MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 22, 2010

 

      Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Building at 9:00 a.m.  Members present were: Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan; absent: Pat Harney.

 

      Unless otherwise noted, all actions were taken by the following vote: Roll call: aye: Neuzil, Stutsman, Sullivan, Rettig; absent: Harney.

 

      Motion by Sullivan, second by Rettig, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Neuzil, second by Sullivan, to approve the minutes of the formal meeting of January 14, 2010. 

 

      Motion by Sullivan, second by Rettig, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Convened Public Hearing on Proposal to Sell and Remove a Modular Home Located at 3196 Half Moon Avenue NW, Tiffin, Iowa at 9:01 a.m.

 

      County Attorney Janet Lyness said the Conservation Board acquired property to build a trail and on it is a modular home.  This home is not needed by the Conservation Board so they have recommended offering it for sale to the highest bidder.  Lyness said the Board has approved the proposal for this action and bids are due on February 5, 2010.  Conservation Director Harry Graves said the Conservation staff will raze the building and salvage any parts if no bids are received. 

 

      No one from the public spoke.

RESOLUTION 01-22-10-01

RESOLUTION TO SELL AND REMOVE A MODULAR HOME LOCATED AT 3196 HALF MOON AVENUE NW, TIFFIN, IOWA

 

      Whereas, the Johnson County Conservation Board has acquired property at 3196 Half Moon Avenue, NW, Tiffin, Iowa, and

 

      Whereas, the acquired property has a modular home located on it which the Johnson County Conservation Board is not interested in using or maintaining, and

 

      Whereas, the Johnson County Conservation Board has requested that Johnson County, Iowa dispose of the modular home by offering it for sale with removal by purchaser through a sealed bid process to help prepare the land for future use, and

 

      Whereas, offering the modular home through sealed bids will be the best method to dispose of the modular home, and

 

      Whereas, a notice and hearing have been provided in accordance with Iowa Code section 331.361,

 

      Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, that disposing of the modular home on property acquired by the Johnson County Conservation Board at 3196 Half Moon Avenue NW, Tiffin, Iowa is deemed necessary,

 

      Be It Further Resolved that the plans for selling the modular home are available at the County Auditor's Office at 913 S. Dubuque Street, Iowa City, Iowa.

 

      Be It Further Resolved that the Board of Supervisors approved the plan and bidding procedures attached as Exhibit A following a public hearing held in accordance with Iowa Code section 331.361, the Board of Supervisors will offer the modular home for sale and removal by sealed bids due 10 A.M., local time, on the 5th day of February, 2010, in the office of the Johnson County Auditor, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa according to the attached plan and bidding procedures which shall be available at the County Auditor's Office or at the Johnson County Conservation Board Office located at Kent Park.  The Johnson County Auditor is directed to publish notice of this bid letting. 

 

      Motion by Rettig, second by Sullivan, to approve Resolution 01-22-10-01.

 

      Rezoning Application 15912 of BP Products North America, Inc. signed by Brad Krabel requesting rezoning of 5.27 acres from R-Residential to MH-Heavy Industrial of certain property described as being in the W 1/2 of the NW 1/4 of Section 35, Township 81 North, Range 7 West of the 5th P.M. in Johnson County, Iowa.  This property is located on the east side of Highway 965 NE approximately 3200 feet north of its intersection with Swan Lake Road NE in Madison Township.

AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM R-RESIDENTIAL TO MH-HEAVY INDUSTRIAL

 

SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described in Section II hereof from R-Residential to MH-Heavy Industrial.

 

SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Madison Township and comprised of approximately 5.27 acres to wit:

 

A TRACT OF LAND CONTAINING 5.27 ACRES, MORE OR LESS, LOCATED IN THE WEST HALF OF THE NORTHWEST QUARTER OF SECTION 35, TOWNSHIP 81 NORTH, RANGE 7 WEST OF THE FIFTH PRINCIPAL MERIDIAN IN JOHNSON COUNTY, IOWA, DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

is hereby changed from R-Residential to MH-Heavy Industrial.

 

SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.I of the Johnson County Unified Development Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

 

SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitu­tional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

 

SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

 

      On January 14, 2010, motion by Sullivan, second by Rettig, to waive the requirement of three considerations before amending an ordinance and to approve Application 15912 on first and second consideration.  Roll call: aye: Harney, Neuzil, Stutsman, Sullivan, Rettig.

 

      Motion by Sullivan, second by Rettig, to approve Zoning Application 15912 on final consideration and to approve Ordinance 01-22-10-Z1.  Roll call: aye: Neuzil, Stutsman, Sullivan, Rettig; absent: Harney.

 

      Motion by Neuzil, second by Sullivan, to approve and authorize the Chairperson to sign the amendment to the 28E Project Agreement with the City of Coralville for Engineering Design and Construction Management for Improvements on Oakdale Boulevard Extension. 

 

      Motion by Sullivan, second by Neuzil, to approve a recommendation from the Criminal Justice Coordinating Committee to hire Novak Design Group for the purpose of preparing a space needs analysis for offices and departments that would be contained within a justice center or renovated Jail and/or Courthouse space at a cost not to exceed $15,000.

 

      Recessed to Informal Meeting at 9:11 a.m.; reconvened at 9:52 a.m.

 

      Motion by Sullivan, second by Neuzil, to approve and authorize the Chairperson to sign the collective bargaining tentative agreement with the American Federation of State, County and Municipal Employees (AFSCME) Local 183 for the SEATS Unit.
