MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 4, 2001

Chairperson Lehman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.

Unless otherwise noted, all actions were taken unanimously.

Motion by Stutsman, second by Neuzil, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Thompson, second by Harney, to approve the minutes of the formal meeting of December 28, 2000 and January 2, 2001.

Motion by Stutsman, second by Neuzil, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Motion by Stutsman, second by Thompson, to accept the Recorder’s Report of Fees Collected for the month of November, 2000, in the amount of $84,322.78, as submitted by County Recorder Kimberly Painter.

Motion by Stutsman, second by Thompson, to approve and authorize the Chairperson to sign the Courthouse restrooms remodeling contract with Apex Construction for $134,100.

Local amendments to the 1997 Uniform Building, 1997 Uniform Mechanical, 1997 Uniform Plumbing, and the 1999 National Electrical Codes.

On December 28, 2000, motion by Thompson, second by Lehman, to approve the local amendments to the 1997 Uniform Building, 1997 Uniform Mechanical, 1997 Uniform Plumbing, and the 1999 National Electrical Codes on first and second consideration. Roll Call: aye: Lehman, Jordahl, Stutsman, Thompson; nay: Duffy.

Motion by Stutsman, second by Thompson, to approve the local amendments to the 1997 Uniform Building, 1997 Uniform Mechanical, 1997 Uniform Plumbing, and the 1999 National Electrical Codes on final consideration and approve Ordinance 01-04-01-Z1. Roll Call: aye: Neuzil, Stutsman, Lehman, Thompson, Harney.

RESOLUTION 1-04-01-01

FARM TO MARKET CONSTRUCTION PROJECTS

Be it resolved by the Board of Supervisors of Johnson County, Iowa, that Mike Gardner, the County Engineer of Johnson County, Iowa, be and is hereby designated, authorized, and empowered on behalf of the Board of Supervisors of said County to execute the certification of completion of work and final acceptance thereof in accordance with plans and specifications therefore in connection with all Farm to Market construction projects in this county.

Motion by Thompson, second by Neuzil, to approve Resolution 1-04-01-01.

RESOLUTION 1-04-01-02

AUTHORIZING THE IOWA DEPARTMENT OF TRANSPORTATION TO HOLD LETTINGS ON FARM TO MARKET PROJECTS

Whereas, rules and regulations of the Iowa Department of Transportation require authorization from local County Boards of Supervisors to hold Farm to Market project lettings;

Now therefore be it resolved that the Iowa Department of Transportation may hold lettings on projects financed from the Farm to Market Road Fund.

Motion by Stutsman, second by Harney, to approve Resolution 1-04-01-02.

RESOLUTION 01-04-01-03

DEFINING CONDITIONS UNDER WHICH COUNTY ROADS MAY BE TEMPORARILY CLOSED

Whereas, Section 306.41, Code of Iowa (1999), provides for the closing of certain highways when necessary for maintenance, construction or natural disaster;

Therefore be it resolved:

That all portions of roads in the 2001 Construction Program be closed when necessary during the construction processes;

That any roads having maintenance operations performed necessitating closure be closed when necessary;

That any portions of road incurring some type of natural disaster be closed when necessary; and

The actual dates of closure are to be determined by the County Engineer for each necessary closure.

Motion by Stutsman, second by Thompson, to approve Resolution 01-04-01-03.

Motion by Stutsman, second by Neuzil, to approve and authorize the Chairperson to sign the contract and contractor’s bond with DeLong-Keith Construction, Inc. for bid received for Johnson County grading and bank stabilization project L-2001-G-1 on Mehaffey Bridge Road NE (Lake MacBride Causeway) for $106,597.40.

Motion by Thompson, second by Stutsman, to approve and authorize the Chairperson to sign the contract and contractor’s bond with Metro Pavers, Inc. for bid received for Johnson County recreational trail project STP-E-C052(55)--8V-52 on Dubuque Street NE from Butler Bridge to West Overlook Road NE, for $307,469.65.

Motion by Thompson, second by Neuzil, to cancel the formal and informal meeting of the Board of Supervisors for January 25, 2001.
