MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 30, 2001

Chairperson Lehman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:04 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.

Unless otherwise noted, all actions were taken unanimously.

Convened Public Hearing on Zoning and Platting Applications at 9:04 a.m.

Application Z00034 of Iowa District East Camp (IA-DIS-E-CA), Solon, Iowa, signed by Paul Golke, camp director, requesting the Johnson County Board of Supervisors to remove a court imposed use restriction on Lot 12 of Sandy Beach Farms Addition described as being located in the North 1/2 of Section 24; Township 81 North; Range 7 West of the 5th P.M. in Johnson County, Iowa (This property is located on the north side of Sandy Beach Road NE, approximately one mile east of its intersection with Lake Manor Road NE in Jefferson Twp.).

Assistant Planning and Zoning Administrator R.J. Moore said the Applicants have requested that Application Z00034 be denied.

Motion by Stutsman, second by Harney, to accept the withdrawal of Application Z00034.

Application S00044 of Johnson County Emergency Management Agency and Loren Southwick, signed by Loren Southwick, requesting preliminary and final plat approval of Picnic Point Subdivision Part II (A Resubdivision of Lot 1 of Picnic Point Subdivision) a subdivision described as being located in the South 1/2 of Section 27; Township 79 North; Range 6 West of the 5th P.M. in Johnson County, Iowa (This is a 2-lot (1 residential with 1 non-buildable outlot), 28.70 acre, residential and floodplain buy-out subdivision, located on the north side of Camino Del Rio a private road at the end of Izaak Walton Road SE in West Lucas Twp.).

Disaster Services Director Tom Hansen spoke in favor of the application.

RESOLUTION 01-30-01-Z1

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF PICNIC POINT SUBDIVISION PART II, JOHNSON COUNTY, IOWA.

Whereas, the owner has filed application S00044 for approval of a preliminary and final plat of Picnic Point Subdivision Part II, and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, Therefore, Be It Resolved By The Board Of Supervisors Of Johnson County, Iowa:

1. That said plat be approved.

2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.

3. This Resolution requires the recording of the following documents: Owner Certificate; Title Opinion; Certificate of the Treasurer; 2 Consents of Mortgagee; Consent of Subdivider; Access Easement Agreement; Subdivider's Agreement; Restrictive Covenant; Water Line Easement Agreement; Resolution Affirming the Stability of the Current Road System

Motion by Stutsman, second by Thompson, to approve Resolution 01-30-01-Z1.
