MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
FEBRUARY 11, 2010
Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 6:30 p.m. Members present were: Pat Harney, Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Sullivan, second by Rettig, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Neuzil, second by Sullivan, to approve the minutes of the formal meeting of February 4, 2010.
Motion by Harney, second by Sullivan, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Harney, second by Neuzil, to accept and place on file the Treasurer’s Semi-annual Settlement of the Board of Supervisors for the period beginning July 1, 2009 and ending December 31, 2009, as submitted by County Treasurer Tom Kriz.
Motion by Sullivan, second by Rettig, to place on file the Clerk’s Report of Fees Collected for the month of January, 2010, in the amount of $12,185.84, as submitted by Clerk of District Court Lodema Berkley.
Convened Public Hearing on the following Platting Application at 6:33 p.m.
Subdivision Application 16105 of Martin and Mary Gaffey requesting preliminary and final plat approval of Fairview Fields Subdivision, a subdivision described as being located in the W 1/2 of Section 34, Township 80 North, Range 5 West of the 5th P.M. in Johnson County, Iowa. This is a 1 Lot, 5.00 acre farmstead split located on the north side of Fairview Cemetery Road NE approximately 1500 feet east of its intersection with Wapsi Avenue NE in Graham Township.
No one from the public spoke.
RESOLUTION 02-11-10-Z1
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF FAIRVIEW FIELDS SUBDIVISION
Whereas, the owner has filed application 16105 for approval of a preliminary and final plat of Fairview Fields Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be it Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Subdividers Agreement, Title Opinion, Certificate of County Auditor, Certificate of Treasurer, Consent to Platting by Mortgage Holder, Covenant for Fences, Certificate of Owner and Spouse, Resolution Affirming the Stability of the Current Road System; B. Subdivision Plat (5).
Motion by Sullivan, second by Harney, to approve Resolution 02-11-10-Z1.

RESOLUTION 02-11-10-Z2
Whereas the Johnson County Planning and Zoning Commission, following a public hearing on February 8, 2010, filed its report and recommendations for certain actions;
Now, Therefore, Be It Resolved as follows:
1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for March 11, 2010 at 5:30 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following subdivision application: Dean Oakes (16159) and the following amendments to the Johnson County Unified Development Ordinance: An amendment to address the placement of roadside stands. An amendment allowing public garages, mini storage, and warehousing as a permitted use in class CH-Highway Commercial Districts and allowing public garages as permitted uses in class C-Commercial Districts. An amendment to allow asphalt and ready mix plants and asphalt and concrete recycling plants as a temporary conditional use in C-Commercial, CH-Highway Commercial, C-AG Agribusiness, A-Agricultural, ML-Light Industrial, and MH-Heavy Industrial Districts. An amendment to fix errors in conditional use land classifications and allowing approved auxiliary dwelling units in A-Agricultural, AR-Agricultural Residential and R-Residential Districts. An amendment amending the Conditional Use Permit regulations to include new uses and fix typographical errors. An amendment to define the terms Major Subdivision and Minor Subdivision, and to address final plat required improvements. An amendment to define the term “outlot”. An amendment to add a RC-Rural Cluster Zoning District. An amendment addressing farmstead splits on dirt roads. An amendment amending the zoning regulations for newly platted lots.
2. That the Johnson County Auditor be authorized to publish the official notice of above public hearing.
Motion by Harney, second by Sullivan, to approve Resolution 02-11-10-Z2.
Motion by Neuzil, second by Sullivan, to approve and authorize the Chairperson to sign a contract with the State Department of Human Services for Decat funding for $14,950 to support the Transitioning Youth Initiative and efforts of the Community Partnership to Protect Children Program.
Motion by Sullivan, second by Rettig, to approve and authorize the Chairperson to sign an amendment to the current Decat Contract # DCAT 7-09-142 to add $4,950 to assist “Club Kazi: Black Americans Concerned About Black Children in Foster Care in Iowa” in their efforts to assist the Iowa Department of Human Services to respond to disproportionality in the child welfare system.
Motion by Sullivan, second by Rettig, to approve and authorize the Chairperson to sign the Iowa Department of Human Services Community Mental Health Center Affiliation for FY11.
Motion by Harney, second by Sullivan, to approve and authorize the Chairperson to sign a contract with Magellan Health Services to obtain reimbursement for Targeted Case Management services.
Motion by Neuzil, second by Sullivan, to approve and authorize Mental Health/Disability Services to hire a Targeted Case Manager.
Motion by Neuzil, second by Rettig, to approve and authorize Mental Health/Disability Services to purchase computer upgrades.
Motion by Neuzil, second by Sullivan, to deny the requests to waive late fees, penalties, and interest charges submitted by:
1. Aaron Dunkin
2. Cosette and Louis Scallon
3. Ryan Foulkes
4. Leslie Bohlen
5. Jim and Bev Worrell
Motion by Rettig, second by Sullivan, to set a public hearing on the Johnson County budget estimate for FY 2011 on Wednesday, March 3, 2010 at 6:00 p.m. and authorize the Auditor’s Office to publish the budget hearing notice.
Motion by Sullivan, second by Neuzil, to approve and authorize the Chairperson to sign the collective bargaining tentative agreement with the American Federation of State, County and Municipal Employees (AFSCME) Local 183 for the Ambulance Unit.
