MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
AUGUST 5, 2010
Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.
Motion by Rettig, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Sullivan, second by Rettig, to approve the minutes of the formal meeting of July 29, 2010.
Motion by Harney, second by Sullivan, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
RESOLUTION 08-05-10-01
RESOLUTION SETTING PUBLIC HEARING ON PROPOSED PLANS, SPECIFICATIONS, FORM OF CONTRACT, ESTIMATED TOTAL COST AND REQUESTING BIDS FOR SITE IMPROVEMENTS TO 925 SOUTH DUBUQUE STREET, IOWA CITY, IOWA (FORMER ARMORY PROPERTY)
Be It Resolved By The Johnson County Board Of Supervisors that site improvements to 925 South Dubuque Street, Iowa City, Iowa (the former Armory property) are deemed necessary; and
Be It Further Resolved that the plans, specifications, form of contract and estimated total cost prepared at the request of the Board of Supervisors by Neumann Monson Architects, are set forth as the proposed plans, specifications, form of contract, and estimated total cost in connection with said public improvement, to-wit: site improvements to 925 South Dubuque Street, Iowa City, Iowa (the former Armory property).
Be It Further Resolved that said plans, specifications, form of contract, and estimated total cost are available for inspection in the office of the Johnson County Auditor, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa; and
Be It Further Resolved that, in accordance with Sections 26.12 and 331.341 of the 2007 Code of Iowa, as amended, a public hearing on said proposed plans, specifications, form of contract, and estimated total cost of the public improvement is set for the 19th day of August, 2010, at 9:00 A.M., Central Time in the Johnson County Board of Supervisors Boardroom, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa. The Johnson County Auditor is directed to publish notice of the hearing in accordance with the law.
Motion by Neuzil, second by Sullivan, to approve Resolution 08-05-10-01.
RESOLUTION 08-05-10-02
RESOLUTION AWARDING AND AUTHORIZING EXECUTION OF CONTRACT ADMINISTRATIVE OFFICE BUILDING – WINDOW REPLACEMENT PROJECT
Whereas, on the 8TH day of July, 2010, after notice as required by law, a public hearing was conducted concerning the proposed plans, specifications and form of contract for, and the estimated cost of, the Administrative Office Building – Window Replacement Project; and
Whereas, after said public hearing and hearing all the evidence presented, and on that date the Johnson County Board of Supervisors gave due consideration to and adopted a resolution approving said proposed plans, specifications, form of contract for, and the estimated cost of, said construction, and providing that sealed bids for the Administrative Office Building – Window Replacement Project be solicited for receipt by the Johnson County Auditor no later than 1:00 P.M. Central Time, August 3rd, 2010, Notice to bidders being published pursuant to the Iowa Code; and
Whereas, at said time and place the bids were opened and the amounts of all bids announced and it was determined that the lowest responsive, responsible bidder, determined pursuant to Iowa Code §§ 26.9-.10, was Todd Hackett Construction Company of Muscatine, Iowa, and said bid was for $274,000.00.
Now, Therefore, Be It Resolved that Todd Hackett Construction Company of Muscatine, Iowa was the lowest responsive, responsible bidder for the proposed project, and that the bid amount is $274,000.00 for the Administrative Office Building – Window Replacement Project as shown in the plans previously adopted by the Board;
Be It Further Resolved that the Board hereby awards the contract for the Administrative Office Building – Window Replacement Project, as shown in the plans previously adopted by the Board to Todd Hackett Construction Company of Muscatine, Iowa, and authorizes the Chairperson to sign any documents, including the previously approved form of contract, necessary to effectuate said award of contract in such manner as is consistent with Iowa law.
Motion by Neuzil, second by Rettig, to approve Resolution 08-05-10-02.
Motion by Rettig, second by Sullivan, to approve and authorize the Chairperson to sign an agreement for the use of public right-of-way of White Oak Avenue NE North of 130th Street NE on Sunday, September 5, 2010 from 10:00 a.m. to 7:00 p.m. for the purpose of the Sutliff Bridge authority fundraiser.
RESOLUTION 08-05-10-03
A RESOLUTION TO APPROVE AMENDMENT TO CONTRACT WITH WILLIS LAW FIRM AND SECURITY ABSTRACT FOR LEGAL AND CLOSING SERVICES
Whereas, Johnson County has a contract with Willis Law Firm/’Security Abstract for legal and closing services related to the property acquisition program (HMGP); and
Whereas, three CDBG acquisitions need to be amended into these service contracts; and
Whereas, CDBG acquisitions have to include certain language related to federal procurement policy and be included with all procurement contracts and is attached to this resolution.
Now, Therefore Be It Resolved by the Johnson County Board of Supervisors that the contract between Johnson County and Willis Law Firm/Security Abstract is amended by adding three additional home acquisitions and adding the attached clauses to the contract.
Motion by Harney, second by Neuzil, to approve Resolution 08-05-10-03.
RESOLUTION 08-05-10-04
A RESOLUTION TO APPROVE AMENDMENT TO CONTRACT WITH HAWKEYE TITLE SERVICES FOR ABSTRACTING/TITLE SERVICES
Whereas, Johnson County has a contract with Hawkeye Title Company for abstract and title services related to the property acquisition program (HMGP); and
Whereas, three CDBG acquisitions need to be amended into these service contracts; and
Whereas, CDBG acquisitions have to include certain language related to federal procurement policy and be included with all procurement contracts and is attached to this resolution.
Now, Therefore Be It Resolved by the Johnson County Board of Supervisors that the contract between Johnson County and Hawkeye Title Company is amended by adding three additional home acquisitions and adding the attached clauses to the contract.
Motion by Sullivan, second by Rettig, to approve Resolution 08-05-10-04.
Motion by Harney, second by Neuzil, to approve and authorize the Chairperson to sign a letter to the United States Corps of Engineers, urging reevaluation of the regulation plan for the Coralville Lake Reservoir Dam.
Motion by Neuzil, second by Rettig, to approve and authorize the Chairperson to sign a letter to the Joint Emergency Communication Services Association regarding bonding authority and meetings of the Users Advisory Group.
Motion by Harney, second by Sullivan, to approve and authorize the Chairperson to sign a letter to the Iowa Department of Natural Resources regarding Regency Mobile Home Park.
Motion by Sullivan, second by Neuzil, to elect to approve the “Commuting Rule” method effective July 1, 2010 for valuing the fringe benefit of the use of County vehicles by on-call employees with emergency response duties. Roll call: aye: Harney, Neuzil Stutsman, Sullivan; nay: Rettig.
