MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

FEBRUARY 18, 2010

 

      Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

PROCLAMATION 02-18-10-01

JOHNSON COUNTY LEAGUE OF WOMEN VOTERS 90TH ANNIVERSARY LEAGUE PROCLAMATION

 

      Whereas,  the League of Women Voters of Johnson County is the organization where hands-on work to safeguard democracy leads to civic improvement; and

 

      Whereas,  the League of Women Voters is a nonpartisan political organization, that has fought since 1920 to improve our system of government and impact public policies through citizen education and advocacy; and

 

      Whereas,  League members are constantly striving to serve their communities to make strong, safe, fair and vibrant places to live; and

 

      Whereas,  the League of Women Voters of Johnson County believes in representative government and in the individual liberties established in the Constitution of the United States; and

 

      Whereas,  the League of Women Voters of Johnson County has always worked to promote the values and processes of representative government; and

 

      Whereas,  the League of Women Voters of Johnson County collaborates with other organizations to achieve mutual goals, increase civic participation, create lasting change in the community and to make democracy work; and

 

      Whereas,  the League, for 90 years, has held the public trust by respectfully bringing elected leaders and the public together through non-partisan, civil means and through thoughtfully advancing solutions; and

 

      Whereas,  Johnson County has benefited tremendously from the countless volunteer hours donated by League members over its 90 year history of enhancing our democracy

 

      Now, Therefore, I, Sally Stutsman, Chairperson of the Johnson County Board of Supervisors, state of Iowa, do hereby proclaim the month of February, 2010, as “League of Women Voters Making Democracy Work Month” in honor of the League of Women Voters 90th Anniversary and urge all residents of Johnson County, Iowa, to pay great tribute and respect to the League of Women Voters for all they do to make our community healthy, vibrant and strong.

 

      Motion by Rettig, second by Sullivan, to approve Proclamation 02-18-10-01.

 

      Motion by Sullivan, second by Rettig, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Neuzil, second by Sullivan, to approve the minutes of the formal meeting of February 11, 2010. 

 

      Motion by Harney, second by Rettig, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Neuzil, to approve and authorize the Chairperson to sign: a Renewal Application for a Class C Liquor License, Application for Outdoor Service Area, and Application for Sunday Sales Privilege for Pleasant Valley Golf Course, Iowa City, as submitted by Aleda Feuerbach.

 

      Motion by Harney, second by Sullivan, to approve and authorize the Chairperson to sign: a Renewal Application for a Class B Beer Permit, for Morse Community Club, Inc., Tipton, as submitted by David Smith.

 

      Motion by Neuzil, second by Sullivan, to approve and authorize the Chairperson to sign a cooperative agreement with the Iowa Department of Transportation to provide Johnson County access to fiber optic cable installed by the Department of Transportation for use by Johnson County entities, including the Sheriff’s Office, Emergency Management, and Secondary Roads Department.

 

RESOLUTION 02-18-10-01

RESOLUTION TO FIX A DATE FOR PUBLIC HEARINGS ON GENERAL OBLIGATION LOAN AGREEMENTS

 

      Whereas, Sections 331.402 and 331.441 of the Code of Iowa authorize counties to enter into loan agreements and borrow money for the purpose of paying the cost of capital projects for the construction, reconstruction, improvement, repair or equipping of bridges, roads and culverts if such capital projects assist in economic development which creates jobs and wealth, and such Sections also authorize counties to enter into loan agreements and borrow money for the purpose of acquiring sites for and constructing county buildings; and

 

      Whereas, the Board of Supervisors (the “Board”) of Johnson County, Iowa (the “County”), is considering entering into an agreement with the City of Shueyville to share the cost of the reconstruction of a portion of 120th Street (the “120th Street Project”); and the Board proposes to enter into a loan agreement (the “County Road Improvements Loan Agreement”) in a principal amount not to exceed $2,300,000 pursuant to the provisions of Sections 331.402 and 331.441 of the Code of Iowa, for the purpose of paying the cost, to that extent, of the 120th Street Project; and

 

      Whereas, the Board also proposes to enter into a loan agreement (the “County Jail Project Loan Agreement”) in a principal amount not to exceed $1,200,000, pursuant to the provisions of Sections 331.402 and 331.441 of the Code of Iowa, for the purpose of paying the cost, to that extent, of acquiring land suitable for the site of a new county jail; and

 

      Whereas, the Board also proposes to enter into a loan agreement (the “County Ambulance Facility Loan Agreement”) in a principal amount not to exceed $600,000, pursuant to the provisions of Sections 331.402 and 331.441 of the Code of Iowa, for the purpose of paying the cost, to that extent, of constructing a new county ambulance facility; and

 

      Whereas, it is necessary to fix a date of meeting of the Board at which it is proposed to take action to enter into the County Road Improvements Loan Agreement, the County Jail Project Loan Agreement and the County Ambulance Facility Loan Agreement (together, the “Loan Agreements”) and to give notice thereof;

 

      Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, as follows:

 

      Section 1.  This Board shall meet on the 11th day of March, 2010, at the Johnson County Administration Building, Iowa City, Iowa, at 5:30 o’clock p.m., at which time and place hearings will be held and proceedings will be instituted and action taken to enter into the Loan Agreements.

 

      Section 2.  The County Auditor is hereby directed to give notice of the proposed action on each of the Loan Agreements, setting forth the amount and purpose thereof, the time when and place where the said meeting will be held, by publication at least once and not less than 4 nor more than 20 days before the meeting, in a legal newspaper of general circulation in the County.

 

      Section 3.  The notices shall be substantially as follows:

 

NOTICE OF PROPOSED ACTION TO INSTITUTE PROCEEDINGS TO ENTER INTO A LOAN AGREEMENT IN A PRINCIPAL AMOUNT NOT TO EXCEED $2,300,000

(GENERAL OBLIGATION COUNTY ROAD IMPROVEMENTS)

 

      The Board of Supervisors of Johnson County, Iowa, will meet on the 11th day of March, 2010, at the Johnson County Administration Building, Iowa City, Iowa, at 5:30 o’clock p.m. for the purpose of instituting proceedings and taking action to enter into a loan agreement (the “County Road Improvements Loan Agreement”) in a principal amount not to exceed $2,300,000 for the purpose of paying the cost, to that extent, of constructing an improvement to a county road that will assist in economic development which creates jobs and wealth, by reconstructing a portion of 120th Street in and adjacent to the City of Shueyville.

 

      The County Road Improvements Loan Agreement is proposed to be entered into pursuant to authority contained in Sections 331.402 and 331.441 of the Code of Iowa and will constitute a general obligation of the County.

 

      At that time and place, oral or written objections may be filed or made to the proposal to enter into the County Road Improvements Loan Agreement.  After receiving objections, the Board of Supervisors may determine to enter into the County Road Improvements Loan Agreement, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter.

      The County Jail Project Loan Agreement is proposed to be entered into pursuant to authority contained in Sections 331.402 and 331.441 of the Code of Iowa and will constitute a general obligation of the County.

      The County Ambulance Facility Loan Agreement is proposed to be entered into pursuant to authority contained in Sections 331.402 and 331.441 of the Code of Iowa and will constitute a general obligation of the County.

      Section 4.  All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict.

 

      Motion by Sullivan, second by Neuzil, to approve Resolution 02-18-10-01.

 

      Motion by Harney, second by Rettig, to approve and authorize the Chairperson to sign letters of support for grant funds for the Park Road Bridge Replacement and the Dubuque Street Elevation Project in Iowa City.

 

      Motion by Rettig, second by Sullivan, to approve and authorize the Chairperson to sign letters of support for grant funds for the First Avenue-Iowa Interstate Railroad Grade Separation Project.

 

      Motion by Sullivan, second by Rettig, to approve and authorize the Chairperson to sign letters of support for grant funds for the Iowa City Fire Department Training Center Relocation Project.
