MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

OCTOBER 15, 2009

 

      Chairperson Neuzil called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Building at 9:05 a.m.  Members present were: Pat Harney, Terrence Neuzil, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Sullivan, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Stutsman, to approve the minutes of the October 8, 2009 canvass of votes for the Iowa City Primary Election and the October 8, 2009 formal meeting. 

 

      Motion by Harney, second by Sullivan, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Zoning Application 15973

AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM R-RESIDENTIAL TO A-AGRICULTURAL AND FROM A-AGRICULTURAL TO R5-RESIDENTIAL

 

SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described in Section II hereof from R-Residential to A-Agricultural(two 1.99 acre parcels) and from A-Agricultural to R5-Residential(9.96 acres).

 

SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Jefferson Township and comprised of approximately 3.98 acres to wit:

 

COMMENCING AT THE SOUTHEAST CORNER OF THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 12, TOWNSHIP 81 NORTH, RANGE 7 WEST OF THE 5TH P.M.; THENCE S90°W ALONG THE SOUTH LINE OF SAID NORTHEAST QUARTER, 821 FEET TO THE EASTERLY RIGHT-OF-WAY LINE OF HICKORY HOLLOW ROAD NE; THENCE N01°W ALONG SAID RIGHT-OF-WAY LINE 204 FEET TO THE POINT OF BEGINNING; THENCE CONTINUING N01°W ALONG SAID RIGHT-OF-WAY LINE, 203 FEET; THENCE N90°E, 426 FEET; THENCE S01°E, 203 FEET; THENCE S90°W 426 FEET TO THE SAID POINT OF BEGINNING.  SAID PARCEL OF LAND CONTAINS 1.99 ACRES.

is hereby changed from A-Agricultural to R5-Residential,

 

SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.I of the Johnson County Unified Development Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

 

SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

 

SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

 

      On October 8, 2009, motion by Harney, second by Stutsman, to waive the requirement of three considerations before amending an ordinance and to approve Rezoning Application 15973 on first and second consideration.  Roll call: aye: Harney, Stutsman, Neuzil, Sullivan.

 

      Motion by Harney, second by Sullivan, to approve Application 15973 on final consideration and to approve Ordinance 10-15-09-Z1.  Roll call: aye: Harney, Stutsman, Neuzil, Sullivan.

 

RESOLUTION 10-15-09-Z2

 

      Whereas the Johnson County Planning and Zoning Commission, following a public hearing on October 12, 2009, files its report and recommendations for certain actions;

 

      Now, Therefore, be it Resolved as follows:

 

      A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 12th day of November, 2009 at 5:30 p.m. in Room 203B and 203C, Johnson County Health & Human Services Building, 855 South Dubuque Street, Iowa City, Iowa, on the following subdivision applications: Plotz(15340), Stark(15967), Cole Family Farms(15969), Burns(15971), Southwick(16008), and zoning applications: Oakes(16004), and Schmidt(16005).

 

      That the Johnson County Auditor be authorized to publish the official notice of above public hearing.

 

      Motion by Sullivan, second by Harney, to approve Resolution 10-15-09-Z2.

 

      Motion by Stutsman, second by Harney, to authorize Facilities Manager David Kempf to hire Novak Design Group to determine the cost of one justice center facility downtown utilizing the current Courthouse compared to a jail at the Press-Citizen Building and an expanded Courthouse downtown.  Roll call: aye: Harney, Stutsman; nay: Neuzil, Sullivan.

 

      Recessed at 9:23 a.m.; reconvened at 9:24 a.m.

 

      Motion by Stutsman, second by Harney, not to authorize Facilities Manager David Kempf to hire Novak Design Group.  Roll call: aye: Stutsman; nay: Harney, Neuzil, Sullivan.

 

      Motion by Stutsman, second by Sullivan, to approve sending the Iowa River Valley Food Cooperative Consumer Survey to Johnson County employees.

 

      Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign a 28E Construction Project Agreement with the City of Cedar Rapids for ESFM-C052(90)--5S-52, from the 120th Street intersection with Highway 965 (6th Street SW) north to the County Line.
