MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 31, 2002

Chairperson Thompson called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.

Unless otherwise noted, all actions were taken unanimously.

Motion by Harney, second by Lehman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Stutsman, second by Neuzil, to approve the minutes of the formal meeting of January 24, 2002.

Motion by Lehman, second by Harney, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

RESOLUTION 01-31-02-01

POSTING STOP SIGN AT EAST LUCAS TOWNSHIP LOCATION

Whereas, the Iowa Code requires that the Board of Supervisors must authorize all stop signs on the Secondary Road System; and

Whereas, Johnson County has reconstructed Prairie Du Chien Road NE creating a new intersection of the old roadway alignment with the new alignment located in the NE1/4 of Section 34, Township 80 North, Range 6 West of the 5th P.M.; and

Whereas, the Johnson County Board of Supervisors has received a request to install additional traffic control at the above location; and

Whereas, the Johnson County Engineer has investigated said intersection and determined that it would be in the public interest and enhance traffic safety to place additional traffic control at the above location;

Therefore be it resolved by the Johnson County Board of Supervisors upon recommendation of the County Engineer that the traffic approaching said intersection from the South on the "old" alignment be stopped, and the County Engineer is further directed to cause the erection of proper signing.

Motion by Stutsman, second by Harney, to approve Resolution 01-31-02-01.

RESOLUTION 01-31-02-02

TO SET A DATE FOR A PUBLIC HEARING FOR A PROPOSED BRIDGE REPLACEMENT AND APPROACH GRADING PROJECT ON EAGLE AVENUE IN SECTION 10, T79N, R8W

PROJECT NUMBER BROS-C052(58)--8J-52

Whereas, Johnson County, State of Iowa, proposes to acquire property under the power of Eminent Domain for a public improvement project, pursuant to the provisions of Section 6B.2A of the Code of Iowa, for the purpose of a Bridge Replacement and Approach Grading Project on Eagle Avenue in Section 10, T79N, R8W Project Number BROS-C052(58)--8J-52, and it is necessary to set a date of meeting of the Johnson County Board of Supervisors, at which it is proposed to consider taking action on the proposed public improvement project and to give notice thereof as required by such law;

Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, as follows:

Section 1. This Board of Supervisors shall meet on the 14th day of February, 2002, at the Johnson County Administration Building, located at 913 South Dubuque Street, Iowa City, Iowa at 5:45 p.m., at which time and place a hearing will be held and proceedings will be instituted to consider funding the site-specific design for public improvement, final selection of the route or site location for the public improvement, and to authorize acquisition of private property needed for the project by condemnation proceedings if necessary.

Section 2. The County Engineer is hereby directed to give notice of the proposed public hearing to consider funding the site-specific design for public improvement, final selection of the route or site location for the public improvement, and to authorize acquisition of private property needed for the project by condemnation proceedings if necessary. The Auditor is hereby directed to provide notice by publication not less than 4 nor more than 20 days before the meeting in a legal newspaper, which has a general circulation in Johnson County.

Motion by Stutsman, second by Harney, to approve Resolution 01-31-02-02.

Motion by Lehman, second by Stutsman, to appoint Jerry Musser to the Compensation Commission for a term ending December 31, 2002.

Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to send Judy Felder and Richard Rhodes a letter of appreciation and certificate for serving on the Johnson County Integrated Roadside Vegetation Management Committee.
