MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 20, 2011

 

      Chairperson Harney called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Stutsman, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Stutsman, to approve the minutes of January 13, 2011 and January 18, 2011 formal meetings and January 18, 2011 canvass of votes for special election to fill a City Council vacancy for the City of University Heights.

 

      Motion by Stutsman, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Rettig, to accept and place on file the Treasurer’s semi-annual report for July 1, 2010 through December 31, 2010.

 

      Convened Public Hearing on proposed plans, specifications, form of contract, estimated total cost for Ambulance West Satellite project to be located at the SEATS/Secondary Roads facility, 4810 Melrose Avenue West, Iowa City, at 9:02 a.m. 

 

      Facilities Manager David Kempf presented the proposed plans.  No one from the public spoke.

 

      Public Hearing closed at 9:04 a.m.

 

RESOLUTION 01-20-11-01

RESOLUTION APPROVING PLANS AND SPECIFICATIONS, FORM OF CONTRACT, COST ESTIMATE AND REQUESTING BIDS FOR JOHNSON COUNTY AMBULANCE WEST SATELLITE PROJECT

 

      Whereas, a public hearing was conducted on the 20th day of January, 2011, concerning proposed plans, specifications and form of contract for, and the estimated cost of Ambulance West Satellite project to be located at the SEATS/Secondary Roads facility, 4810 Melrose Avenue West, Iowa City;  and

 

      Whereas, the Johnson County Board of Supervisors has given due consideration to said proposed plans, specifications, form of contract for, and the estimated cost of, said project along with objections and evidence for or against the same as reflected by the record of the public hearing.

 

      Now, Therefore, be it Resolved that the proposed Johnson County Ambulance West Satellite project is in the best interest of Johnson County; and

 

      Be it Further Resolved that the estimated total cost of the Ambulance West Satellite project is $458,979.00; and

 

      Be it Further Resolved that the proposed plans, specifications and form of contract for, and the estimated total cost of said construction, are hereby approved as the plans, specifications and form of contract for, and estimated cost of said construction project; and

 

      Be it Further Resolved that sealed bids for the Johnson County Ambulance West Satellite project be solicited for receipt by the Johnson County Auditor, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, until 9:00 A.M. Central Time, February 15th, 2011.  Notice to bidders to be published pursuant to the Iowa Code; and

 

      Be it Further Resolved that the bid security to accompany each bid for the construction of the project shall be in the amount of five percent (5%) of the amount of the bid; and

 

      Be it Further Resolved that pursuant to Iowa Code Section 26.11, David Kempf, Johnson County Facilities Manager, is hereby delegated the duty of receiving and opening bids for this project, announcing the results, and reporting the results of the bidding with his recommendations to the Board of Supervisors at its next regular meeting or at a special meeting called for that purpose.

 

      Motion by Stutsman, second by Sullivan, to approve Resolution 01-20-11-01.  Roll call: Aye: Harney, Neuzil, Stutsman, Sullivan; nay: Rettig.

RESOLUTION 01-20-11-02

RESOLUTION APPROVING PLANS AND SPECIFICATIONS, FORM OF CONTRACT, COST ESTIMATE AND REQUESTING BIDS FOR JOHNSON COUNTY SHERIFF’S OFFICE CONTROL ROOM REMODEL PROJECT

 

      Whereas, a public hearing was conducted on the 20th day of January, 2011, concerning proposed plans, specifications and form of contract for, and the estimated cost of the Sheriff’s Office Control Room Remodel Project at 511 South Capitol Street, Iowa City, Iowa; and

 

      Whereas, the Johnson County Board of Supervisors has given due consideration to said proposed plans, specifications, form of contract for, and the estimated cost of, said project along with objections and evidence for or against the same as reflected by the record of the public hearing.

 

      Now, Therefore, be it Resolved that the proposed Johnson County Sheriff’s Office Control Room Remodel Project is in the best interest of Johnson County; and

 

      Be it Further Resolved that the estimated total cost of the Sheriff’s Office Control Room Remodel Project is $483,300.00; and

 

      Be it Further Resolved that the proposed plans, specifications and form of contract for, and the estimated total cost of said construction, are hereby approved as the plans, specifications and form of contract for, and estimated cost of said construction project; and

      Final consideration of Rezoning Application 16525 of Robert B. Adams requesting the rezoning of 9.75 acres from A – Agricultural to CH – Highway Commercial of certain property described as being in the SW 1/4 of the SW 1/4 Section 19, Township 78 North, Range 8 West of the 5th p.m. in Johnson County, Iowa. This property is located at the northeast corner of the intersection of 540th Street SW and Johnson-Iowa Road in Washington Township.

Zoning Application 16525

AN ORDINANCE AMENDING THE JOHNSON COUNTY UNIFIED DEVELOPMENT ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM

A – AGRICULTURAL TO CH – HIGHWAY COMMERCIAL

 

SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Unified Development Ordinance by changing the classification of the real estate described in Section II hereof from A – Agricultural to CH – Highway Commercial.

 

SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Washington Township and comprised of approximately 9.75 acres to wit:

 

      Beginning at the southwest corner of Section 19, Township 78N, Range 08W of the 5th P.M., thence east 700 feet, more or less, to the center of the cement road culvert, thence north 765 feet, thence west 700 feet, more or less, to the center of the highway, thence south 765 feet to the point of beginning, excluding Right-of-Way and the 1.5 acres that is currently zoned CH – Highway Commercial all in the SW 1/4 of the SW 1/4 of Section 19, Township 78N, Range 08W of the 5th P.M. located in Johnson County, Iowa.

is hereby changed from A – Agricultural to CH – Highway Commercial.

 

SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Chapter 8:1.5.I of the Johnson County Unified Development Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

 

SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

 

SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

 

      On January 13, 2011, motion by Stutsman, second by Sullivan, to waive the requirement of three considerations before amending an ordinance and to approve Rezoning Application 16525 on first and second consideration.  Roll call: aye: Harney, Neuzil, Stutsman, Sullivan, Rettig.

 

      Motion by Neuzil, second by Stutsman, to approve Rezoning Application 16525 of Robert B. Adams and approve Ordinance 01-20-11-Z1 on final consideration.  Roll call: Harney, Neuzil, Stutsman, Sullivan, Rettig.

 

      Motion by Rettig, second by Stutsman, to approve the following self-funded monthly rates for health care for FY 2012: Single: Current: $420.26, Proposed: $456.00; Family: Current: $1,166.24, Proposed: $1,265.42; Medicare Carveout: Current: $388.52, Proposed: $421.54.

 

      Motion by Sullivan, second by Neuzil, to approve the following monthly health care contribution for all non-bargaining employees of Johnson County effective July 1, 2011: Non-bargaining: Single: $7.50, Family: $40.00.

 

RESOLUTION 01-20-11-03

RESOLUTION AUTHORIZING THE PURCHASE OF PROPERTY PURSUANT TO THE IOWA HOMELAND SECURITY AND EMERGENCY MANAGEMENT DIVISION HAZARD MITIGATION GRANT VOLUNTARY PROPERTY ACQUISITION PROGRAM

 

      Whereas, in 2008 Johnson County, Iowa, including both incorporated and unincorporated areas thereof, experienced flooding of historic proportions; and

 

      Whereas, in response to this flooding and in an effort to mitigate its deleterious effects and prevent future flooding damage, Johnson County has elected to participate in the Iowa Homeland Security and Emergency Management Division Hazard Mitigation Grant Voluntary Property Acquisition Program (hereinafter “Flood Buyout Program”); and

 

      Whereas, Johnson County has had a Flood Buyout Program application approved by the applicable state and federal authorities, has submitted all relevant and proper documentation and is prepared to move forward with the purchase pursuant to the program.

 

      Therefore, Be it Resolved by the Johnson County Board of Supervisors that Johnson County is hereby authorized to enter into a purchase agreement for and to the property listed below pursuant to the Flood Buyout Program; and

 

      Be it Further Resolved that the property to be purchased under the authority of this Resolution includes: 3032 Riverfront Estates NE, Iowa City, owned by Mark J. Osiel; and

 

      Be it Further Resolved that the purchase price for said property shall be determined pursuant to the Administrative Plan previously adopted by the Board of Supervisors; and

 

      Be it Further Resolved that said purchase shall be contingent upon voluntary approval of the same by the current property owner and upon certain conditions to be set out in the formal purchase offers; and

 

      Be it Further Resolved that future use of said property by Johnson County shall be limited to open space, consistent with required Flood Buyout Program deed restrictions; and

 

      Be it Further Resolved that the Chairperson of the Board of Supervisors or its authorized representative is hereby authorized to sign said purchase offer and any other documents deemed necessary by the County Attorney to carry out the intent of this resolution and purchase said property.

 

      Motion by Sullivan, second by Stutsman, to authorize making a purchase offer pursuant to the Iowa Homeland Security and Emergency Management Division Hazard Mitigation Grant Voluntary Property Acquisition Program for 3032 Riverfront Estate NE, Iowa City, Iowa, owner Mark J. Osiel for $216,337.00 and approve Resolution 01-20-11-03.

 

      Motion by Rettig, second by Sullivan, to approve and authorize the Chairperson to send a letter to employees on the new parking policy.
