MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
AUGUST 12, 2010
Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Pat Harney, Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan.
Unless otherwise noted, all actions were taken unanimously.

GET MOVING FOR HEALTHY KIDS DAY
AUGUST 29, 2010
Whereas, there is an increasing concern with overweight children in our state and communities; and
Whereas, some of the source of this alarming trend is a tendency of our youth to be less physically active in favor of more sedentary pursuits; and
Whereas, children may benefit from a program of physical activity and their parents with suggestions for continued activity for them; and
Whereas, Healthy Kids Initiative is raising awareness of physical activity by sponsoring a 5K walk and run, youth mile, and other races and activities at 8:00 a.m. on Sunday, August 29 at the West High School Track; and
Whereas, Healthy Kids Community Care, our system of school-based health care, and its sponsors will help to meet the endowment match from the Community Foundation of Johnson County which provides support for the clinics’ budget; and
Now, Therefore, be it Resolved that we, the Johnson County Board of Supervisors, do hereby proclaim, Sunday, August 29, 2010 as:
Get Moving for Healthy Kids Day
in Johnson County, we encourage our community’s children and their parents to participate in the event at West High School.
Motion by Rettig, second by Neuzil, to approve Proclamation 08-12-10-01.
Motion by Sullivan, second by Rettig, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Sullivan, second by Neuzil, to approve the minutes of the formal meeting of August 5, 2010.
Motion by Harney, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Sullivan, second by Rettig, to place on file the Clerk’s Report of Fees Collected for the month of July, 2010, in the amount of $11,779.75, as submitted by Clerk of District Court Lodema Berkley.
Motion by Sullivan, second by Rettig, to amend the minutes of the July 29, 2010 formal meeting of the Johnson County Board of Supervisors, correcting a scrivener's error in the motion to approve the formal minutes of July 22, 2010, by changing the word “June” to “July”.
Convened Public Hearing on Zoning Applications at 5:38 p.m.
Zoning Application 16276 of Kristi Meyer requesting the rezoning of 1.0 acres from R – Residential to R3 – Residential and 5.46 acres from A – Agricultural to R3 – Residential of certain property described as being in the NW ¼ of the SW ¼ of Section 20, Township 80 North, Range 6 West of the 5th p.m. in Johnson County, Iowa. This property is located on the south side of Johnston Way NE approximately 1700 feet west of its intersection with North Liberty Road NE in Penn Township.
Brian Crawford of McClure Engineering Company and Alan Meyer spoke at length for the application.
Sullivan expressed objections based on unresolved issues, the lack of an agreement between Coralville and North Liberty regarding annexations and a future extension of Forevergreen Road, and a 3 acre density in an area that likely would someday be in one of the cities. Stutsman said this land use was consistent with the surrounding area.
Motion by Neuzil, second by Harney, to waive the requirement of three considerations before amending an ordinance and to approve Zoning Application 16276 on first and second consideration. Roll call: aye: Harney, Neuzil, Stutsman, Rettig; nay: Sullivan.
Zoning Application 16321 of Renee L. Madden, requesting the rezoning of 0.5 acres from CH – Highway Commercial and RUA – Single Family Residential to RUA – Single Family Residential of certain property described as being in the SW ¼ of the NE ¼ of Section 34, Township 79 North, Range 8 West of the 5th p.m. in Johnson County, Iowa. This property is located on the south side of Black Diamond Road SW approximately 1500 feet east of its intersection with Eagle Avenue SW in Hardin Township.
Glen Meisner of MMS Consultants, Inc. spoke for the application.
Motion by Sullivan, second by Rettig, to waive the requirement of three considerations before amending an ordinance and to approve Zoning Application 16321 on first and second consideration. Roll call: aye: Harney, Neuzil, Stutsman, Sullivan, Rettig.

RESOLUTION 08-12-10-Z1
Whereas, the Johnson County Planning and Zoning Commission, following a public hearing, on August 9, 2010, filed its report and recommendations for certain actions;
Now, Therefore, Be It Resolved as follows:
1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for September 9, 2010 at 5:30 p.m. in rooms 203B and 203C, Johnson County Health and Human Services Building, 855 South Dubuque Street, Iowa City, Iowa, on the following subdivision applications: Yvonne M. Holcomb (16352), Kristi A. Meyer (16353), and The Celebration Farm LLC, signed by Thomas Werderitsch (16354).
2. That the Johnson County Auditor be authorized to publish the official notice of above public hearing.
Motion by Harney, second by Sullivan, to approve Resolution 08-12-10-Z1.
Motion by Neuzil, second by Sullivan, to approve the updated job description for Johnson County SEATS Director.
Motion by Harney, second by Rettig, to approve the updated job description for Johnson County SEATS Operation Supervisor.
Motion by Rettig, second by Sullivan, to approve the updated job description for Johnson County Conservation Director.
Motion by Neuzil, second by Sullivan, to approve and authorize the Chairperson to sign a memorandum of agreement between the Multi-State Information Sharing and Analysis Center and Johnson County for federally funded cyber security services.
Motion by Sullivan, second by Rettig, to approve and authorize Andy Johnson to sign updated FEMA project worksheets 10013 and 10016 for debris cleanup of the west approach and east span of the Sutliff Bridge. Roll call: aye: Neuzil, Stutsman, Sullivan, Rettig; nay: Harney.
Motion by Rettig, second by Sullivan, to approve and authorize the Chairperson to sign a letter of support for the Transportation Investment Generating Economic Recovery II (TIGER-II) grant application for funds to extend the Clear Creek Trail from Coralville to Tiffin and Kent Park.
Motion by Sullivan, second by Rettig, to approve and authorize the Chairperson to sign a letter of support for the Transportation Investment Generating Economic Recovery II (TIGER-II) grant application of North Liberty and Coralville for funds to improve the section of Highway 965 from Holiday Road in Coralville, to 230th Street in North Liberty.
Motion by Sullivan, second by Neuzil, to approve the deletion of the longevity pay policy in the employee handbook, effective July 1, 2010. Roll call: aye: Neuzil, Stutsman, Sullivan, Rettig; nay: Harney.
Motion by Harney, second by Rettig, to approve and authorize the Chairperson to sign a Memorandum of Agreement between the Iowa Department of Public Health and Johnson County for a $10,000 grant to provide substance abuse prevention and related services.
