MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

FEBRUARY 1, 2000

Chairperson Stutsman called the Johnson County Board of Supervisors to order at the Johnson County Fairground in Montgomery Hall at 5:30 p.m. Members present were: Charles Duffy, Jonathan Jordahl, Mike Lehman, Sally Stutsman, and Carol Thompson.

Unless otherwise noted, all actions were taken unanimously.Convened Public Hearing on Proposed Building Code for Johnson County at 5:30 p.m.

Stutsman said the Board of Supervisors would not be making a decision on the proposed building code at this meeting, and the Board of Supervisors was only present to hear comments from the public.

Planning and Zoning Administrator Rick Dvorak explained the process the County went through in getting to the point where they had a proposed Building Code for Johnson County.

Building Code Study Committee Chairperson Gary Werle introduced the members of the Building Code Study Committee: Jane Hagedorn, David Wright, Dwight Dobberstein, Tom Bockenstadt, Mike Sattler, Les Kuehl, Gary Eden and Jim Martinek. Werle said it is the recommendation of the Committee to adopt a Building Code for Johnson County, which would be adoption of the Uniform Building Code, including the Uniform Plumbing, Uniform Mechanical, and the National Electric codes. He said enforcement of the Code would apply to all construction and remodeling on Industrial, Commercial, Agricultural, and Residential zoned land in the county. He said farm structures would be exempt provided that they meet the definition of a farm as outlined in the Johnson County Zoning Ordinance.

Curt Moore, Roy Walton, Dave Guenther, Gene Wehrheim, Tony Serbousek, Orville Yoder, Kip Sheldon, Bill Eden, Betty Proe, Tim Borchardt, Carroll Eden, Don Kerr, Steve Foss, Jerry Denison, Bill Young, Libertarian Party Representative Christy Welty, and Tom Kane, spoke against the proposed Johnson County Building Code.

Howard Himmelreich, Bill Schiefer, Ben Moore, Dean Yanausch, Tom Carsner, Rob Phipps, League of Women Voters Representative Carol Spaziani, Homebuilders Association President Keith Kerf, Homebuilders Association member Mark Hall, and Jack Jessup, spoke for the proposed Johnson County Building Code.

Roger Titone, Glenn Kasper, and Phil Wagner spoke regarding the proposed building code.

Motion by Thompson, second by Lehman, to have all written correspondence entered into the record of the public hearing.

Public Hearing closed and meeting adjourned at 7:05 p.m.
