MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

FEBRUARY 10, 2011

 

      Chairperson Harney called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m.  Members present were: Pat Harney, Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Sullivan, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Stutsman, second by Sullivan, to approve the minutes of the formal meeting of February 3, 2011.

 

      Motion by Stutsman, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Rettig, to approve and authorize the Chairperson to sign a Renewal Application for a Class B Beer Permit, Application for Outdoor Service Area, and Application for Sunday Sales Privilege for Hi Point Golf Course, Iowa City, as submitted by Scott Wood.

 

      Convened Public Hearing on Zoning and Platting Applications at 5:32 p.m.

 

      First and Second consideration of Rezoning Application 14781 of Dennis L. Byrnes, Atalissa, Iowa, requesting the rezoning of 1.13 acres from A – Agricultural to R – Residential of certain property described as being located in the NE 1/4 of the NE 1/4 of Section 35, Township 81 North, Range 6 West of the 5th p.m. in Johnson County, Iowa. This property is located on the south side of Racine Avenue NE at its intersection with Jordan Creek Road NE in Big Grove Twp.

 

      Planning and Zoning Assistant Planner Josh Busard said the applicant has withdrawn the application.  Harney asked if the applicant submitted a letter stating they are withdrawing.  Busard said yes.  Assistant County Attorney Andy Chappell said the applicant can withdraw their application at any time and the Board does not need to take any action.

      Subdivision Application 15805 of Bruce Kienholz requesting preliminary and final plat approval of Bramblewood Estates Fifth Addition, a Resubdivision of lots 5 and 6 of Bramblewood Estates First Addition and Lot 1 of Bramblewood Estates Fourth Addition, a subdivision described as being located in the SW 1/4 of the SW 1/4 of Section 13 and the SE 1/4 of Section 14, Township 81 North, Range 7 West of the 5th p.m. in Johnson County, Iowa. This is a 3-lot residential subdivision consisting of 26.43 acres located at the intersection of Sandy Beach Road NE and Bramblewood Road NE in Jefferson Township.

 

      Busard said the applicant wants to rearrange the existing lot lines.  He said this application has been deferred since June, 2009, and the applicant must submit all legal documents and upgrade the wastewater systems.  Planning and Zoning staff has tried every means of contacting the applicant, and the applicant's engineer and attorney over the past year, however, no one has replied.  Staff recommends denial of Application 15805.

      Motion by Neuzil, second by Stutsman, to deny Subdivision Application 15805.

 

      Subdivision Application 16556 of Russell Chabal requesting preliminary and final plat approval of Chabal Farmstead, a subdivision described as being located in the NE 1/4 of the NE 1/4 of Section 35, Township 78 North, Range 6 West of the 5th p.m. in Johnson County, Iowa. This is a 1-lot farmstead split consisting of 4.37 acres located at the southwest corner of the intersection of Sand Road SE and 560th Street SE in Pleasant Valley Township.

 

      Busard said the applicant needs to receive a building permit, and since the property is in a floodplain, special permits must be obtained.  Stutsman asked how a mobile home was allowed on the property if it was in a floodplain.  Busard said the mobile home was placed on a farm, and the County does not regulate farms.  Stutsman said that was done prior to the farmstead split.

RESOLUTION 02-10-11-Z1

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF CHABAL FARMSTEAD

 

      Whereas, the owner has filed application 16556 for approval of a preliminary and final plat of Chabal Farmstead, and

 

      Whereas, the County Zoning Commission, having studied said application recommends that the plat be approved.

 

      Now, Therefore, be it Resolved by the Board of Supervisors of Johnson County, Iowa:

 

      1.  That said plat be approved.

      2.  That the Chairperson be directed to sign said plat and Subdivider's Agreement.

      3.  This Resolution requires the recording of the following documents: A. Resolution & Documents: Dedication, Title Opinion, Certificate of County Auditor, County Treasurer’s Certificate, Subdivider Agreement, Fence Agreement, Consent of Mortgagee, Demolition Letter, Easement for Public Highway, Agricultural Access Easement Agreement, Resolution Affirming the Stability of the Current Road System; B. Subdivision Plat (5); C. Road Right-of-Way Acquisition Plat (5).

 

      Motion by Rettig, second by Sullivan, to approve Resolution 02-10-11-Z1.

RESOLUTION 02-10-11-01

RESOLUTION AUTHORIZING STAFF TO SUBMIT THE FOLLOWING CAPITAL TRANSPORTATION PROJECTS AND COST ESTIMATES TO THE JOHNSON COUNTY COUNCIL OF GOVERNMENTS FOR INCLUSION IN THE REVISED LONG RANGE TRANSPORTATION PLAN TO BE ADOPTED MAY OF 2012

 

      Whereas, our community/organization is a member of the Johnson County Council of Governments; and

 

      Whereas, the Federal Highway Administration now requires that the JCCOG Long Range Transportation Plan include a fiscally constrained project list for the JCCOG urbanized area; and

 

      Whereas, the Johnson County Council of Governments Urbanized Area Policy Board has directed JCCOG staff to receive said capital transportation project lists by resolution.

 

      Now, Therefore, be it Resolved by the Board of Supervisors of Johnson County, Iowa, that:

 

      1.  The following list of anticipated federally funded projects be included in the revised version of the JCCOG Long Range Transportation Plan to be adopted by May of 2012.

      Motion by Stutsman, second by Sullivan, to approve Resolution 02-10-11-01.

 

RESOLUTION 02-10-11-02

AUTHORIZING WEIGHT EMBARGOES ON SECONDARY ROADS

 

      Whereas, the recent weather conditions have caused soft subgrade and surface conditions to develop on some Secondary Roads; and

 

      Whereas, it is deemed to be in the public interest and welfare to preserve the road system in the best possible condition; and

 

      Whereas, Sections 321.471, 321.472, and 321.473 of the Code of Iowa provide local authorities the right to restrict the weight of vehicles;

 

      Therefore, be it resolved that an embargo be authorized where necessary on the Secondary Roads System for Johnson County.  The County Engineer is authorized beginning on February 24, 2011, to restrict gross loads on certain sections of the road system showing extreme distress at this time.  He shall be authorized to restrict all traffic to an 8-ton gross load if necessary and to place temporary signs to comply with Section 321.472.

 

      Motion by Sullivan, second by Stutsman, to approve Resolution 02-10-11-02.

 

      Motion by Neuzil, second by Stutsman, to award the bid for a bridge replacement, RCB culvert extension, grading and PCC paving project on Oak Crest Hill Road just south of 565th Street over Crooked Creek in Section 33, T78N, R6W known as Johnson County Project LFM-R-33-9--7X-52, to Taylor Construction, Inc. for a total of $664,162.00.

 

      Motion by Rettig, second by Sullivan, to approve the application for tax suspension for 1350 Deerfield Drive, North Liberty, Iowa.

 

      Motion by Neuzil, second by Sullivan, to approve and authorize the Chairperson to sign the Sheriff’s contract for the provision of law enforcement services to the town of North Liberty from January 1, 2011 until September 30, 2011 for $34.00 per hour, for a total of up to $19,890.00.

 

      Motion by Stutsman, second by Sullivan, to set the public hearing on the Johnson County budget estimate for FY 2012 on Wednesday, March 2, 2011 at 6:00 p.m. and authorize the Auditor’s Office to publish the budget public hearing notice. 

 

      Motion by Neuzil, second by Rettig, to approve the blizzard emergency compensation for February 2, 2011.
