MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 10, 2002

Chairperson Thompson called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:30 p.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.

Unless otherwise noted, all actions were taken unanimously.

Motion by Stutsman, second by Lehman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Lehman, second by Neuzil, to approve the minutes of the formal meetings of January 2, 2001 and January 3, 2001.

Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Motion by Lehman, second by Harney, to accept the County Auditor’s Quarterly Report of Fees Collected for the quarter ending December 31, 2001, in the amount of $2,167.71, as submitted by County Auditor Tom Slockett.

ORDINANCE 01-10-02-01

AN ORDINANCE REPEALING 09-27-01-01 AND ESTABLISHING VOTING PRECINCTS IN JOHNSON COUNTY

Section I. Purpose. The purpose of this ordinance is to revise the voting precincts in Johnson County and repeal Ordinance 09-27-01-01 adopted September 27, 2001.

Section II. Precinct name and description.

Big Grove Big Grove Township, not including the City of Solon.

Cedar Cedar Township.

Clear Creek Clear Creek Township, not including the City of Tiffin.

Fremont Fremont Township, including the City of Lone Tree.

Graham Graham Township.

Hardin Hardin Township.

Iowa City Precinct 12 Beginning at the intersection of Industrial Park Road and Highway 6; north on Industrial Park Road to the Iowa Interstate railroad tracks; east on the railroad tracks to the east corporate limits of Iowa City; following the corporate limits of Iowa City south to Hwy. 6; west along Highway 6 to Sioux Avenue; south on Sioux Avenue to Napoleon Street; west on Napoleon Street and the East Lucas township boundary to the Iowa River; north on the Iowa River to the corporate Iowa City limits; east on the corporate Iowa City limits to Sycamore Street; north on Sycamore Street to California Avenue; east on California to Union Road; south on Union to Nevada street; east on Nevada to Miami Drive; north on Miami Drive to Hollywood Blvd.; west on Hollywood Blvd. to Fairmeadows Boulevard; north on Fairmeadows to Hwy. 6; east on Hwy. 6 to the point of beginning.

North Liberty Precinct 1 Beginning at the intersection of Hwy 965 and Dubuque Street; then south on Hwy 965 to Penn Street; then east on Penn Street to the western boundary of the CRANDIC Railroad right-of-way; then south along the railroad right-of-way approximately 1.5 miles to the boundary of the unincorporated area on the east side of the railroad right-of-way; then east along the City boundary and around the south and west boundaries of the City boundary to the intersection of Kansas Avenue and Clear Creek township; then east along the Clear Creek township boundary to the City boundary; then around the west and north boundaries of the City back to the point of beginning.

North Liberty Precinct 2 Beginning at the intersection of Hwy 965 and Dubuque Street; then south on Highway 965 to Penn Street; then east on Penn Street to the eastern boundary of the CRANDIC Railroad right-of-way, then south along the railroad right-of-way to the City boundary north of the unincorporated parcel; then east following the boundary of the unincorporated parcel back to the eastern boundary of the railroad right-of-way; then south along the railroad right-of-way to the City boundary on the east side of the railroad right-of-way; then east following the City boundary around the southern, eastern and northern City boundary back to the point of beginning.

Oxford Oxford Township, including the City of Oxford.

Scott Scott Township, including that portion of the City of West Branch inside Johnson County.

Section III. Repealer. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section IV. Savings Clause. If any section, provision, or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

Section V. Effective Date. This ordinance shall be in effect January 15, 2002, after its passage and publication as part of the proceedings of the Board of Supervisors.

On December 27, 2001, motion by Harney, second by Thompson, to approve on first consideration an ordinance establishing voting precincts in Johnson County. Roll call: aye: Neuzil, Lehman, Thompson, Harney; absent; Stutsman.

On January 3, 2002, motion by Stutsman, second by Harney, to approve on second consideration an ordinance establishing voting precincts in Johnson County. Roll call: aye: Neuzil, Stutsman, Thompson, Lehman, Harney.

Motion by Stutsman, second by Harney, to approve on final consideration Ordinance 01-10-02-01, an ordinance establishing voting precincts in Johnson County. Roll call: aye: Neuzil, Stutsman, Thompson, Lehman, Harney.

Motion by Harney, second by Neuzil, to approve and authorize the chairperson to sign the letter of agreement with the City of North Liberty to combine two rural township precincts with their respective contiguous North Liberty precincts.

Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to sign the Precinct Population Certification based upon the voting precinct ordinance.

Motion by Neuzil, to exempt garbage haulers from the annual oil road embargoes on Johnson County Secondary Roads. Motion died for lack of a second.

Motion by Lehman, second by Stutsman, to approve and authorize the Chairperson to send a letter and Certificate of Appreciation to Rae Blanchard, Diane Duncan-Goldsmith, Elizabeth McKray, Helen Moe, Reverend Robert Welsh, and Ruth Bell for serving on the Johnson County Nutrition Advisory Board (Title V) Heritage Agency on Aging.

Motion by Harney, second by Stutsman, to re-appoint Mike Gardner to the East Central Iowa Council of Governments ISTEA Technical Advisory Committee for a term ending January 1, 2005.

Whereas, the owner has filed application S01044 for approval of a preliminary and final plat of Stanley Yoder Subdivision, and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, Therefore, be it Resolved by the Board of Supervisors of Johnson County, Iowa:

1. That said plat be approved.

2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.

3. This Resolution requires the recording of the following documents: Owner Certificate; Title Opinion; Treasurer’s Certificate; Subdivider's Agreement; Fence Agreement; Resolution Affirming the Stability of the Current Road System

A subdivision described as being located in the NE 1/4 of SW 1/4 of Section 8, Township 79 North, Range 7 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 2.21 acre farmstead split, located on the west side of Half Moon Avenue SW, approximately 1/4 mile north of its intersection with the IWV Road in Union Twp.).
