MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
MARCH 21, 2000
Chairperson Stutsman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:02 a.m. Members present were: Charles Duffy, Jonathan Jordahl, Mike Lehman, Sally Stutsman, and Carol Thompson.
Unless otherwise noted, all actions were taken unanimously.
Motion by Duffy, second by Lehman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Lehman, second by Jordahl, to approve the minutes of the formal meetings of March 8th and March 9th for Johnson County Mental Health/Developmental Disabilities Services Plan for FY2001, and the formal minutes of March 9th, March 14th, and March 15th, 2000. Roll Call: aye: Lehman, Jordahl, Stutsman, Duffy; abstain: Thompson.
Motion by Duffy, second by Thompson, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Reconvened Public Hearing of March 9, 2000, on Fringe Area Agreement between Johnson County and Solon at 9:05 a.m.
Planning and Zoning Administrator Rick Dvorak explained the Fringe Area Agreement process. Dean Miller had questions concerning the Fringe Area Agreement.

RESOLUTION 03-21-00-Z1
APPROVING A FRINGE AREA AGREEMENT BETWEEN THE CITY OF SOLON, IOWA, AND JOHNSON COUNTY, IOWA
Whereas, Chapter 28E of the Code of Iowa (1999) enables two or more local governments to enter into agreements to cooperate for their mutual advantage; and
Whereas, it is the interest of Johnson County and the City of Solon, Iowa to establish policies for the orderly growth and development within the City’s extraterritorial jurisdiction; and
Whereas, Johnson County and the City of Solon mutually agree that such policies are necessary to more effectively and economically provide services for future growth and development and to protect and preserve the extraterritorial area’s natural resources and its environmentally sensitive features.
Now, Therefore, Be It Resolved By The Board Of Supervisors Of Johnson County, Iowa:
1. That the Johnson County Board of Supervisors hereby accepts and agrees to the policies outlined within the Fringe Area Agreement.
2. That the Chairperson be directed to sign said Agreement.
Motion by Thompson, second by Lehman, to approve Resolution 03-21-00-Z1.
Application Z00001 of Dean E. Rebal, Solon, Iowa, and Dale A. Rebal, Cedar Rapids, Iowa, requesting rezoning of 16.58 acres from A1 Rural and RS Suburban Residential to RS-10 Suburban Residential of certain property described as Lot 2 of Rebal’s First Subdivision described as being located in the NW 1/4 of Section 6; Township 80 North; Range 5 West of the 5th P.M. in Johnson County, Iowa (This property is located on the east side of Iowa Highway #1 NE, approximately 1.75 miles south of Solon, Iowa in Newport Twp.).
On March 9, 2000, motion by Duffy, second by Thompson, to waive the requirement of three considerations before amending an ordinance and to approve Application Z00001 on first and second consideration. Roll call: aye: Lehman, Thompson, Duffy; nay: Jordahl; absent: Stutsman. (This motion constitutes passage on first consideration only due to the lack of three-fourths of the entire Board voting aye.)

Application Z00002 of Dewey and Darlene Nielsen, Oxford, Iowa, requesting rezoning of 1.02 acres from CH Highway Commercial to RS Suburban Residential of certain property described as Lot 1 of Sleepy Hollow Subdivision described as being located in the SW 1/4 of the SW 1/4 of Section 32; Township 80 North; Range 8 West of the 5th P.M. in Johnson County, Iowa (This property is located on the east side of Black Hawk Avenue NW, approximately 1/4 of a mile north of I-80 in Oxford Twp.).

AN ORDINANCE AMENDING THE JOHNSON COUNTY ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM CH TO RS
SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Zoning Ordinance by changing the classification of the real estate described in Section II hereof from CH to RS.
SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Oxford Township and comprised of approximately 1.02 acres to wit:
That part of Lot 1 Sleepy Hollow Subdivision as recorded in plat book 28 at page 78, Johnson County Recorder’s Office, Iowa City, Iowa, more particularly described as follows: Beginning at the NW corner of said Lot 1; thence North 73° 30’20" East along the north line of said Lot 1, 225.00 feet; thence South 07° 51’38" West, 261.34 feet; thence South 90° 00’00" West, 180.00 feet to the west line of said Lot 1; thence North 00° 00’00" West along the west line of said Lot 1, 195.00 feet to the Point of Beginning, containing 1.02 acres, more or less, and is subject to any restrictions or easements of record.
is hereby changed from CH to RS.
SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Article V, Section 2 of the Johnson County Zoning Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.
SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.
SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

Application Z00007 of Wayne and Audrey Miller, Wellman, Iowa, requesting rezoning of 3.23 acres from A1 Rural to RS-3 Suburban Residential of certain property described as being located in the SE 1/4 of the SE 1/4 of Section 18; Township 78 North; Range 8 West of the 5th P.M. in Johnson County, Iowa (This property is located on the north side of 520th Street SW, approximately 1/4 of a mile west of its intersection with Black Hawk Avenue SW in Washington Twp.).
On March 9, 2000, motion by Duffy, second by Thompson, to waive the requirement of three considerations before amending an ordinance and to approve Application Z00007 on first and second consideration. SETTING PUBLIC HEARING FOR VARIOUS ZONING AND PLATTING APPLICATIONS
Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on March 13, 2000 filed its report and recommendations for certain actions;
Now, Therefore, Be It Resolved as follows:
A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 13th day of April, 2000 at 6:00 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following: (Z00003) Trosky/Seda, (Z00009) Gingerich, (Z00010) Jansa & Sons Inc./Gaddis, (Z00011) Grabin, (Z00012) Kelch, (Z00013) Forbes, (S9968) Thuerauf, (S00003) Rohret, (S00005) Pechous and (S00006) Millard

Motion by Thompson, second by Duffy, to approve Resolution 03-21-00-Z2.
Motion by Thompson, second by Duffy, to waive the rezoning fees for River Products (RS to A1) and Eldon T. Miller (M2 to A1).
Motion by Duffy, second by Jordahl, to approve and authorize the Chairperson to send Marie Weldon a letter of appreciation and certificate for serving on the Johnson County Commission of Veteran Affairs.
Motion by Jordahl, second by Thompson, to appoint Mike Scheer to the Johnson County Courthouse Security Committee.
Motion by Duffy, second by Lehman, to approve and authorize the Chairperson to sign the following Applications For Fireworks Permit: Duane Kasper, 1412 Brookwood Drive, Iowa City, on June 24, 25 or 27, 2000; and Jim Rammelsberg, 1892 Amana Rd. NW, Swisher, on July 1 or 4, 2000.
