MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
MARCH 10, 2011
Chairperson Harney called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Pat Harney, Terrence Neuzil, Sally Stutsman, and Rod Sullivan. Janelle Rettig arrived at 5:35 p.m.
Unless otherwise noted, all actions were taken unanimously.
Clarence Leichty addressed the Board about recurring dangerous traffic incidents on Sharon Center Road.
Motion by Sullivan, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Sullivan, to approve the minutes of the formal meetings of March 2, 2011 and March 3, 2011.
Motion by Neuzil, second by Sullivan, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Sullivan, second by Stutsman, to approve and authorize the Chairperson to sign: a Renewal Application for a Class C Beer Permit, Application for Sunday Sales Privilege for Funcrest Bait & Tackle, Iowa City, as submitted by William Kallaus.
Motion by Rettig, second by Neuzil, to approve and authorize the Chairperson to sign: a Renewal Application for a Class C Beer Permit, Application for Sunday Sales Privilege for Morse Community Club, Inc, Iowa City, as submitted by David Smith.
RESOLUTION 03-10-11-B1
ADOPTING THE FISCAL YEAR 2011-2012 COUNTY BUDGET
AND CERTIFICATE OF TAXES
Whereas, the Board of Supervisors conducted a public hearing on March 2, 2011 whereupon the proposed fiscal year 2011-2012 county budget was presented to the citizens of Johnson County; and
Whereas, the citizens of Johnson County were invited to comment on the proposed fiscal year 2011-2012 county budget, as duly published in the official publications of Johnson County; and
Whereas, the Board of Supervisors appreciates the attendance at the public hearings and the comments from citizens who spoke at the public hearings, and encourages all citizens to be informed and participate in county government; and
Whereas, the Board of Supervisors has carefully taken into consideration the opinions expressed at the public hearing.
Therefore, be it resolved that the fiscal year 2011-2012 county budget and certificate of taxes is adopted as per the Proposed Johnson County Budget Summary for fiscal year 2011-2012.
Motion by Sullivan, second by Stutsman, to approve Resolution 03-10-11-B1.
Convened Public Hearing on Platting Applications at 5:46 p.m.
Subdivision Application 16555 of Andy Eckrich requesting preliminary and final plat approval of Eckrich Farm First Subdivision, a subdivision described as being located in the SE 1/4 of the SW 1/4 of Section 13, Township 79 North, Range 8 West of the 5th p.m. in Johnson County, Iowa. This is a 1-lot farmstead split consisting of 3.43 acres located on the north side of 400th Street SW approximately 2400 feet east of its intersection with Cosgrove Road SW in Hardin Township.
Planning and Zoning Assistant Planner Josh Busard said the applicant must apply for a building permit before any building can occur.
Scott Ritter of Hart-Frederick Consultants was present to answer questions.
RESOLUTION 03-10-11-Z1
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF ECKRICH FARM FIRST SUBDIVISION
Whereas, the owner has filed application 16555 for approval of a preliminary and final plat of Eckrich Farm First Subdivision, and
Whereas, the County Zoning Commission, having studied said application recommends that the plat be approved.
Now, Therefore, be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Owners Certificate, Title Opinion, Certificate of County Auditor, Treasurer’s Certificate, Subdivider’s Agreement, Covenant for Fences, Easement for Public Highway, Resolution Affirming the Stability of the Current Road System; B. Subdivision Plat (5); C. Road Right-of-Way Acquisition Plat (5).
Motion by Stutsman, second by Sullivan, to approve Resolution 03-10-11-Z1.
Subdivision Application 16557 of Timothy Furman requesting preliminary and final plat approval of Gilpin Grove Subdivision, a subdivision described as being located in the SE 1/4 of Section 28, Township 80 North, Range 6 West of the 5th p.m. in Johnson County, Iowa. This is a 2-lot residential subdivision consisting of 4.09 acres with two buildable lots located on the west side of Dubuque Street NE approximately 250 feet south of its intersection with Highview Knoll NE in Penn Township.
Busard said this plat is located in the B1 Northeast Planning Area of the Johnson County-Coralville Fringe Area Agreement, and the City of Coralville also required a voluntary annexation agreement which was received. Busard said a building permit is required before beginning any construction. Each lot will have a separate septic system.
Stutsman asked where the Lot One access will be. Busard said it is shared. Sullivan said if the lot is further subdivided, there will be an access driveway for that. Busard said correct. Stutsman asked for clarification of the voluntary annexation agreement. Busard said the annexation would occur at Coralville's request.
MMS Consultants Representative Sandra Steil was present to answer questions.
RESOLUTION 03-10-11-Z2
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF GILPIN GROVE
Whereas, the owner has filed application 16557 for approval of a preliminary and final plat of Gilpin Grove, and
Whereas, the County Zoning Commission, having studied said application recommends that the plat be approved.
Now, Therefore, be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Owners Consent for Subdivision, Attorney’s Title Opinion, Certificate of County Auditor, Certificate of Treasurer, Subdivider’s Agreement, Consent of Mortgagee, Municipal Improvements Agreement, Well Easement Agreement, Easement for Public Highway, Shared Well Maintenance and Usage Agreement, Easement Agreement for Access, Proceedings of the Coralville City Council, Resolution Affirming the Stability of the Current Road System; B. Subdivision Plat (5); C. Road Right-of-Way Acquisition Plat (5).
Motion by Neuzil, second by Sullivan, to approve Resolution 03-10-11-Z2.
Subdivision Application 16572 of Ila Ernst and Hills Bank and Trust Company, signed by Sandra Steil, MMS Consultants, requesting preliminary and final plat approval of Dads Place, a subdivision described as being located in the SE 1/4 of the NE 1/4 of Section 33, Township 80 North, Range 5 West of the 5th p.m. in Johnson County, Iowa. This is a 1-lot farmstead split consisting of 2.53 acres located on the west side of Wapsi Avenue approximately 3300 feet north of its intersection with 340th Street NE in Graham Township.
Busard said the applicant must remove one access and construct a new one before a building permit can be granted. Sullivan asked if the new access is required to meet the 500-foot sight distance requirement between the existing driveways. Busard said yes.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF DADS PLACE
Whereas, the owner has filed application 16572 for approval of a preliminary and final plat of Dads Place, and
Whereas, the County Zoning Commission, having studied said application recommends that the plat be approved.
Now, Therefore, be It Resolved by the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Documents: Owners’ Certificate, Title Opinion, Certificate of County Auditor, Certificate of County Treasurer, Subdivider’s Agreement, Fence Agreement, Well Agreement, Shared Access Easement Agreement, Resolution Affirming the Stability of the Current Road System; B. RESOLUTION 03-10-11-Z4
RESOLUTION APPROVING THE MORSE VILLAGE PLAN AS AN APPENDIX TO THE 2008 JOHNSON COUNTY LAND USE PLAN
Whereas, the Board of Supervisors finds that the Morse Village Plan is intended to supplement the 2008 Johnson County Land Use Plan specifically regarding future growth in Morse and the surrounding area; and
Whereas, the Board of Supervisors finds that it is in the public interest to adopt said Morse Village Plan as an appendix to the 2008 Johnson County Land Use Plan.
Now, Therefore be it Resolved by the Johnson County Board of Supervisors, that the following Morse Village Plan, copies of which can be obtained at the Johnson County Planning and Zoning Office, Johnson County Auditor’s Office, or at www.johnson-county.com, is hereby adopted as an appendix to the Johnson County Land Use Plan.
Be it Further Resolved that this Morse Village Plan shall become effective as an Appendix to the Land Use Plan upon adoption of this Resolution.
Motion by Sullivan, second by Neuzil, to approve Resolution 03-10-11-Z4 with the amendments to the map as discussed during the March 10, 2011 Formal Meeting of the Board of Supervisors.
Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign the letter to the Iowa Department of Transportation pledging local contributions for the Iowa Passenger Rail operating subsidy.
Motion by Stutsman, second by Sullivan, to approve and authorize the Chairperson to sign a contract for Archeological Services for the Hazard Mitigation Grant Program (HMGP) Property Acquisition Demolition Program Project with Wapsi Valley Archaeology of Anamosa, Iowa at a cost not to exceed $22,036.00.
