of Highway 218.  The legal description for the property is as follows:

 

That portion of the southeast quarter of the southeast quarter of Section 12-79-7 lying north and east of Camp Cardinal Boulevard and lying west of Camp Cardinal Road, in Iowa City, Johnson County, Iowa

 

The Johnson County Board of Supervisors has determined to dispose of the property.  The plan is to sell Johnson County’s fee interest in the approximately three acre tract to the highest bidder at a public auction, setting the minimum bid for the tract at $115,000.00, the value of the property as determined by an independent appraisal.  The County would reserve the right to reject all bids if none meets the minimum bid and would require payment in full, possibly at the conclusion of the auction.

      Therefore, be it Resolved by the Johnson County Board of Supervisors that it hereby sets forth its proposal to dispose of county-owned real property consisting of approximately three undeveloped acres north and west of the intersection of Camp Cardinal Boulevard and Camp Cardinal Road in Iowa City, Iowa,

 

and as specifically described in the proposal.

RESOLUTION 06-18-09-02

 

RESOLUTION SETTING PUBLIC HEARING ON PROPOSED PLAN TO DISPOSE OF COUNTY-OWNED REAL PROPERTY CONSISTING OF A REMNANT PARCEL LOCATED AT THE INTERSECTION OF CAMP CARDINAL ROAD AND CAMP CARDINAL BOULEVARD IN IOWA CITY, IOWA

 

      Whereas, Johnson County is the owner of real property located immediately north and west of the intersection of Camp Cardinal Road and Camp Cardinal Boulevard in Iowa City, Iowa; and

      Whereas, the Johnson County Board of Supervisors has set forth by resolution a proposal to dispose of county-owned real property consisting of a remnant parcel located at the intersection of Camp Cardinal Boulevard and Camp Cardinal Road.

 

      Therefore, be it Resolved by the Johnson County Board of Supervisors that the plans for disposing of this interest in real property are set out in the Proposed Plan to Dispose of County-Owned Real Property Consisting of a Remnant Parcel located at the Intersection of Camp Cardinal Road and Camp Cardinal Boulevard in Iowa City, Iowa, and are available at the Johnson County Auditor’s Office at 913 S. Dubuque Street, Iowa City; and

 

      Be it Further Resolved that the Board of Supervisors proposes to dispose of the property by selling Johnson County’s fee interest in the approximately three acre parcel to the highest bidder at a public auction, setting the minimum bid for the tract at $115,000.00, the value of the property as determined by an independent appraisal; and

 

      Be it Further Resolved that in accordance with Section 331.361(2) of the 2009 Code of Iowa, a public hearing on said proposed plan to dispose of the interest in property is set for July 2, 2009, at 9:00 A.M., in the Boardroom of the Johnson County Board of Supervisors, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa.  The Johnson County Auditor is hereby directed to publish notice of the hearing no less than four (4) and no more than twenty (20) days prior to the same.

 

      Motion by Sullivan, second by Meyers, to approve Resolution 06-18-09-02.

 

      Motion by Sullivan, second by Meyers, to approve the Mental Health/Disability Services Provider Agency FY10 rates with ARC of Southeast Iowa.

 

      Motion by Sullivan, second by Meyers, to approve the Mental Health/Disability Services Provider Agency FY10 rates with Chatham Oaks, Inc.

 

      Motion by Stutsman, second by Sullivan, to approve the Mental Health/Disability Services Provider Agency FY10 rates with the Community Mental Health Center of Mid-Eastern Iowa.

 

      Motion by Meyers, second by Stutsman, to approve the Mental Health/Disability Services Provider Agency FY10 rates with Goodwill Industries of the Heartland.

 

      Motion by Stutsman, second by Sullivan, to approve the Mental Health/Disability Services Provider Agency FY10 rates with Hillcrest Family Services.

 

      Motion by Stutsman, second by Meyers, to approve the Mental Health/Disability Services Provider Agency FY10 rates with Life Skills, Inc.

 

      Motion by Sullivan, second by Stutsman, to approve the Mental Health/Disability Services Provider Agency FY10 rates with the Mayors Youth Empowerment Program.

 

      Motion by Sullivan, second by Meyers, to approve the Mental Health/Disability Services Provider Agency FY10 rates with Reach for Your Potential.

 

      Motion by Sullivan, second by Stutsman, to approve the Mental Health/Disability Services Provider Agency FY10 rates with Successful Living.

 

      Motion by Harney, second by Stutsman, to approve the Mental Health/Disability Services Provider Agency FY10 rates with and Systems Unlimited.

 

      Motion by Stutsman, second by Meyers, to approve and authorize the Chairperson to sign the Mental Health/Disability Services new Provider Contracts and establishment of FY10 service rates with First Resources. 

 

      Motion by Sullivan, second by Meyers, to approve and authorize the Chairperson to sign the Mental Health/Disability Services new Provider Contracts and establishment of FY10 service rates with ResCare.

 

RESOLUTION 06-18-09-03

 

DESIGNATING ANDY JOHNSON AS AUTHORIZED REPRESENTATIVE AND TERRENCE NEUZIL AS CHIEF FINANCIAL OFFICER WITH AUTHORITY TO SIGN AND FILE DOCUMENTS ON BEHALF OF JOHNSON COUNTY WITH THE IOWA HOMELAND SECURITY AND EMERGENCY MANAGEMENT DIVISION AND THE FEDERAL EMERGENCY MANAGEMENT AGENCY

 

      Whereas, Johnson County continues to work with the Iowa Homeland Security and Emergency Management Division (HSEMD) and the Federal Emergency Management Agency (FEMA) regarding projects resulting from the floods of 2008; and

 

      Whereas, HSEMD and FEMA require that an applicant for funds designate an “Authorized Representative” and a “Chief Financial Officer” for purposes of signing and filing documents and that the Authorized Representative and Chief Financial Officer be authorized by official resolution, code, or statute, recognized by the governing body of the applicant as legally binding; and

 

      Whereas, Mike Sullivan, as Executive Assistant to the Board, was previously designated as Authorized Representative and Rod Sullivan, as chair of the Board of Supervisors, was designated Chief Financial Officer; and

 

      Whereas, Andy Johnson and Terrence Neuzil currently serve in the positions previously held by Mike Sullivan and Rod Sullivan, respectively,

 

      Therefore, be it Resolved that Andy Johnson is hereby designated as the Authorized Representative, and Terrence Neuzil is hereby designated as the Chief Financial Officer for the purposes of signing and filing documents with the Iowa Homeland Security and Emergency Management Division and the Federal Emergency Management Agency on behalf of Johnson County.

 

      Motion by Meyers, second by Stutsman, to approve Resolution 06-18-09-03.

 

      Motion by Harney, second by Stutsman, to approve and authorize the Chairperson to sign the 2009-2010 contract with the Johnson County Agricultural Association for the amount of $93,765.00.

 

      Motion by Sullivan, second by Stutsman, to reappoint Al Axeen, John Arthur,

 Jeff Lihs, Jerry Szezech, Cynthia Severs, Bryan Bredman, and Mayor Jim Fausett to the Johnson County Rural Advisory Committee for a term ending June 30, 2011.
