MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JULY 2, 2009

 

      Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:02 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Presentation of $19,339 to Johnson County Through Mid-American Energy’s Energy Efficiency Rebate Program, Received for Energy Efficient Components of the Johnson County Health and Human Services Building.

 

      Motion by Stutsman, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Meyers, second by Stutsman, to approve the minutes of the formal meeting of June 25, 2009. 

 

      Motion by Sullivan, second by Meyers, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Convened Public Hearing on Proposed Plan to Dispose of County-Owned Real Property Consisting of a Remnant Parcel Located at the Intersection of Camp Cardinal Road and Camp Cardinal Boulevard in Iowa City, Iowa 9:05 a.m.

 

      No member of the public spoke regarding the proposed plan.  Public Hearing closed at 9:07 a.m.

 

RESOLUTION 07-02-09-01

RESOLUTION ADOPTING PROPOSED PLAN TO DISPOSE OF COUNTY-OWNED REAL PROPERTY CONSISTING OF A REMNANT PARCEL LOCATED AT THE INTERSECTION OF CAMP CARDINAL ROAD AND CAMP CARDINAL BOULEVARD IN IOWA CITY, IOWA

 

      Whereas, Johnson County is the owner of real property located immediately north and west of the intersection of Camp Cardinal Road and Camp Cardinal Boulevard in Iowa City, Iowa; and

 

      Whereas, this is generally a triangular tract consisting of approximately three acres of undeveloped property with approximately 680 feet of frontage along Camp Cardinal Boulevard and approximately 410 feet of frontage on Camp Cardinal Road; and

 

      Whereas, the parcel is a remnant of a larger tract that had been owned by Johnson County but was cut off with the improvement of Highway 218; and

 

      Whereas, in accordance with Section 331.361(2) of the 2009 Code of Iowa, a public hearing on a proposed plan to dispose of the county’s interest in this real property was held on this the 2nd day of July, 2009, at 9:00 A.M., in the Boardroom of the Johnson County Board of Supervisors, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa; and

 

      Whereas, after said hearing, the Johnson County Board of Supervisors made its final determination on the proposed plan to dispose of county-owned real property consisting of approximately three undeveloped acres north and west of the intersection of Camp Cardinal Boulevard and Camp Cardinal Road in Iowa City, Iowa, and decide to sell Johnson County’s fee interest in the approximately three acre parcel to the highest bidder at a public auction, setting the minimum bid for the parcel at $115,000.00, the value of the property as determined by an independent appraisal.  The Board has further decided that the County will reserve the right to reject any and all bids if none meets the minimum bid; will require payment of the purchase price in full, possibly at the conclusion of the auction; will set such other conditions on the auction and sale so as to adequately carry out the Board’s intent as set out herein; and will retain the services of a professional auctioneer for the purposes of advertising and conducting the auction; and

 

      Whereas, this conveyance to the highest bidder, as described above and in the proposal set forth, is necessary and will be the best method to dispose of the subject property.

 

      Therefore, Be It Resolved by the Johnson County Board of Supervisors that disposing of county-owned real property consisting of approximately three undeveloped acres north and west of the intersection of Camp Cardinal Boulevard and Camp Cardinal Road in Iowa City, Iowa, is deemed necessary; and

 

      Be It Further Resolved that the plan to dispose of county-owned real property consisting of approximately three undeveloped acres north and west of the intersection of Camp Cardinal Boulevard and Camp Cardinal Road in Iowa City, Iowa, and as specifically described in the proposal and available at the Johnson County Auditor’s Office at 913 S. Dubuque Street, is hereby adopted; and

 

      Be It Further Resolved the Johnson County Board of Supervisors shall dispose of Johnson County’s fee interest in the approximately three acre parcel described in the Proposed Plan to the highest bidder at a public auction, setting the minimum bid for the tract at $115,000.00, the value of the property as determined by an independent appraisal; the County shall reserve the right to reject all bids if none meets the minimum bid, shall require payment in full and its representatives shall set such other conditions on the auction and sale so as to adequately carry out the Board’s intent as set out herein, and will retain the services of a professional auctioneer for the purposes of advertising and conducting the auction; and

 

      Be It Further Resolved that the Board of Supervisors hereby authorizes the Chairperson to sign on its behalf any documents of conveyance necessary to fulfill the above-referenced Proposed Plan, including but not limited to a deed, and to take any other such actions to convey the interests in real property described above.

 

      Motion by Sullivan, second by Meyers, to approve Resolution 07-02-09-01.

 

RESOLUTION 07-02-09-T1

TRANSFERRING FROM THE CAPITAL PROJECTS FUND

TO THE DEBT SERVICE FUND

 

      Whereas, the Capital Projects Fund has budgeted monies for both projects as defined by the Board of Supervisors or debt retirement; and

 

      Whereas, there is $2,000,000 available to apply to the payment of outstanding debt.

 

      Therefore Be It Resolved that the Auditor is authorized to transfer $2,000,000 from the Capital Projects Fund to the Debt Service Fund.

 

      Motion by Harney, second by Sullivan, to approve Resolution 07-02-09-T1.

 

RESOLUTION 07-02-09-02

RESOLUTION AWARDING AND AUTHORIZING EXECUTION

OF CONTRACT FOR JOHNSON COUNTY ADMINISTRATION BUILDING RENOVATION PROJECT

 

      Whereas, on the 4th day of June, 2009, after notice as required by law, a public hearing was conducted concerning the proposed plans, specifications and form of contract for, and the estimated cost of, the Johnson County Administration Building Renovation Project; and

 

      Whereas, after said public hearing and hearing all the evidence presented, and on that date the Johnson County Board of Supervisors gave due consideration to and adopted a resolution approving said proposed plans, specifications, form of contract for, and the estimated cost of, said construction, and providing that sealed bids for the construction of said maintenance shed be solicited for receipt by the Johnson County Auditor no later than 1:00 P.M. Central Time, June 30, 2009, Notice to bidders being published pursuant to the Iowa Code; and

 

      Whereas, at said time and place the bids were opened and the amounts of all bids announced and it was determined that the lowest responsive, responsible bidder, determined pursuant to Iowa Code §§ 26.9-.10, was Knutson Construction Services of Iowa City, Iowa, and said bid was for $776,000.00.

 

      Now, Therefore, Be It Resolved that Knutson Construction Services of Iowa City, Iowa, was the lowest responsive, responsible bidder for the proposed project, and that the bid amount is $776,000.00 for the Johnson County Administration Building Renovation Project, as shown in the plans previously adopted by the Board;

 

      Be It Further Resolved that the Board hereby awards the contract for the Johnson County Administration Building Renovation Project, as shown in the plans previously adopted by the Board to Knutson Construction Services of Iowa City, Iowa, and authorizes the Chairperson to sign any documents, including the previously approved form of contract, necessary to effectuate said award of contract in such manner as is consistent with Iowa law.

 

      Motion by Stutsman, second by Sullivan, to approve Resolution 07-02-09-02.

 

      Motion by Stutsman, second by Harney, to approve and authorize the Chairperson to sign an agreement between the City of Iowa City, Iowa and Johnson County regarding 2009 Byrne Justice Assistance Grant (JAG) Program Award in the amount of $60,597 to be used to purchase police training and range equipment for a multi-jurisdictional firearms range.

 

      Motion by Stutsman, second by Sullivan, to approve the government pricing rates for GIS services. 

 

      Motion by Stutsman, second by Sullivan, to reappoint Tammy Rowe, and to appoint Michael Bowers to the Targeted Case Management Advisory Board for a term ending June 30, 2012.

 

      Motion by Sullivan, second by Meyers, to approve and authorize the Chairperson to sign FY10 Provider Contracts and rates renewals for six area pharmacies at eleven locations.

 

      Motion by Stutsman, second by Meyers, to approve the Medical Examiner’s Department Medical Secretary job description.

 

      Motion by Sullivan, second by Meyers, to approve and authorize the Chairperson to sign the Iowa Department of Transportation 28E Construction Project Agreement, 2009-C-175, for HMA Resurfacing on Iowa Highway #1 from I-80 North to Solon.

 

      Motion by Sullivan, second by Meyers, to approve and authorize the Chairperson to sign a contract for Project # STP-S-CO52(77)—5E-52, Highway 965 from Croy Road North to 120th Street NE with Streb Construction Inc., for the bid amount of $2,303,285.25.

 

      Motion by Sullivan, second by Harney, to approve and authorize the Chairperson to sign a contract for Project # STP-S-CO52(88)—5E-52, Oak Crest Hill Road from South of the Hills Corporate Limits North to Highway #921 with Streb Construction Inc., for the bid amount of $3,035,037.10.

 

      Motion by Sullivan, second by Stutsman, to approve setting a joint public hearing of the Boards of Supervisors of Cedar County and Johnson County for July 30, 2009 at 9:00 a.m. for the Level “B” Section of Roadway, 145th Street NE, Road Vacation, located in Section 13, Township 81 North, Range 5 West in Cedar Township.

 

      Motion by Sullivan, second by Stutsman, to approve reclassifying the Secretary II support staff position to a Child Support Recovery Officer position at Child Support Recovery Unit.

 

      Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign an Application For Fireworks Permit for Michael L. Burgert, 3921 Spring Street N.E., Solon, on July 4, 2009.

 

      Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign an Application For Fireworks Permit for Tim Spivey, 3581 Half Moon Avenue, S.W., Tiffin, July 18, 2009, rain date July 19, 2009.
