MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
JANUARY 7, 2010
Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Building at 9:02 a.m. Members present were: Pat Harney, Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Rettig, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Sullivan, second by Rettig, to approve the minutes of the formal meeting of December 31, 2009 and January 4, 2010.
Motion by Harney, second by Sullivan, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Sullivan, to approve and authorize the Chairperson to sign: a New Application for a Class C Liquor License, Application for Outdoor Service Area, and Application for Sunday Sales Privilege for Cedar Ridge Vineyards LLC, Swisher, as submitted by Jeff Quint.
RESOLUTION SETTING FORTH AND SETTING PUBLIC HEARING ON PROPOSAL TO SELL AND REMOVE A MODULAR HOME LOCATED AT 3196 HALF MOON AVENUE NW, TIFFIN, IOWA
Whereas, the Johnson County Conservation Board (hereinafter "Conservation Board") has acquired property at 3196 Half Moon Avenue NW, Tiffin, Iowa, and
Whereas, the acquired property had a modular home situated on it which the Johnson County Conservation Board is not interested in using or maintaining, and
Whereas, the Conservation Board has requested Johnson County, Iowa dispose of the modular home by offering it for sale with removal by purchaser through a sealed bid process to help prepare the land for future use, and
Whereas, offering the modular home for sale though sealed bids will be the best method to dispose of the building; and
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa that disposing of the modular home on the property acquired by the Johnson County Conservation Board at 3196 Half Moon Ave. NW, Tiffin, Iowa is deemed necessary, and the Proposal for doing so is set forth in the document attached as Exhibit A; and
Be It Further Resolved that the Board of Supervisors proposes to offer the buildings for sale by sealed bids due by 10 A.M., local time, on the 5th day of February, 2010, and
Be It Further Resolved that in accordance with Iowa Code section 331.361 a public hearing on said proposed plan for the sale and removal the modular home by sealed bid is set for the 22nd day of January, 2010 at 9:00 a.m. in the Johnson County Health and Human Services Building, Room 203 B/C, 855 South Dubuque Street, Iowa City, Iowa. The Johnson County Auditor is directed to publish notice of the hearing.
Exhibit A
Proposed Plan and Bidding Procedures For Sale And Disposal Of Modular Home Located At 3196 Half Moon Avenue NW, TIFFIN, IOWA
1. Subject of Bid: Any bids made in connection to Johnson County Resolution No. 01-07-10-01 shall be for the purchase of a single story manufactured ranch style Modular Home located at 3196 Half Moon Avenue, N.W., Tiffin, Iowa, and the bidder's removal of the same from the property. By submitting a bid, the bidder acknowledges that such a bid is for the purchase and removal of the modular home.
2. Where to Submit Bid: Bids for purchase and removal of the Modular Home located at 3196 Half Moon Avenue, N.W., Tiffin, Iowa shall be submitted at the office of the Johnson County Auditor, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa.
3. Property Information: Obtaining further details on the modular home or an appointment to view the modular home may be coordinated through the Director of the Johnson County Conservation Commission.
4. Deadline for Bids: Bids shall be submitted by 10 A.M., local time, on the 5th day of February, 2010. All bids received after the deadlines for submission of bids shall be returned to the late bidder unopened.
5. Submission Form and Acceptance: Bids shall be submitted in a sealed opaque envelope marked, "Half Moon Avenue Modular Home Sale and Disposal Bid" with the name of the bidder. The date and time that each bid is received shall be recorded by the government entity on the envelope containing the bid.
6. Removal. The modular home and all scrap from said modular home shall be removed within 60 days of the purchase being awarded.
7. Purchase Awarded: The modular home located at 3196 Half Moon Avenue, N.W., Tiffin, Iowa shall be awarded after consideration of bids. The Board reserves the right to reject or accept any and all bids.
Motion by Neuzil, second by Harney, to approve Resolution 01-07-10-01.
Motion by Sullivan, second by Rettig, to approve and authorize the Chairperson to sign the 2008 Polling Place Accessibility Grant Agreements 052-08-001 ($2,080.88) and 052-08-002 ($2,500.00) between Johnson County and the Iowa Secretary of State to support accessibility improvement to the Swisher American Legion and Tiffin Fire Station polling places.
Recessed to Informal Meeting at 9:09 a.m.; reconvened at 9:40 a.m.
Motion by Neuzil, second by Sullivan, to enter Executive Session at 9:44 a.m. to discuss collective bargaining strategy for the Sheriff's Office under section 20.17(3), Code of Iowa: “negotiating sessions, strategy meetings of public employees… shall be exempt from the provisions of chapter 21 (Official Meetings Open to the Public).” Roll call: aye: Harney, Neuzil, Stutsman, Sullivan, Rettig.
Motion by Neuzil, second by Harney, to leave Executive Session at 9:55 a.m. Roll call: aye: Harney, Neuzil, Stutsman, Sullivan, Rettig.
Motion by Sullivan, second by Neuzil, to approve and authorize the Chairperson to sign the collective bargaining agreement for the Sheriff's Office.
