MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JULY 23, 2009

 

      Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Larry Meyers, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Sullivan, second by Meyers, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Stutsman, second by Sullivan, to approve the minutes of the formal meeting of July 16, 2009. 

 

      Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Meyers, to approve and authorize the Chairperson to sign: a New Application for a Class B Beer Permit, Application for Outdoor Service Area, and Application for Sunday Sales Privilege for St. Peter Church, Cosgrove, as submitted by John H. Ruth.

 

      Motion by Sullivan, second by Stutsman, to accept the Recorder’s Report of Fees Collected for the month of June 2009, in the amount of $324,557.23, as submitted by County Recorder Kim Painter.

 

      Reconvened Public Hearing of July 9, 2009 on First and Second consideration of the following Zoning Application at 9:04 a.m.

 

      Zoning Application 15599 of Richard Wonick requesting rezoning of 39.92 acres from A-Agricultural to R-Residential of certain property described as being in the SE 1/4 of the SE 1/4 of Section 24 Township 80 North, Range 6 West and the NE 1/4 of the NE 1/4 and the SE 1/4 of the NE 1/4 of Section 25 Township 80 North, Range 6 West and the NW 1/4 of the NW 1/4 and the SW 1/4 of the NW 1/4 of Section 30 Township 80 North Range 5 West of the 5th P.M. in Johnson County, Iowa. This property is located on the east side of Wonick Road NE approximately at its southern intersection with Highway 1 NE in Newport Township.

 

      Planning and Zoning Assistant Administrator R.J. Moore said the applicant requested another two-week deferral.  Stutsman said she is willing to defer one more time but not indefinitely; this may be the last time.  Moore said he will communicate that to the applicant.  No one from the public spoke. 

 

      Public Hearing closed at 9:05 a.m.

 

      Motion by Stutsman, second by Harney, to defer Application 15599 to August 6, 2009 and continue the public hearing.  Roll call: aye: Harney, Stutsman, Sullivan, Neuzil, Meyers.

 

      Final consideration of Amendment to the Johnson County Local Amendments to the 2008 National Electrical Code, Including Annex H, amending section 80.18 to add reference to unclassified persons.

 

Ordinance 07-23-09-Z1

AN ORDINANCE AMENDING THE JOHNSON COUNTY BUILDING CODE BY AMENDING JOHNSON COUNTY’S LOCAL AMENDMENTS

TO THE 2008 NATIONAL ELECTRICAL CODE

 

BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF JOHNSON COUNTY, IOWA:

 

SECTION I.  PURPOSE.  The purpose of this ordinance is to further the stated purpose of the Johnson County Building Code by amending Johnson County’s Local Amendments to the 2008 National Electrical Code to include appropriate reference to “Unclassified Persons” as defined by Iowa Administrative Code Section 661—551.2.

 

SECTION II.  AMENDMENTS.  The local amendments to the 2008 National Electrical Code are hereby amended by deleting Paragraph (G) of the same in its entirety and replacing it with the following:

 

G.  Sec. 80.18: Add new Section 80.18 as follows.

 

80.18 Licenses.

 

(A) Master Electrician.  No person shall plan for, layout, or supervise electrical work, with or without compensation, unless the person holds:

(1) A master electrician’s Class A license issued by the State of Iowa, or

(2) A master electrician’s Class B license issued by the State of Iowa and has performed permitted electrical work in Johnson County after December 1, 2000.

 

(B) Journeyman Electrician.  No person shall work as a journeyman electrician, unless the person holds:

(1) A journeyman electrician’s Class A license issued by the State of Iowa, or

(2) A journeyman electrician’s Class B license issued by the State of Iowa and has performed permitted electrical work in Johnson County after December 1, 2000.

 

(C) Permitting Work by Unlicensed Individuals.  No person shall knowingly employ or permit an unlicensed person to perform electrical work within Johnson County if the work is required by this code to be performed by a licensed electrician.

 

(D) Licensed Electrician to be On-Site.  There shall be a properly licensed electrician present at all locations and at all times where electrical work is being performed.  At least one licensed electrician shall be present for every three apprentices, unclassified persons, or laborers.  Such licensed electrician must be an employee of the Permit Holder.

 

(E) Licenses.  Licenses shall be secured, renewed, revoked, reissued, etc., pursuant to Chapter 661—502 of the Iowa Administrative Code.

 

SECTION III.  REPEALER.  All other ordinances or parts of ordinances in conflict with the provi­sions of this ordinance are hereby repealed.

 

SECTION IV.  SEVERABILITY.  If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

 

SECTION V.  EFFECTIVE DATE.  This ordinance shall become effective after its passage and publication as part of the proceedings of the Board of Supervisors.

 

      On July 16, 2009, motion by Harney, second by Sullivan, to waive the requirement of three considerations before amending an ordinance and to approve the amendment to the Johnson County Local Amendments to the 2008 National Electrical Code, Including Annex H, on first and second consideration. Roll call: aye: Harney, Stutsman, Sullivan, Neuzil, Meyers.

 

      Motion by Sullivan, second by Meyers, to approve Ordinance 07-23-09-Z1 on final consideration.  Roll call: aye: Harney, Stutsman, Sullivan, Neuzil, Meyers.

 

      Motion by Stutsman, second by Sullivan, to approve Johnson County's hiring policy and procedure.

 

RESOLUTION 07-23-09-B1

LOAN AND TRANSFER FROM THE CAPITAL PROJECTS FUND TO THE CONSERVATION BOND FUND IN THE FY10 BUDGET

 

      Whereas, budgeted expenditures in the Conservation Bond Fund are intended for property acquisitions and other such activity as defined in the referendum; and

 

      Whereas, bond proceeds for the Conservation Bond Fund have yet to be received, and such purchases are being made before receiving these proceeds; and

 

      Whereas, there is sufficient cash in the Capital Projects Fund to temporarily loan to the Conservation Bond Fund; and

 

      Whereas, the inter-fund loan will be repaid by the Conservation Bond Fund when the bond proceeds are received;

 

      Therefore be it resolved that: 1) up to $1,000,000 be loaned from the Capital Projects Fund to the Conservation Bond Fund during fiscal year 2010, and 2) the Johnson County Auditor be authorized to transfer up to $1,000,000 to the Conservation Bond Fund from the Capital Projects Fund during fiscal year 2010, and 3) the Johnson County Auditor be authorized to transfer the repayment of the inter-fund loan when the bond proceeds become available.

 

      Motion by Sullivan, second by Meyers, to approve Resolution 07-23-09-B1.

 

      Motion by Stutsman, second by Sullivan, to approve and authorize the Auditor to sign a contract with Anderson, Larkin & Company P.C. for audit services not to exceed the amount of $30,000 for services provided in Fiscal Year 2010, $30,500 for services provided in Fiscal Year 2011, and $31,000 for services provided in Fiscal Year 2012, with an option to extend the contract not to exceed the amount of $31,500 for services provided in Fiscal Year 2013 and $32,000 for services provided in Fiscal Year 2014, except as specifically agreed to by Johnson County, Iowa and the CPA.

 

      Motion by Harney, second by Stutsman, to approve and authorize the Chairperson to sign an application to the Iowa Department of Economic Development for Community Development Block Grant (CDBG) Property Acquisition/Demolition of seven additional houses in unincorporated Johnson County in the amount of $1,154,201. 

 

      Motion by Sullivan, second by Meyers, to reappoint Dr. Lowell Luhman and Dion Williams, and to appoint Stephanie Van Housen, Keri Neblett, and Steve Noack to the Mental Health/Disability Services Planning Council for a term ending June 30, 2012. 

 

      Motion by Stutsman, second by Sullivan, to approve the FY10 proposed rates for fees for services provided to County clients by University of Iowa Hospitals and Clinics and Carver College of Medicine University of Iowa Physicians.

 

      Motion by Harney, second by Sullivan, to approve and authorize the Chairperson to sign a Road Maintenance Agreement as part of Conditional Use Permit #15489 with Cedar Ridge Winery and Distillery.

 

      Motion by Stutsman, second by Sullivan, to approve changing the classification of a Technician II position to a Technician I position for Secondary Roads.

 

      Motion by Meyers, second by Sullivan, to approve and authorize the Chairperson to sign an agreement for use of public right-of-way of White Oak Avenue NE North of 130th Street NE on Sunday, September 6, 2009 from 10:00 a.m. to 7:00 p.m. for the purpose of the Sutliff Bridge event and fundraiser.
