MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
FEBRUARY 15, 2001
Chairperson Lehman called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Thompson, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Harney, to approve the minutes of the formal meeting of February 8, 2001.
Motion by Neuzil, second by Thompson, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Neuzil, to place on file the Clerk’s Report of Fees Collected for the month of January, 2000, in the amount of $7,505.19, as submitted by Clerk of District Court Lodema Berkley.
Application Z00035 of Lee M. Grabin, Oxford, Iowa, signed by Rozella Sorsenson Grabin, requesting rezoning of 6.19 acres from A1 Rural and RS Suburban Residential to RS-5 Suburban Residential of certain property described as Lot 1 of Windy Hills Subdivision located in the SW 1/4 of Section 10; Township 80 North; Range 8 West of the 5th P.M. in Johnson County, Iowa (This property is located on the north side of 255th Street NW, approximately 2/3 of a mile east of its intersection with Upper Old Highway #6 NW in Oxford Twp.).

AN ORDINANCE AMENDING THE JOHNSON COUNTY ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM A1 & RS TO RS-5
SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Zoning Ordinance by changing the classification of the real estate described in Section II hereof from A1 & RS to RS-5.
SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Oxford Township and comprised of approximately 6.19 acres to wit:
Commencing at the Southwest corner of the Northwest one-quarter of the Southwest one-quarter of Section 10, Township 80 North, Range 8 West of the Fifth Principal Meridian, Johnson County, Iowa; Thence N89°24'43"E, along the south line of said Northwest one-quarter, 663.63 feet to the Southwest corner of the Southeast one-quarter of said Northwest one-quarter of the Southwest one-quarter and Point of Beginning; Thence N00°02'18"E along the west line of the east one-half of the south 10 acres of said Northwest one-quarter of the Southwest one-quarter, 328.16 feet; Thence N89°24'43"E along the north line of said east one-half of the south 10 acres, 663.85 feet; Thence S00°04'35"W along the east line of said east one-half of the south 10 acres, 312.05 feet to a point on the northerly right-of-way of 255th Street NW; Thence S87°36'10"W, along said northerly right-of-way line 218.11 feet; Thence southwesterly, 271.11 feet along said northerly right-of-way line and an arc of 324.21 foot radius curve, concave southeasterly, whose 263.28 foot chord bears S63°38'50"W; Thence S39°41'29"W, along said northerly right-of-way line, 264.10 feet; Thence southwesterly, 60.21 feet along said northerly right-of-way line and an arc of 382.81 foot radius curve, concave northwesterly, whose 60.14 foot chord bears S43°24'47"W; Thence N00°02'18"E, along the west line of the Northeast one-quarter of the Southwest one-quarter of the Southwest one-quarter of said Section 10, a distance of 349.98 feet to said Point of Beginning, containing 6.19 acres and subject to easements and restriction of record.
is hereby changed from A1 & RS to RS-5.
SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Article V, Section 2 of the Johnson County Zoning Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.
SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.
SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.
On February 8, 2001, motion by Thompson, second by Harney, to waive the requirement of three considerations before amending an ordinance and to approve Application Z00035 on first and second consideration. Roll call: aye: Neuzil, Stutsman, Lehman, Thompson, Harney.

RESOLUTION 02-15-01-Z1
Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on 2000, filed its report and recommendations for certain actions;
Now, Therefore, Be It Resolved as follows:
1. A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 8th day of March, 2001 at 6:00 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the following: (Z00033) Luneckas, (S01001) Peterson, (S01002) Wick
2. That the Johnson County Auditor be authorized to publish the official notice of the above public hearing.
Motion by Stutsman, second by Thompson, to approve Resolution 02-15-01-Z1.
Motion by Stutsman, second by Neuzil, to approve and authorize the Chairperson to sign the letter to the City of Iowa City regarding the Fringe Area Agreement with the clarification that Johnson County will be involved in the process.
RESOLUTION 02-15-01-01
Whereas, the Johnson County Targeted Case Management program has been surveyed by the Iowa Division of Mental Health and Developmental Disabilities and has been found to be in compliance with conditions set forth in Chapter 24 of the Administrative Rules, and
Whereas, the Johnson County Targeted Case Management program has been awarded the highest accreditation by the Iowa Commission on Mental Health and Developmental Disabilities,
Now
Therefore Be it resolved, that the Johnson County Board of Supervisors commends the staff of Johnson County Mental Health and Developmental Disabilities Services for their exemplary performance in serving the individuals and communities of Johnson County.
Motion by Neuzil, second by Stutsman, to approve Resolution 02-15-01-01.
Motion by Thompson, second by Harney, to approve and authorize the Chairperson to sign the letter of thanks to the City of Coralville for their donation of space for the Johnson County Ambulance Service.
Motion by Harney, second by Thompson, setting the public hearing over the proposed Johnson County budget for March 6, 2001 at 5:30 p.m. and authorize the Auditor to publish.
