MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
FEBRUARY 10, 2000
Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Charles Duffy, Jonathan Jordahl, Mike Lehman, Sally Stutsman, and Carol Thompson.
Unless otherwise noted, all actions were taken unanimously.
Motion by Duffy, second by Jordahl, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Jordahl, second by Lehman, to approve the minutes of the formal meetings of February 1, 2000, and February 3, 2000.
Motion by Thompson, second by Duffy, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Thompson, second by Jordahl, to adopt the Johnson County Respectful Work Environment Policies effective April 1, 2000.
Motion by Thompson, second by Lehman, to approve and authorize the Chairperson to sign the Iowa Department of Transportation Agreement for Federal-Aid Surface Transportation Program (STP) Project STP-S-C052--5E-52.
Motion by Lehman, second by Jordahl, to approve and authorize the Chairperson to send a letter of support regarding Grant Proposal to McElroy Trust in Waterloo, Iowa.
Motion by Jordahl, second by Thompson, to approve and authorize the Chairperson to sign the contract between Johnson County SEATS and StrataGen, Inc. for the purchase and installation of paratransit scheduling software for $65,000.
Motion by Duffy, second by Thompson, to accept the Johnson County Jail Overcrowding Study Committee Report.
Motion by Lehman, second by Duffy, to appoint County Auditor Tom Slockett, County Treasurer Tom Kriz, Supervisor Carol Thompson, County Sheriff Bob Carpenter, and Jail Study Committee Chair Pete Hayek, to a working group to develop a request for proposals to select a potential financial consultant regarding the County Jail project.
Recessed at 5:46 p.m.; reconvened as a Public Hearing on Conditional Use Permit, Zoning and Platting applications at 6:00 p.m.
Application CU9904 of Donna Hostetler requesting a Conditional Use Permit to operate a dog grooming business as a home business on property described as being Lot 2 of River Oaks II Subdivision located in the NW 1/4 of Section 35; Township 81 North; Range 7 West of the 5th P.M. in Johnson County, Iowa (This parcel is located on the south side of River Oaks Drive NE, a private road off of Highway 965 NE in Madison Twp.)
Charlotte Young, and Pat Novack spoke against the application. Donna Hostetler spoke for the application and asked for a 30 day deferral.
Motion by Jordahl, second by Duffy, to defer application CU9904 for 30 days and continue the public hearing.
Application Z9951 of V & C Farm Company, signed by Lenore Manrique, Hills, Iowa, requesting rezoning of 7.56 acres from A1 Rural to RS-5 Suburban Residential of certain property described as being in the SE 1/4 of the SE 1/4 of Section 6; Township 78 North; Range 6 West of the 5th P.M. in Johnson County, Iowa (This property is located in the NW quadrant of Naples Avenue SW and 480th Street SW in Liberty Twp.)
Glen Meisner of MMS Consultants, Inc. and Lenore Manrique spoke for the application.
Jordahl said they can’t approve applications based on people’s financial situation. Stutsman said they would be able to put a house on this land without rezoning. Lehman and Duffy said the best use of the land is a residence. Thompson said the parcel is on a gravel road and they want to preserve the agricultural life style.
Motion by Duffy, second by Lehman, to waive the requirement of three considerations before amending an ordinance and to approve Application Z9951 on first and second consideration. Roll call: aye: Lehman, Duffy; nay: Jordahl, Stutsman, Thompson.

Application S9904A of Wayne Yoder, signed by Douglas P. Frederick of Hart-Frederick Consultants P C, requesting preliminary and final plat approval of Sawmill Acres, a subdivision described as being located in the NW 1/4 of Section 28; Township 78 North; Range 8 West of the 5th P.M. in Johnson County, Iowa (This is a 3-lot (1-lot residential, 1-lot Heavy Industrial and 1-outlot subdivision), 6.46 acres, located on the SE side of Angle Road SW and on the north side of 550th Street SW, east of the Calkins Avenue SW and 550th Street SW intersection in Washington Twp.)
Michael Brenneman, attorney for the applicant, spoke for the application.
RESOLUTION 02-10-00-Z1
APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF SAWMILL ACRES, JOHNSON COUNTY, IOWA
Whereas, the owner has filed application S9904A for approval of a preliminary and final plat of Sawmill Acres, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved By The Board Of Supervisors Of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: Owner Certificate; Title Opinion; Certificate of the Treasurer; Consent of Mortgagee; Fence Agreement; Subdivider's Agreement; Resolution Affirming the Stability of the Current Road System

Application S9958 of Loren Southwick and Johnson County Emergency Management, signed by Tom Hansen, requesting preliminary and final plat approval of Picnic Point Subdivision (A Resubdivision of Government Lot 5), a subdivision described as being located in the South 1/2 of Section 27; Township 79 North; Range 6 West of the 5th P.M. in Johnson County, Iowa (This is a 2-lot, 61.2 acre, residential subdivision, located at the northeast end of Izaak Walton Road SE in West Lucas Twp.)

Whereas, the owner has filed application S9958 for approval of a preliminary and final plat of Picnic Point, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved By The Board Of Supervisors Of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: Owner Certificate; Title Opinion; Certificate of the Treasurer; 2 Consent of Mortgagee; Access / Maintenance Easement; Resolution Affirming the Stability of the Current Road System; Subdivider's Agreement with Fence Agreements

Application S9966 of Irvin Grout requesting preliminary and final plat approval of Robert Grout Subdivision, a subdivision described as being located in the East 1/2 of the SE 1/4 of Section 28; Township 78 North; Range 7 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 13.51 acre, farmstead split, located on the west side of James Avenue SW, approximately 1/2 mile south of it intersection with 540th Street SW in Sharon Twp.)
Michael Brenneman, attorney for the applicant, was present to answer questions.

Whereas, the owner has filed application S9966 for approval of a preliminary and final plat of Robert Grout Subdivision, and
Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.
Now, Therefore, Be It Resolved By The Board Of Supervisors Of Johnson County, Iowa:
