MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

FEBRUARY 24, 2011

 

      Chairperson Harney called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m.  Members present were: Pat Harney, Terrence Neuzil, Janelle Rettig, Sally Stutsman, and Rod Sullivan.

 

      Unless otherwise noted, all actions were taken unanimously.

 

      Motion by Stutsman, second by Sullivan, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Rettig, to approve the minutes of the formal meeting of February 17, 2011. 

 

      Motion by Stutsman, second by Rettig, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

 

      Motion by Sullivan, second by Stutsman, to approve and authorize the Chairperson to sign: a Renewal Application for a Class C Liquor License, Application for Outdoor Service Area, and Application for Sunday Sales Privilege for The Black Diamond Road House, Iowa City, as submitted by Gary Harding.

 

      Convened Public Hearing for General Obligation Refunding Loan Agreement in the amount of $1,985,000 at 9:02 a.m.

 

      County Treasurer Tom Kriz said the Board previously discussed refinancing this loan and the savings to the County will be about $95,000.  Harney asked if this is a new loan.  Kriz said no, this is to refinance debt from the original General Obligation County Purpose Note of 2008. 

 

      No one from the public spoke.

 

      Public Hearing closed at 9:03 a.m.  The resolution addressing the General Obligation Refunding Loan Agreement is deferred to March 3, 2011 at 9:00 a.m.

 

      Motion by Neuzil, second by Sullivan, to approve and authorize the Chairperson to sign the adoption of the current County Emergency Operations Plan (Disaster Plan/Multi Hazard Plan).  Motion withdrawn by Neuzil.

 

RESOLUTION 02-24-11-Z1

 

RESOLUTION APPROVING BUILDING PERMIT FEE SCHEDULE FOR JOHNSON COUNTY BUILDING CODE

 

      Whereas, the Johnson County Building Code requires individuals to secure a building permit prior to commencing certain work on buildings under its jurisdiction in Johnson County, Iowa; and

 

      Whereas, the Johnson County Building Code provides that fees for said building permits shall be as set out in the Building Permit Fee Schedule established by Resolution by the Johnson County Board of Supervisors; and

 

      Whereas, the Johnson County Building Code Board of Appeals has reviewed the following Building Permit Fee Schedule and recommends that the same be adopted by the Johnson County Board of Supervisors.

 

      Now, Therefore, be it Resolved by the Johnson County Board of Supervisors that the following Building Permit Fee Schedule be adopted:

 

BUILDING PERMIT FEE SCHEDULE

All permit fees collected by Johnson County may be included under the Building Permit

PLAN REVIEW FEES

1.  Projects permitted under the International Residential Code: No plan review fee.

2.  Projects permitted under the International Building Code: The plan review fee shall be a separate additional fee equal to 10% of the building permit fee.

3.  Additional plan review required by changes, additions or revisions to approved plans: (minimum charge – one half hour) $50.00 per hour.

4.  Use of outside consultants for plan checking and inspections or both: Actual costs.

 

MECHANICAL PERMIT FEES

1.  Work Related To One and Two Family Dwellings and Accessory Buildings: $50.

2.  Fees for all other occupancies, including commercial and industrial, are based on the total value of the electrical work and shall use the same fee table as for building permits.

 

PLUMBING PERMIT FEES

1.  Work Related To One and Two Family Dwellings and Accessory Buildings: $50.

2.  Fees for all other occupancies, including commercial and industrial, are based on the total value of the electrical work and shall use the same fee table as for building permits.

 

ELECTRICAL PERMIT FEES

1.  Work Related To One and Two Family Dwellings and Accessory Buildings: $50.

OTHER FEES

1.  Inspection outside of normal business hours: $50.00 per hour

2.  Re-inspection fee: $50.00 per hour

3.  Special inspection fee for which there is no permit*: $50.00 per hour

4.  Hearing before the Board of Appeals: $30.00

5.  Renewal of expired permit: $50.00

6.  Change of occupancy permit: $35.00

7.  Investigation for work started without a permit: Equal to Permit Fee

8.  Issuance of Temporary Certificate of Occupancy: $50.00

9.  Issuance of a Certificate of Occupancy: No charge

10.  Re-roof application: $100.00

11.  Retaining walls/fences: $100.00

12.  In-ground swimming pools: $200.00

13.  Above ground swimming pools: $100.00

14. Mobile Home placed in manufactured home communities: $200.00

 

*The special inspection fee may be used for a site visit prior to receiving a permit. The special inspection fee may be deducted from the permit fee upon permit approval if the permit pertains to the special inspection.

 

      Be it Further Resolved that this Building Permit Fee Schedule shall set forth the costs for various building-related permits in Johnson County until such time as this resolution is either rescinded, replaced or amended by the Board of Supervisors and that this resolution specifically rescinds the previously adopted Building Permit Fee Schedule set forth in Resolution 01-31-08-Z1; and

 

      Be it Further Resolved that the Chair of the Board of Supervisors is hereby directed to execute this resolution.

 

      Motion by Stutsman, second by Sullivan, to approve Resolution 02-24-11-Z1.

 

      Motion by Sullivan, second by Stutsman, to approve and authorize the Chairperson to sign the Application for Community Development Block Grant Funds to provide replacement housing benefit for qualified sellers.

 

RESOLUTION 02-24-11-01

 

RESOLUTION AUTHORIZING THE PURCHASE OF PROPERTY PURSUANT TO THE IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT COMMUNITY DEVELOPMENT BLOCK GRANT DISASTER RECOVERY PROPERTY ACQUISITION PROGRAM

 

      Whereas, in 2008 Johnson County, Iowa, including both incorporated and unincorporated areas thereof, experienced flooding of historic proportions; and

 

      Whereas, in response to this flooding and in an effort to mitigate its deleterious effects and prevent future flooding damage, Johnson County has elected to participate in the Iowa Department of Economic Development Community Development Block Grant Disaster Recovery Property Acquisition Program (hereinafter “Flood Buyout Program”); and

 

      Whereas, Johnson County has had a Flood Buyout Program application approved by the applicable state and federal authorities, has submitted all relevant and proper documentation and is prepared to move forward with purchase pursuant to the program.

 

      Therefore, be it Resolved by the Johnson County Board of Supervisors that Johnson County is hereby authorized to enter into a purchase agreement for and to purchase the property listed below pursuant to the Flood Buyout Program; and

 

      Be it Further Resolved that the property to be purchased under the authority of this Resolution is:

 

4402 Driftwood Lane, owned by John Rummelhart

 

      Be it Further Resolved that the purchase price for said property shall be determined pursuant to the Administrative Plan previously adopted by the Board of Supervisors; and

 

      Be it Further Resolved that said purchase shall be contingent upon voluntary approval of the same by the current property owner and upon certain conditions to be set out in the formal purchase offer; and

 

      Be it Further Resolved that future use of said property by Johnson County shall be limited to open space, consistent with required Flood Buyout Program deed restrictions; and

 

      Be it Further Resolved that the Chairperson of the Board of Supervisors and Johnson County’s Authorized Representative for said Program are hereby authorized to sign said purchase offer and any other documents deemed necessary by the County Attorney to carry out the intent of this resolution and purchase said property.

 

      Motion by Stutsman, second by Rettig, to approve Resolution 02-24-11-01.

 

RESOLUTION 02-24-11-B1

FY11 APPROPRIATION CHANGES TO SECONDARY ROADS (DEPT. 49) AND CAPITAL PROJECTS (DEPT. 85)

 

      Whereas, the appropriations for CAPITAL PROJECTS Capital Projects Service Area, are not sufficient to meet payments for various operational expenses, and

 

      Whereas, the SECONDARY ROADS Department has available funds in its budget; and

 

      Whereas, pursuant to section 331.434(6) of the Code of Iowa, a department appropriation may be decreased without a public hearing if the decrease is not more than the greater of $5,000 or ten percent of the department’s total budget; and

 

      Therefore, be it resolved that CAPITAL PROJECTS (Dept. 85), Capital Projects Service Area, is herewith appropriated an additional $850,000 and a total appropriation of $4,297,032 for fiscal year 2010-2011. The appropriation for SECONDARY ROADS (Dept. 49) is decreased $850,000 for a total of $760,050 for fiscal year 2010-2011.  The relevant county service area is Capital Projects, which remains unchanged.

 

      Motion by Neuzil, second by Stutsman, to approve Resolution 02-24-11-B1.

 

      Motion by Stutsman, second by Sullivan, to set the public hearing on the Johnson County budget amendment for March 17, 2011 at 9:00 a.m., and authorize the Auditor’s Office to publish public hearing notice.
